HomeMy WebLinkAbout98-168 - Resolutions RESOLUTION NO. 98-168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF AN EASEMENT FOR STREET, HIGHWAY AND RELATED PURPOSES FOR GOLDEN OAK ROAD, BROOK DRIVE AND SIXTH STREET LOCATED WITHIN AMENDED TRACTS 15727-1, 15727-2 AND 15727-3 AT THE INTERSECTION OF FOURTH STREET AND CUCAMONGA CREEK FLOOD CONTROL CHANNEL, BORDERED BY SIXTH STREET ON THE NORTH WHEREAS, by Chapter 4 Article 1, Section 8331, of the Streets and Highways code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate Brook Drive and a portion of Golden Oak Road, herein more particularly described; and WHEREAS, by Chapter 4 Article 1, Section 8333, of the Streets and Highways Code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate Sixth Street and a portion of Golden Oak Road, herein more particularly described; and WHEREAS, the City Council found all the evidence submitted that Brook Drive and a portion of Golden Oak Road is unnecessary for present or prospective public street purposes, it has not been used for more than five (5) consecutive years and no public money was expanded for maintenance of same; and WHEREAS, the combined total of the above mentioned Golden Oak Road, Sixth Street and Brook Drive are described per Document No. 19970159785 and Document No. 19970159787 attached hereto as Exhibit "A" and "B." NOW, THEREFORE, the City Council of the City of Rancho Cucamonga hereby resolves as follows: SECTION 1: That the City Council hereby makes its order vacating Golden Oak Road, Brook Drive, and Sixth Street easements originally dedicated per Document No. 19970159785 and Document No. 19970159787, on file in the office of the City Clerk of the City of Rancho Cucamonga, labeled Exhibit"A" and "B", and this by reference made a part hereof. SECTION 2: That from and after the date the resolution is recorded, said Document No. 19970159785 and Document No. 19970159787 no longer constitute public street easement dedications. SECTION 3: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino, California. Resolution No. 98-168 Page 2 SECTION 4: That the City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force.
