HomeMy WebLinkAbout91-151 - Resolutions RESOLUTION NO. 91-151 A RESOLUi~ON OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCA~, CALIFORNIA, DECIARIlqG ITS INT~qTION TO LEVY AND COT.T.~CT ASSES~ ~ S~ T.TGH~ ]~- NANCE DISTRICTS NOS. 1, 2, 3, 4, 5, 6, 7, AND 8, FOR THE FISCAL YEAR 1991/92 PURSUANT TO THE IANDSCAP~ AND LIGHTING AC~ OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS T~ERETO WHerEAS, the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the Lardscaping and Lighting Act of 1972, being Division 5 of the Streets and HighwaysCodeofthe State of California, does resolveas follc~s: Description of Work SECTION 1: ~nat the public interest and convenience require and it is the intention of this City Council to levy and collect assessments within Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8 for the fiscal year 1991/92 for the mintenance and operation of those parkways, parks and facilities thereon dedicated for co,non greenbelt purposes by deed or recorded subdivision tract map within the boundaries of said Districts. Said mintenance and operation includes the cost and supervision of street lighting maintenance (including repair, removal or replacement of all or any part of any improvement providing for illumination of the subject area) in connection with saiddistricts. Location of Work SECTION 2: ~ne foregoing described work is to be located within the roadway rights-of-way and easements enumerated in the report of the City Engir~_r and more particularly described on maps which are on file in the City Clerk's Office, entitled "Assessment Diagx-ams Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8". Description of Assessment District SECTION 3: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the work chargem__ble upon the districts, which said districts, are assessed to pay the costs and expenses thereof, and which districts are described as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boumdmry lines shown upon that certain '94ap of Street Lighting Maintenanoe District No. 1", '94ap of Street Lighting Maintenance District No. 2", '94ap of Street Lighting Maintenance District No. 3", '5Map of Street Lighting Maintenance District No. 4", '94ap of Street Lighting District No. 5, '94ap of Street Lighting Maintenance District No. 6", '~4ap of Street Lighting Maintenance District No. 7", '94ap of Street Lighting Maintenance District No. 8", indicating by said boundary lines the extent of the Resolution No. 91-151 Page 2 territory included within each assessment district and which maps are on file in the office of the City Clerk of said City. Reference is hereby made to said maps for further, full and more particular description of said ~ districts, and the said maps so on file shall govern for all details as to the extent of said assessment Report of Enqineer SECTION 4: The City Council of said City by Resolution No. 91-152 has approved the annual report of the City Engineer which report indicates the amount of the proposed assessments, the district boundaries, asset zones, and the method of assessment. The report title "Annual Engineer's Report" is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Time and Place of Hearing SE~TION 5: Notice is hereby given that on the 3rd day of July, 1991, at the hour of 7:00 o'clock P.M. in the City Council Chambers in the City of Rancho Cu~, located at 10500 Civic Center Drive, any and all persons may appear and sb~w cause why said work should not be done or carried out or why assessments should not be levied and collected for fiscal year 1991/92. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk of said City prior to the time set for the hearing, and no other protests or objections will be considered. If the signer of any protest is not shown upon the last equalized assessment roll such protest must contain or be acc~ed by written evidence that such signer is the owner of the property so described. Landscapir~ and Liqhtin~ Act of 1972 SECTION 6: All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated as the Landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California. Publication of Resolution of Intention S~DCTION 7: Published notice shall be made pursuant to Section 6961 of the Gov~-rm~nt Code. The Mayor shall sign this Besolution and the City Clerk shall attest to the same, and the City clerk shall cause the same to be published 10 days before the date set for the hearing, at least once in the Inland Valley Daily Bulletin, a ~ of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamorm3a, California.
