HomeMy WebLinkAbout98-137 - ResolutionsRESOLUTION NO. 98-137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO QUITCLAIM A PORTION OF A 14' STRIP OF SAN BERNARDINO ROAD EAST OF THE FOOTHILL BOULEVARD INTERSECTION 8351 SAN BERNARDINO ROAD - APN'S 207-571-76 A. RECITALS: 1. California Government Code Section 37350 provides as follows: "A City may purchase, lease, receive, hold and enjoy real and personal property and control and dispose of it for the common benefit." 2. California Government Code Section 37351 provides in pertinent part as follows: "The legislative body (City Council) may... dispose of, and convey such property for the benefit of the City .... " 3. The Planning Commission of the City Rancho Cucamonga heretofore made the finding on July 8, 1998, that disposing of said property, herein contemplated, would be in conformity with the General plan of the City of Rancho Cucamonga. B. RESOLUTION: NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. All the fact stated in the Recitals, Part A, of this Resolution hereby are found to be true and correct. That the City Council hereby declares its intention to dispose of a 14' strip of San Bernardino Road east of the Foothill Boulevard signalized intersection as shown on Map V-151. That the City Council hereby fixes Wednesday, the 2nd day of September, 1998 at 7:00 p.m., in the City Council Chambers, located at 10500 Civic Center Drive, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation for the purpose of its determining whether said City streets are necessary for present or prospective street purposes. That the City Street Superintendent shall cause notices to be posted conspicuously along the line of the street or part thereof proposed for disposition at least 14 days before the hearing, not more than 300 feet apart and not less Resolution No. 98-137 Page 2 than three signs shall be posted, each of which shall have a copy of this resolution on them and shall have the following title in lettering not less than one inch in height: "NOTICE OF HEARING TO DISPOSE OF EXCESS STREET RIGHT-OF-WAY". The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk cause same to be published 14 days before the date set for the hearing, at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
