HomeMy WebLinkAbout91-057 - Resolutions RESOL[/I~ONNO. 91-057 A RESOLUTION OF THE CITY ODUNCIL OF THE CITY OF RANCHO AM~qD THE G~RAL PLAN LAND USE MAP FRC~ OFFICE TO M~I)i-dM RESID~qTIAL (8-14 E~FLLING UNITS PER ACRE) FOR 3.56 ACRES OF LAND, ~ AT THE SOUTHEAST OORNER OF ~BALD ~HEREOF A. Recitals. (i) Pitassi/Dalmau Architects bm.~ filed an application for General Plan Amendment 90-0lB as described in the title of this Resolution. Herein- after in this Resolution, the subject General Plan Amendment is referred to as "the application." (ii) On August 22, 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and rec~ended its approval to the City Council. (iii) On September 19, and continued to November 21, 1990, and February 20, 1991, the City Council of the City of Rancho Cucamonga conducted duly noticed public hearings on the application. (iv) All legal prerequisites to the adoption of this Resolution have B. Resolution. NC~, ~{EREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. ~nis Council hereby specifically finds that all of the facts set forth in the Recitals, Part "A", of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearings on September 19, and continued to November 21, 1990, and Fmhruary 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to approximately 3.56 acres of land, basically a rectangular configuration, located at the southeast corner of Archibald Avenue and Church Street and is presently vacant. Said property is currently designated as Office; and (b) The property to the north and west of the subject site is designated Low Residential and is developed with single family units. The property to the east is designated Medium Residential and is developed with residential condcmziniums. The property to the south is designated Medium Residential and is developed with residential apartments and vacant; and Rmsolution No. 91-057 Page 2 (c) This amendment does not conflict with the ~and Use Policies of the General Plan and will provide for development within the district in a manner consistent with the General Plan and with related developments; and (d) This amendment does promote the goals and objectives of the Land Use Element; and (e) This ~ would not be materially injurious or detrimental to the adjacent properties, would not have a significant impact on the environment nor the surrour~in~ properties, and that issuance of a Negative Declaration is recc~,,~_nded. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearings and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follows: (a) That the subject property is suitable for the uses permitted in the proposed General Plan Land Use Designation and Development District in terms of access and size, as evidenced by the site's exceeding the City's mJ_nJ3mmn lot size requirements, and compatibility with existing surrounding land uses, as evidenced by the site's being bordered on the east and south by parcels of land with the same land use designation; and (b) That the proposed amendment would not have significant impacts on the environment nor the surrour~li~g properties as evidenced by the conclusions and findings of the Initial Environmental Study and the implementation of mitigation agreements between the property owner and the Chaffey Joint Union High School District and the Central School District; and (c) That the proposed amendment is in confo~ with the General Plan and Development Code due to the site's capacity to promote the goals and objectives for residential development. 4. This Council hereby finds that the project ham been reviewed and considered in co~¥~01iance with the California Environmental Quality A~t of 1970 and, further, this Council hereby approves the issuanoe of a mitigated Negative Declaration. 5. Based upon the findings and conclusicms set forth in paragraphs 1, 2, 3, and 4 above, this Council hereby resolves that pursuant to Section 65850 to 65855 of the California Govem~-~ent Code, the City Council of the City of Rancho Cuca~o~ hereby approves c~1 this 20th day of February 1991, of General Plan Amendment No. 90-0lB. 6.
