A RESOLUTION OF THE CITY COUNCIL OF ~HE CITY OF RANCHO
A PORTION OF AN ALT,FY
WHEREAS, by C~k~pter 4, Article 1, Section 8331, of the Streets and
Highway Code, the City of Rancho Cucamonga is authorized to s~m~rily vacate a
portion of an alley herein more particularly described; and
WHEREAS, the City Council found all the evidence submitted that the
portion of an alley is unnecessary for present or pr~ive public street
purposes because it has not been used for more than five (5) consecutive years
and no public money was e~ed for maintenance of said alley during such
period.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
SECTION 1: That the City Council hereby makes its order vacating the
portion of an alley as shown on map V-097 on file in the offioe of the City
Clerk of the City of Rancho Cucamonga which has been further described in a
legal description which is attached hereto, marked Exhibit "A", and by
reference made a part thereof.
S~CTION 2: That the subject vacation shall be subject to the
reservations and exceptions, if any, for existing utilities on record.
S~L~TION 3: ~hat frc~ and after the date the resolution is recorded,
said portion of the alley no longer constitutes a street or public easement.
S~CTION 4: That the City Clerk shall cause a certified copy of this
resolution in the office of the County Recorder of San Bernardino, California.
S~CTION 5: That the City Clerk shall certify to the passage and
adoption of this resolution, and it shall tbmreupon take effect and be in
force.
