RE: TIME EXTENSIONS
HONORABLE COUNCIL MEMBERS:
I am here to speak to you not only in behalf of my client, but also on
behalf of other small and medium sized developers who wish the City to
revise their subdivision ordinance to conform to the State's Government
Code, Article 12, Section 66452.6, specifically Subsection (e) relating to
an additional 12 years extension of time for approved tentative maps.
When Tentative Tract 14875 was approved on January 9, 1993, the recession,
due in part to the collapse of the Savings and Loan institutions and the
closure of military installations, was already creating a slowdown of
housing development in Southern California, the Savings & Loans were a
major part of financing for the small and medium sized developers. The
closure of the ~[litary installations triggered a mass movement of people
out of Southern California. These two situations created a shortage of
funds and demand for housing. Developers had no control over this, so they
put their projects on hold.
In recognition of the housing industry's dilemma, the State passed Senate
Bill 428 and Assembly Bill 771 which gave tentative maps that had not
expired as addlitional automatic 3 years extension. Although gratefully
accepted by the housing industry, these extensions took place while the
recession was still on-going.
In the last year to year and one-half, housing construction has begun. The
majority of these developments are by the larger developers that have more
resources and borrowing power then the small developers. The smaller
developers, therefore, take longer to secure fund for development and to
build the team necessary to begin their projects. In my client's case, he
had been advised that he still had one more extension of 1 year to record
the Final Map, but he was later informed that he did not have any more
extensions and than his map would expire on January 9, 1999.
If the Subdivision Ordinance is revised, the City still retains the
authority to approve or disapprove the time extensions. It is not an
automatic time extension. The time extension process would still be in
place.
