HomeMy WebLinkAbout98-158 - ResolutionsRESOLUTION NO. 98-158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CALIFORNIA FINDING THAT CERTAIN REAL PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, TO BE SURPLUS AND A BURDEN ON THE CITY OF RANCHO CUCAMONGAAND AUTHORIZING THE CITY ENGINEER TO SIGN THE QUITCLAIM DEED AN TO PRESENT SAME TO THE COUNTY RECORDER TO BE FILED FOR RECORD WHEREAS, by Resolution No. 98-137 passed on August 5, 1998, the Council of the City of Rancho Cucamonga declared it intention to quitclaim a portion of City street hereinafter more particularly described, and set the hour of 7:00 p.m. on September 2, 1998, in the City Council Chambers, located at 10500 Civic Center Drive, Rancho Cucamonga, California, as the time and place for hearing all person objecting to the proposed disposition by quitclaim; and WHEREAS, The City Council found all the evidence submitted that the portion of San Bernardino Road is unnecessary for present or prospective public street purposes; and WHEREAS, since that portion of San Bernardino Road is owned by the City of Rancho Cucamonga in fee, a Quitclaim Deed is required, hereby remising, releasing and quitclaiming the right to said portion of San Bernardino Road; and WHEREAS, such public hearing has been held at said time and place and there were no protests, oral or written, to such disposition by quitclaim. NOW THEREFORE BE IT RESOLVED by the Council of the City of Rancho Cucamonga as follows: SECTION 1: The council hereby makes its order vacating that portion of San Bernardino Road ( a 14 foot strip fronting 8351 San Bernardino Road) as shown on map V-151a, on file in the office the City Clerk of the City of Rancho Cucamonga, which has been further described in a legal description and plat attached hereto, marked Exhibit "A" and "B", and by reference made a part hereof. SECTION 2: That from and after the date the resolution is recorded, said portion of San Bernardino Road no longer constitutes a street or public utility easement. SECTION 3: That the City Engineer is authorized to sign the Quitclaim Deed and to present same to the County Recorder to be filed for record. SECTION 4: That the City Clerk shall cause a certified copy of this resolution and exhibits to recorded along with the Quitclaim Deed in the office of the County Recorder of San Bernardino County, California. Resolution No. 98-158 Page 2 SECTION $: That the City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force.
