HomeMy WebLinkAbout91-114 - Resolutions RESOLUI~ONNO. 91-114 A RESOLUI~ON OF THE CITY ODUNCIL OF ~HE CITY OF RAN(~O CUCAMDNGA, CALIFORNIA, AUTHORIZ]]qG THE EXt~/3TION AND SIGNING OF PROGRAM SUPPL~F~ NO. 17 TO I3DCAL AGenCY - STATE AG~~ NO. 08-5420 FOR PRk~,TN[[NARY ~qGIN~ OF THE ARR~ ROUTE BRIDGE WID~qING AT CUCAMONGA ~k~J{ WHEREAS, the City Council of the City of Rancho Cucamonga (herein- after referred to as "Local Agency"), has for its consideration and execution, the Program Supplement No. 17 to Local Agency - State Agreement No. 08-5420 for Preliminary Engineering of the Arrow Route Bridge Widening at Cucamonga WHERFAS, the State of California, Depa~ h~nt of Transportation, District Office 8 (hereinafter referred to as "State") processes and monitors Federally funded projects; and WHEREAS, as a condition to payment of Federal funds for said projects, the Local Agency shall approve and execute said Program Supplement No. 17. NC~, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve to: 1. Authorize the Execution of Supplement No. 17 to Local Agency - State Agreement No. 08-5420 for Preliminary Engineering of the Arrc~ Route Bridge Widening at Cucamonga Creek Project in the City of Rancho Cucamonga, San Bernardg~ County. 2. To authorize the Mayor to sign said Supplement and direct the City Clerk to attach a certified copy of this Resolution, as well as type in the Resolution number and date in the blanks of the third block of said Supplement and for the return of the original copies of said Supplement to the State of California Department of Transportation along with the certified copy of this Resolution. BE IT ~ RESOLVED that the Local Agency shall also comply with the "Special Covenants or Remarks" attached to said Supplement including: 1. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI ~CE of the aforementioned Master Agreement, will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. ~ Local Agency will advertise, award and administer this project and will obtain the State's concurrenoe prior to either award or rejection of the contracts. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal Aid Project Agreement (PR-2) /Detail Estimate, or its modification (PR-2A) or t_he FNM-76, and accepts any increases in Local Agency Funds as shcm~ on the Finance or Bid Letter or its modification as prepared by the Division of LocaL Streets and Roads. 4. In executing this Program Supplemental Agreement, Local A~ency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal Aid Program. 5. Whenever the Local Agency uses a consultant on a cost plus basis, the Local Agency is required to suhnit a post-audit report covering the allowability of cost payments for each individual consultant or sub-contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced to CFR 49, part 18, Subpart C-22, Allowable PASSfD, APPROVfD, and ADOPI~D this 1st day of May, 1991.
