HomeMy WebLinkAbout98-163 - Resolutions RESOLUTION NO. 98-163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A DETERMINATION OF PUBLIC CONVENIENCE OR NECESSITY FOR THE ISSUANCE OF A TYPE 48, ON SITE GENERAL LIQUOR LICENSE FOR A CIGAR LOUNGE WITHIN THE VIRGINIA DARE BUSINESS CENTER, LOCATED AT 8034 HAVEN AVENUE, SUITE B -APN: 1077-661-02 A. RECITALS. 1. Daniel J. Bruncati has filed an application for a Type 48 sale of general liquor, beer, and wine license from the Department of Alcoholic Beverage Control. 2. Section 23958 of the Business and Professional Code requires the City of Rancho Cucamonga to make a determination that the issuance of the said license will serve the public convenience or necessity. 3. On the 16th day of September 1998, the City Council of the City of Rancho Cucamonga reviewed said application prior to the adoption of this Resolution. 4. All legal prerequisites prior to the adoption of this Resolution have occurred. B. RESOLUTION. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Council during the above-referenced meeting on September 16, 1998, including written and oral staff reports, this Council hereby specifically finds as follows: a. On November 12, 1997, Conditional Use Permit 97-37 was issued for a bar within a cigar lounge; and b. The site is located along two major arterial streets and is suited for this type of business; and c. The site not close to sensitive users such as day care facilities, schools, or churches; and d. The City Council previously issued Resolution 97-184 on November 19, 1997, making a determination of Public Convenience or Necessity for a beer and wine license for the business. 3. Based upon the findings set forth in paragraphs 1 and 2 above, this Council concludes that the On-Site General sale of liquor, beer, and wine will not have a negative impact on the surrounding uses. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby determines that the issuance of an On-Site General sale of liquor, beer, and wine license for a cigar lounge serves the public convenience or necessity. $. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this 16th day of September, 1998.
