HomeMy WebLinkAbout89-407 - Resolutions RESOLUTION NO~ 89-407 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION WITH THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 7 AND ACCEPTING THE FINAL ENGINEER'S REPORT FOR TRACT NO. 12462 WHEREAS, the City Council of the City of Rancho Cucamonga, California did on the 2nd day of August, 1989, adopt its Resolution of Intention No. 89-356 to order the therein described work in connection with the Annexation to Landscape Maintenance District No. 7, which Resolution of Intention No. 89-356 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 89-356, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 89-356, be done and made; and SECTION 2: Be it further resolved that the report filed by the Engineer is hereby finally approved; and SECTION 3: Be it further resolved that the assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: Be it finally resolved that said assessments shall not begin unt~'~'-~-ir~--'F-~O percent of said tracts have been occupied. Cali'foKn.ia (Landscaping and Lighting Act of 1972). SECTION 2. General Description ,_ .... Thi,s City_Council has elected ,to annex all new.subdivisions into La'dsc'ape Ma!ntenance Distr~C~ No.7., The City Counci'l.has determined that the areas to be maintained will have an effect upon, al] lots within Tract, 12462 as well as on the lots directly abutting the landscaped areas. All landscaped areas to be maintained in the annexed tracts are shown on the. reco,rded Map as roadway right-of-way or easements to be granted t'6 -the CYty of Rancho · Cucamonga. SECTION,3'." SECTION 4. Estimated Costs No costs will be incurred ~Jr pa~way i~provement'constr~ction. ~ll improvements will be constructed by developers. Based on historical data, contract, analysis and developed, work standard), it, is e~timated that maintenance costs for assessment purposes ,will, equal thirty ($.35) cents per square foot per year. These costs are estimated only, actual assessment will be based on actual cost data. Where the development covered by this annexation involves frontage along arterial or collector streets, which are.designated for .inclusion in the maintenance district but will be maintained by an active homeowners association, these assessments shall be reduced. SECTION 5. Assessment Diagram A copy of the proposed assessment diagram is attached to this report and labeled "Exhibit A", by this reference the diagram is hereby incorporated within the. text of this report. SECTION 6. Assessment IJprovements for the ~istrict are found to be all lots within the District and that assessment shall be equal for each unit. Where there is more than one ~we])~qg. 9nit per -19~_or. parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwelling units per lot o~.parcel. The City Council will hold a public hearing in June, to determine'~he actual assessments based upon the actual costs.incurred by the City during the previous fiscal year which are to be recovered through assessments as requi~ed by the Landscape and Lighting Act of 1972. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Ap~Foval of City Engineer's Report. 2'.. City Council adopts Resolution of I~tention to Annex to District and sets ~ublic hearing date. 3. City Council conducts public hearing,, considers 'all testimony 'and determines to Annex to the District or abandon the proceedings. 4. Every year in May, the Cit~ Engineer files a report with the City Cou nc il. 5. _~yery year iq June, the~.~ty._~uncil conducts a public hearing and approves, or modifies and approves the individual assessments.
