HomeMy WebLinkAbout98-084 - Resolutions RESOLUTION NO. 98-084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, TO LEVY AND COLLECT ASSESSMENTS WITHIN STREET LIGHTING MAINTENANCE DISTRICT NOS. 1, 2, 3, 4, 5, 6, 7 AND 8 FOR FISCAL YEAR 1998/99 PURSUANT TO THE LANDSCAPE AND LIGHTING ACT OF 1972. WHEREAS, the City Council of the City of Rancho Cucamonga did on the 18th day of March, 1998, adopt its Resolution of Intention No. 98-052 to order the therein described work in connection with the Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8 which Resolution of Intention No. 98-052 was duly and legally published in the time, form and manner as required by law, shown by the affidavit of Publication of said Resolution of Intention on file in the Office of the City Clerk; and WHEREAS, any new street lights in areas to be maintained by the District, will become part of the active work program at such time as these new areas are annexed into the District. The normal process will be the dedication of the areas to the City, at which time a sufficient non-refundable deposit will be made by the developer to the City. This deposit will provide for costs of energizing and six months of ordinary and usual maintenance, operation and servicing of the street lights in each development at the time of initial operation of the lighting system. The costs will be based on the number and type of street lights and based on Southern California Edison Company's rate for street lights. Immediately upon energization of the street lights, those street lights will become a part of the work program of the district. WHEREAS, said City Council having duly received and considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplation work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: That the public interest and convenience requires the levy and collection of assessments within the Street Lighting Maintenance Districts Nos. 1, 2, 3, 4, 5, 6, 7 and 8 for the Fiscal Year 1998/99, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 98-052, be done and made; and SECTION 2: Be it finally resolved that the assessments for Fiscal Year 1998/99 are hereby approved.
