Oouncil of the City of Rancho Cucamo~ (herein- after referred to as "Local Ager~'), b~-~ f~r its oonsideration and execution, the Progr~ Supplement No. 16 to Local A~ency - State A~3reement No. 08-5420 for Construction and ~ion Engineering including advert~t, award and administration of the Arrow Route Bridqe Widening at Cucamonga Creek Project. WHEREAS, the State of California, Department of Transportation, District Office 8 (hereinafter referred to as "State") processes and monitors Federally funded projects; and WHeedleS, as a condition to payment of Federal funds for said projects, the Local Agency shall approve and execute said Program Supplement No. 16. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve to: 1. Authorize the Execution of Supplement No. 16 to Local Agency - State Azlreement No. 08-5420 for O3nstruction and Construction Engineering including advertS, award and administration of tb~ Arrow Route Bridge Widening at Cucam~ Creek Project in the City of P~ncho O~_camonga, San Ber~ County. 2. To authorize the Mayor to sign said Supplement and direct the City Clerk to attach a certified copy of this Resolution, as well as type in the Resolution number and date in the blank of the third block of said supplement and for the return of the original copies of said supplement to the State of California Department of Trar~ortation along with the certified copy of this Resolution. BE IT FURI}{~R RESOLVED that the Local Agency shall also comply with the "Special Covenants or R~m~rks" attached to said supplement including: 1. All ma/ntenance, involvinq the physical oondition and the operation of the i~, referred to in Article VI MAINTt~qAN~ of the aforementioned Master Agre~_nt will be performed by the Local Aqency at regular intervals or as required for efficient operation of tb~ cc~le~ improvements. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the co~tra~. 3. ~he Local Agency agrees the payment of Federal funds will be limited to the amounts ap~ by tb~ Federal Highway Adminis- tration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the F~4-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of hereby reaffirms the '9;c~discrimination Asst~-~gces,, contained in the aforementioned M~-~cer Agreement for Federal-Aid Program. 5. Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to sukmit a post audit repcTt covering the allowability of cost payments for each individual consultant or sub-c~ractor incurring over $25,000 on the project. The audit re~z~t ~ust state the applicable cost principles utilized by the auditor in det~mining allowable costs as ref~ in CFR 49, part 18, Subpart C - 22, Allowable Costs.
