A RESOLUTION OF THE CITY OOUNCIL OF THE CITY OF RANCHO

BERNARDINO ODUNTY'S IT.T.VGAL OFFSET OF OOUNTY BOOKING FEE
WHEREAS, the State Legislature in t_he late hours of the 1990 legisla-
tive session approved Senate Bill 2557 allowing counties to charge cities
booking fees putting cities against counties; and
WHEREAS, San Ber~ County adopted booking fees in Jan,,~y, 1991,
over the protests of all the cities and law enforcement agencies of the
county, including the Sheriff; and
WHEREAS, all 22 cities in the county filed suite against San
B~ County in Superior Court, Case #262309; and
WHEREAS, the County began billing cities for booking fee charges
retroactive to July 1, 1990; and
WHEREAS, the cities dutifully protested such charges pursuant to
Government Code Section 907; and
WH~5~FAS, in April, 1991, the County began offsetting such booking fee
charges against property tax and other revenues legally obligated to the
cities in contravention to State law.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve to officially protest San Ber~ County's illegal offset of
County booking fee charges against the City property tax and other revenues.
~ne City Clerk is hereby directly to have a certified copy of this Resolution
sent to 2nd District County Supervisor Jon Mikels, the Clerk of the Board of
Supervisors, County Auditor/Controller - Recorder, the Oounty f~ief
Administrative Officer, the news media and all cities in the County.
