HomeMy WebLinkAbout91-009 - Resolutions RESOLUTION NO. 91-009 A RESOLUI~ON OF THE CITY COUNCIL OF THE CITY OF RANC~K) CUCAMONGA, CATJ?FORNIA, DESIGNATING A PORITON OF COI~X~4DOD ~AY AS A PRIVATE STREET AND ~ THE ~ 12.08 OF q~E ML~rICIPAL CODE WHEREAS, the City Council of the City of Rancho Cucamonga ha~ decided that certain residential streets, being unique in nature, functio~ as private residential streets; and WHEREAS, the City Council has decided that properties abutting private streets should be exempted from certain requirements normally attributable to public streets; and WHEREAS, the city Council ham adopted Ordinance No. 58-C creating and estm_blishing the authority to designate oertain streets as private residential WHEREAS, the City Council finds the follc~ing conditions for implementation prior to designation of a portion of Cottonwood Way as a private street. A. Remove and replace failed portions of existing A.C. with 3" A.C. over cc~pacted native as determined by Engineering and Fire Division. Widen pavement to 26 feet wide with 3" A.C. over oc~pa~ native for full length of street. Overlay 1" thick of A.C. over remaining existing A.C. B. Provide documentation indicating minimum of 26 feet wide private access easement for the full length of that portion of Cottonwood Way which extends from Hellman Avenue to approximately 665 feet west of Hellman Avenue. C. Provide f~r additional private access easement for an emergency vehicle paved turnaround in accordance with Section 10.207(g) of the Uniform Fire Code at the westerly terminus of the above mentioned portion of Cottonwood Way. D. Barrier urotection for existing fire hydrants. E. CC and R's or equivalent covenant agreement approved by the City Attorney concerning proper mintenance of Street, signed by all property owners, within a period of 6 months from City Council designation of private street. F. Roadway width to have a height clearance of 14.5 feet. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follc~s: SECTION 1: That the above recitals are all true and correct. Resolution No. 91-009 Page 2 S~CTION 2: Said above cc~ti~ have to be cc~leted and approved by the City of Rancho Cucamong~ for said portic~ of ~ Way which extends frc~ Hellman Avenue to apprc~tsly 665 feet w~st of Hellman Avenue prior to designation as pri~ate streets ~ effective and the abutting properties to be exempted fr~m the req~ts set fcx~h from the provisions of Chapter 12.08 of the City of Rancho Cucamong~ M~nicipal Code. SECTION 3: With the designation of that portion of Cottonwood Way as a private street, it shall join the list of so designated private streets set forth on Exhibit "A" attached hereto and incorporated herein by reference. Bella Vista Road Sapphire Street to Private street designation 1325 feet ~-~t adopted based on 70% Carnelian Street to. representation of petitioning 1320.5 feet west property owners and 100% favorable representation at Public Hearing. 3. Scott lane Palo Alto to 630 Private street designation feet north adopted based on 83% representation 4. Mai Street Almond Street to Private Street designation approximately 385 adopted based on 100% feet north representation of petitioning property owners. Specific conditions have to be met in order for the declaration of private street bec~ effective in accordance with Resolution No. 90-452 5. Cottonwood Way Hellman Avenue to 665 feet west
