HomeMy WebLinkAbout79-70 - Resolutions RESOLUTION NO. 79-70 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING DIRECTOR REVIEW NO. 79-32 LOCATED ON THE NORTH SIDE OF SIXTH STREET, 1,200' WEST OF ROCHESTER IN THE M-2 ZONE WHEREAS, on the 26th day of April, 1979, a complete application was filed ~or review of the above described project; and WHEREAS, on the 19th day of November, 1979, the Rancho Cucamonga Planning Commission held a meeting to consider the above described project. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1:. That the following findings have been made: 1. That the si~e indicated bY th~ development plan is ~ adequate in ~ize a~d s~a~~ toaccommo~e--the pro- posed use, and ~ii ~a~ds f ~paces, yal_ls, ~fen~9's,~arkigg, ~andscapi~g, load~n~and 6ther features required by this section. 2. That the improvements as indicated on the development plan are located in such a manner as to be properly related to existing and proposed streets and highways. 3. That the improv~nents as shown on the development plan are consistent with all adopted standards and policies as set forth in this section. SECTION 2: An Environmental Impact Report has been prepared for this project and certified by the Planning Commission. Mitigation measures have been adopted as part of this approval which reduce the significant impacts to an acceptable level. SECTION 3: That Director Review No. 79-32 is approved subject to the following conditions: Applicant shall contact the Planning Division for compliance with the following conditions: 1. Project shall be ~eveloped in accordance with th~ approved plans and exhibits~bn-~ile in the ~i~n~n-~Yvision and the conditions c~ntained herein. 2. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other appli- cable City Ordinances in effect at time of building permit issuance. 3. Trash receptacle areas shall be enclosed by a 6 foot high msonry wall with view obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Division. 4. Ail roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets as provided by the Planning and Building Division. 5. Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be con~leted to the satisfaction of the Director of Community Development. 6. The applicant shall employ all mitigation measures as outlined in the Air Quality and Aesthetics Sections of the EIR. 7. Any further development of the site will require site ~tan review. 8. Parking lot trees shall be a minimum 15 gallon size. 9. All two-way aisle widths shall be a minimum of 24 feet wide. 10. Emergency access shall be provided and maintained free and clear at a minimum of 24 feet at all times during construction in accordance with Foothill Fire District requirements. 11. A detailed lighting plan shall be submitted to and approved by the Planning Division prior to issuance of building permits. Street trees, a minimum of 15 gallon size or larger~ shall be installed in accordance with the Master Plan of street trees for the City of Rancho Cucamonga and shall be planted at an average of every 30' on interior streets and 20' on exterior streets. 14. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 15. Six (~!_f~oot 1.andscaped e--a~_th be~S ~d opaque fences or o'ther mitigating measures shall be provided along the Sixth Street frontage, east and west property lines, and along ~ the north si~e of the faciiiti~s. ~ 17. First phase construction shall require full landscaping along the street frontages and throughout the project. A 35' wide landscaped strip shall be provided across the entire Sixth Street frontage. Specimen size trees shall be added throughout this area. 18. Any signs proposed for this development shall be designed in conformance with the Comprehensive Sign Ordinance and shall require review and approval by the Planning Division prior to installation of such signs. 19. All transportation systems such as trucks, trains, conveyor belts, etc., shall be enclosed or sufficiently covered to prohibit blow off of material. 20. A detailed plan showing the location and type of wind fences shall be submitted to and approved by the Planning Division prior to the issuance of building permits. Such fences shall be totally installed prior to operation of facility. Such fences shall be located throughout the site to prohibit movement of material and dust by wind currents. 21. Where the site has been cleared and is not used as a paved circulation aisle, ground cover shall be planted to act as a dust suppressant. Applicant shall contact the Building Division for~compli~nce with the following conditions. 22. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, and all other applicable codes and ordinances in effect at the time of approval of this project. 23. Prior to issuance of a building permit for combustible construction, evidence shall be submitted to the Foothill District Fire Chief that water supply for fire protection is available. 24. Prior to the issuance of a building permit for a new commercial or industrial development or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Systems Development Fee, Drainage Fee, Permit and Plan Checking Fees. 25. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. 26. Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Standards and accepted grading practices. 27. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. 28. The final grading plan shall be subject to review and approval by the Planning, Engineering and Building Divisions and shall be completed prior to recordation of the final subdivision map or issuance of building permit. Applicant shall contact the Engineering Division for compliance with the following conditions: 29. Dedication of 60' of right-of-way on 6th Street adjacent to the property and 40' at right-of-way for the remainder of 6th Street easterly to Rochester Avenue. 30. Prior to any work being performed in the public right-of- way, an encroachment permit shall be obtained from the City Engineer's Office, in addition to any other permits required. 31. Approved street improvement plans prepared by a Registered civil Engineer shall be required, for all street improve- ments, prior to issuance of encroachment permit. 32. All street improvements shall be installed to the satis- faction of the City Engineer, prior to 6ccupancy. 33. Surety shall be posted and an agreement executed to the satisfaction of the City Engineer and the City Attorney, guaranteeing completion of the public improvements, prior to issuance of building permits. 34. Construct the following improvements on the following streets: 6th Street: curb and gutter, A.C. pavement, drive approach, street trees, street lights, landscaped median island, and 26' wide A.C. pavement from east property line to Rochester. 35. Pavement striping, marking, traffic and street name signing plan shall be required. 36. An approved grading plan and soils report in accordance with theCity grading standards will be required. 37. The applicant will be responsible for constructionof all on-site drainage facilities required by the City Engineer. 38. Site drainage shall be to a public street or to an acceptable drainage structure and easement. 39. The proposed project falls within areas indicated as subject to flooding under the National Flood Insurance Program and is subject to the provisions of that program and City Ordinance No. 24. 40. Drainage easements shall be provided as follows: 25' width along the east property line; 15' width along~the west property line. 41. Ail proposed utilities within the project shall be installed underground. 42. Utility easements shall be provided to the specification of the appropriate utility companies and the City Engineer. 43. Developer shall be responsible for the relocation of existing public utilities, as required. 44. Developer shall be responsible for the installation of street lighting in accordance with Southern California Edison Company and City standards. 45. Water and sewer system plans shall be designed and constructed to meet requirements of the Cucamonga County Water District (CCWD), Foothill Fire District and the Environmental Health Department of the County of San Bernardino. A letter of compliance from CCWD will be required. 46. Permits from other agencies will be required as follows: County Dust Abatement (required prior to issuance of grading permit. 47. 8th Street shall remain open to public traffic at all times during and after construction until such time as 6th Street is completed from Haven Avenue to Rochester Avenue. Applicant shall contact the Foothill Fire District for compliance with the following conditions: 48. The applicant shall comply with the Foothill Fire Protection District Ordinance No. 1 and the 1976 Edition of the Uniform Fire Code. 49. The applicant shall contact and comply with all fire protec- tion measures for use of above ground combustible storage. In addition, such storage shall be screened from adjacent properties and public right-of-way. Applicant shall contact the Cucamonga County Water District, the Chino Basin Municipal Water District, and the Santa Ana Water Quality Control Board for compliance with the following conditions: 50. Use of the Chino Basin Municipal Water District non- reclaimable waste line shall be reviewed and approved by the CBMWD. 51. All requirements and conditions of the Cucamonga County Water District shall be complied with. 52. Water discharge permits shall be obtained from the Santa Ana Water Quality Control Board. 53. The applicant shall research and provide for water reclaimable facilities and used as appropriate.
