HomeMy WebLinkAbout98-171 - Resolutions RESOLUTION NO. 98-171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF EASEMENTS FOR LANDSCAPE MAINTENANCE PURPOSES LOCATED WITHIN AMENDED TENTATIVE TRACT 15727 AT THE INTERSECTION OF FOURTH STREET AND CUCAMONGA CREEK FLOOD CONTROL CHANNEL, BORDERED BY SIXTH STREET ON THE NORTH WHEREAS, by Chapter4 Article 1, Section 8333, of the Streets and Highways code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate landscape easements within amended Tentative Tract 15727, herein more particularly described; and WHEREAS, the City Council found all the evidence submitted that said landscape easements are unnecessary for present or prospective public landscape purposes, have not been used for more than five (5) consecutive years and no public money was expended for maintenance of same. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga hereby resolves as follows: SECTION 1: That the City Council hereby makes its order vacating landscape easements originally dedicated per Document No. 19970373378 and Document No. 19970373379, on file in the office of the City Clerk of the City of Rancho Cucamonga, which are attached hereto, labeled Exhibits "A" and "B", and by reference made a part hereof. SECTION 2: That from and after the date the resolution is recorded, said landscape easements no longer constitute a public easement. SECTION 3: That the subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities on record. SECTION 4: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California. SECTION 5: That the City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force.
