A RESOLUTION OF THE CITY (IXAKIIL OF THE CITY OF RANC~{O
CTk/AMONGA, CALIFORNIA, AUUAORIZING THE EX~L-LTION OF AN
AM~qD~ AND RESTAT~) JOINT EX~CISE OF POWERS AG~~
AUTHORITY
WHEREAS, the City Oouncil of the City of Rancho Cucamom]a does hereby
resolve as follows:
W~EREAS, the City, the City of Ontario and the Rancho Cucamonga Fire
Protection District have heretofore approved and ~ a joint exercise of
powers agreement, dated February, 21, 1990, creatir~ the West End C~..L~lnica-
tions Financing Authority (the "Authority") Im/rsuant to Articles 1 through 4
(cc~m~ncing with section 6500) of Chapter 5, Division 7, Title 1 of the
California Government Code (the "Agreement"); and
WHEREAS, it is necessary and desirable to amend and restate the
Agreement to, among other things, provide for the membership of the City of
Chino, California, in the Authority.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby find, determine and order as follows:
SfL~ION 1: Amended and Restated Aqreement. ~ne City Council hereby
approves and authorizes the Mayor, the City Manager, any Assistant City
Manager or Finance Director to execute and tb~ City Clerk to attest an amended
and restated Agreement, in substantially the form on file with the City Clerk,
together with any changes therein deemed advisable by the City Attorney.
SRCTION 2: Appointment of Director. The City Manager of the City,
or his designee, is hereby appointed as the City's representative as Director
of the Authority.
SRCTION 3: Official Actions: The Mayor, the City Manager, any
Assistant City Manager or the Finance Director, the City Clerk of the City and
all other proper officers of the City are hereby authorized and directed to
take all actions and do all things necessary or desirable hereunder with
respect to the formation of the Authority, including but not limited to the
execution and delivery of any and all agreements, certificates, instruments
and other documents, which they, or any of them, may deem necessary or
desirable and not inconsistent with the purposes of this Resolution.
SfL'TION 4: Effective Date. ~nis Resolution shall take effect from
and after the date of its passage and adoption.
