HomeMy WebLinkAbout91-149 - Resolutions RESOI3/fION NO. 91-149 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO C~, CAT.TFORNIA, D~2IARING ITS //qI~FfION TO LEVY DISTRICTS NOS. 1, 2, 3A, 3B, 4, 5, 6, 7, AND 8 FOR FISCAL YEAR 1991/92 PURSTJANT TO THE LANDSCAP~ AND LIGh'I~NG ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECITONS THEREIO WHEREAS, the City Council of the City of Pancho Cucamonga, pursuant to the provisions of the Landscaping and Lighting ~t of 1972, being Division 5 of the Streets and Highways Code of the State of California, does hereby resolve as follows: Description of Existinq and Proposed Work. S~CITON 1: ~nat the public interest and convenience require and it is the intention of this City Council to levy and collect assessments within Landscape Maintenance Districts Nos. 1 through 8, inclusive, for fiscal year 1991-1992 for the maintenance and operation of (i) existing and previously approved improvements incl,~tir~g those parkways, parks and facilities thereon dedicated for cc~m¥~n greenbelt purposes by deed or recorded subdivision tract map within the boundaries of said districts and (ii) proposed additional improvements which include the Bear Gulch Park facilities. Said maintenance and operation shall include costs to '%aaintain" and "service" the improv~aents as those terms are defined in Sections 22531 and 22538 of the Streets and Highways Code. Said costs shall also include the administration and supervision r~ired in order to pz~vide such maintenance Location of Existinq and Proposed Improvements. SECTION 2: The existing improvements to be maintained and serviced are located within the public right-of-way and landscaping easements delineated in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitled "Assess- ment Diagrams Landscape Maintenance District Nos. 1 through 8, inclusive." The proposed additional improvements are located within publicly owned lands delineated in the report of the city Engineer. Description of Assessment Districts. S~CTION 3: That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the work chargeable upon the districts, which said districts are assessed to pay the costs and expenses thereof, and which districts are described as follows: Rmsolution No. 91-149 Page 2 All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shown upon that certain '~ap of Landscape Maintenance District No. 1", '9~ap of Tan4.~.ape Maintenance District No. 2", 'T~ap of T.~,n,,-1.¢:r_.ape Main'te.n~ District No. 3A", '9~ap of Landscape Maintenance District No. 3B", '9~ap of Landscape Maintenance district No. 4", '9~ap of ~pe Mainteduance District No. 5", 'SWap of T~ndscape Maintenance District No. 6", '~ap of Tandscape Maintenance District No. 7", '~ap of Landscape Maintenance District No. 8", indicating by said bour~ lines the extent of the territory included within each assessment district and which maps are on file in the office of the City Clerk of said City. Reports of E~ineer. S~CTION 4: The City Council by Resolution No. 91-150 has approved the annual report of the City Engineer which report contains the following: a. Plans and specifications for the maintenance and services to be provided to the existing and proposed improvements, and b. An estimate of the costs of providing the maintenance and service for the existing and proposed improv-~ts, and c. Diagrams of the assessment districts, including any zones within any of the assessment districts, and d. An a~sessment of the estimated costs of providing the maintenance and service for the existing and proposed improvements, including the method of assessment. The report, entitled "Annual Engineer's Report", is on file in the office of the City Clerk. Reference is made to such report for a full and detailed description of the existing and proposed i~provements to be maintained and serviced, the boundaries of the assessment district and any zones therein, and the proposed ~ upon assessable lots and parcels of land within the various assessment district. Time and Place of Hearing. S~2TION 5;: Notice is hereby given that on the 3rd day of July, 1991, at the hour of 7:00 o'clock P.M. in the City Oouncil Chambers of the City of Randuo Cucamonga, any and all persons may appear and show cause why said ma~ and service for the existing ~ and the proposed imp~ should not be done or carried out or why assessments should not be levied and collected for fiscal year 1991-1992. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk prior to the time set for the hearing and no other protests or objections will be considered. If the signer of the protest is not shown upon the last equalized assessment roll as the owner of the ~ for which the protest b~ been filed, such protest must contain or be accc~panied by written evidence that such signer is the owner of the property so described. SECTION 6: All work herein proposed shall be done and carried through in pursuance of an act of the legislature of tb~ State of California designated as the Landscap~ and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of Califox~ia. Publication of Resolution of Intention. SECTION 7: Published notice shall be made pursuant Section 6961 of the Gove~-,ment Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before tb~ date set for the hearing, at least o~ce in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the city of Ontario, California, and circulated in the City of Rancho PASSf~), APPROVfD, and ADOPI~D this 5th day of June, 1991.
