HomeMy WebLinkAbout06-020 - Resolutions RESOLUTION NO. 06-020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING FEES FOR SERVICES PROVIDED IN CONNECTION WITH THE CONTROL AND REGULATION OF ANIMALS WITHIN THE CITY A. RECITALS. (i.) The City of Rancho Cucamonga has, by ordinance, heretofore adopted, by reference, Chapters 1, 2 and 14 of Division 2 of Title 3 of the San Bernardino County Code pertaining to the regulation of animals. As of the effective date of this Resolution, the County of San Bernardino, pursuant to a written agreement and the City's payment of compensation, provides the City with those services specified in the foregoing County Code provisions, including enforcement of such provisions. (ii.) The ordinance reference in Recital (i), above, provides that fees for the provision of services identified in those County Code chapters adopted by reference, shall be as established by resolution of the City Council. (iii.) On January 18, 2006, the City Council conducted a public hearing, noticed as required by law, in order to consider the fees established by this Resolution. (iv.) All legal prerequisites to the adoption of this Resolution have occurred. B. RESOLUTION. NOW, THEREFORE, the City Council hereby finds and resolves as follows: 1. The facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. The City Council hereby approves and adopts those fees set forth in Exhibit A, attached hereto and incorporated by reference herein, as its fees applicable to the provision of animal-related services specified in Chapters 1, 2 and 14 of Division 2 of Title 3 of the San Bernardino County Code. 3. The City Council hereby finds that prior to adopting the specific fees set forth in Exhibit A hereto, the County of San Bernardino conducted a public hearing as required by law and determined that none of the fees exceed the estimated, reasonable cost to the County in providing such services. 4. The City Council hereby finds that none of the fees set forth in Exhibit A: City of Rancho Cucamonga Animal Care and Control Fees exceed the estimated, reasonable costs incurred by the City in providing, by agreement with the County of San Bernardino, those services to which each such fee applies. This Resolution shall become operative upon the operative date of the ordinance referred to in Section (i.) of the Recitals, Part A, of this Resolution, and shall continue in effect for so long as the City or the County continue to provide some or all of the services to which the adopted fees apply. Nothing herein shall be deemed to affect the amount or validity of fees for said services collected prior to the operative date of this Resolution. 6. The City Clerk shall certify to the adoption of this Resolution.
