HomeMy WebLinkAbout78-39 - Resolutions RESOLUTION NO. 78-39 A RESOLUTION OF THE PLANNING CflMMISSION OF THE CITY OF RANCHO CUCAMONGA RECC~fMENDING A GROWTH MANAGEMENT STRATEGY TO THE RANCHO CUCA- MONGA CITY COUNCIL WHEREAS, the Planning Commission desires to develop a comprehensive growth management program for the community; and WHEREAS, the Planning Commission desires to do so through a responsible investigation of public service capabilities relative to development in this city; and WHEREAS, there are approved tentative tracts which the City no longer has review authority for; and WHEREAS, the Planning Commission has met with School District Officials and discussed the school impact problems; and WHEREAS, the scope and nature of the problem is such that a total solu- tion to the school impaction problem requires assistance by the State; and WHEREAS, it is the Planning Commissions' desire to recommend an interim growth management strategy that would limit the amount of new residential con- struction in the City in order to help mitigate the school impaction problems until a more comprehensive solution through the passage of new laws at the State level can be achieved. NOW, THER~%~ORE BE IT RESOLVED that the Planning Commission of the City of Rancho Cucamonga recormnends to the City Council that the present moratorium on residential development within Rancho Cucamonga be lifted on its date of expiration, being January 1, 1979, and that the following interim growth manage- ment strategy be adopted and proper municipal legislation be developed to imple- ment the same: 1. Continue a moratorium on new residential development applications with the exception of applications for multi-family, medium and high density apartment developments until July 1, 1979 after which new residential development files must meet the criteria of any com- prehensive growth management program developed by that date. 2. The construction of residences by single lot owner builders as defined by the current moratorium ordinance be exempted and allowed to obtain building permits. 3. Ail existing residential parcel maps currently on file with the City may be processed after January 1, 1979 and building permits issued. 4. Ail existing unapproved tentative tract maps currently on file with the City shall be treated as new files after July 1, 1979 and must conform to any growth management criteria developed by that date and that the applicants be credited with proportionate fees already paid for processing of their existing tentatives provided that the re-applica- tion occurs prier to January 1, 1980. 5. The attached building permit schedule for calendar year 1979 be adopted (Exhibit "A"). 6. A developer has 120 days from the time a building permit is issued to start construction. Construction is defined as construction of foundations for the dwellings. Grading is not considered as starting construction. If the developer has not started construction of the dwelling foundations within 120 days of issuance, the building permits and/or the sewer allocation are revoked and no longer valid. 7. The builders, through the cooperation of the B.I.A., be encouraged to make direct arrangements with the School Districts to fulfill the requirements of Ordinance 30. 8. The previous B.I.A. phasing agreement be honored. 9. The Planning Co~nission adopts the Tentative Work Schedule for the development of a comprehensive Growth Management Program (Exhibit "B"). 10. The City requests our State Representatives to develop and/or vigorously support legislation that would provide new means for school financing and to modify current laws that would limit the use of existing fiscal resources; i.e. outstanding bonds.
