'SW •11L® ~ WO QOMD eb$ m ~ /~o n N m p ~~~ ^ ~ ~ mo~~ py o ~~ j ~ ~~ ~ F n a y~v Li~/w o' JL__ n m 40~ ~~; ~~~ ~-a T H E C I T Y O F RANCHO CUCAMONGA Staff Report DATE May 24, 2006 TO Chairman and Members of the Plamm~g Commission FROM Dan Coleman, Acting City Planner BY Michael Diaz, Senior Planner SUBJECT PROGRESS REPORT ON CONDITIONAL USE PERMIT 88-45 AND ENTERTAINMENT PERMIT 91-03 -MARGARITA BEACH ANALYSIS In response to an appeal made on behalf of Margarita Beach, the City Counal on February 15, 2006, passed a resolution (Resolution No 06-052) sustaining and modifying the decisions of the Plamm~g • Commission related to the operation of the business at the above address One of the conditions of approval (Condition 21 of the Plamm~g Commission Resolution No 05-50) requires that a progress report be given by the City Planner for two successive 3-month periods and two successive 6-month reports (following the second 3-month rewew) The following report is the first progress report to be made regarding Marganta Beach Since February of 2006, the proprietor of the Marganta Beach business has made a series of changes to comply with the time limits imposed by the modified conditions of approval The following changes have been verified by staff and are described as follows General Chances Chance in Business Partnership -Jose Sambolin is no longer affiliated with the ownership and operation of the Marganta Beach business in Rancho Cucamonga Mark Davidson is now the sole owner of the Rancho Cucamonga location The Business License Department has been notified of the change, and the Business Certificate is in the process of being revised Advertisinc - In response to the City Council direction, Marganta Beach's form of advertsing for the Rancho Cucamonga site has been modified Recent fliers have been printed without titillating images and text as reflected in past printed fliers (Exhibit A) Staff reviewed the www i e oartv coin website and found that it is presently under construction (Exhibit B) • Days of Ooeration -Margarita Beach is currently only open for business Wednesday through Sunday because of a decrease in business When business increases, the business may return to 7 days of operation Peak business hours remain late evening until closing at 2 00 a m ITEM B PLANNING COMMISSION STAFF REPORT CONDITIONAL USE PERMIT 88-45 AND ENTERTAINMENT PERMIT 91-03 May 24, 2006 Page 2 Items Reowred Within First 60 Davs Exterior Appearance and Neiohborhood Litter -The appearance of the shopping center in which Marganta Beach is located has steadily improved, including the maintenance of landscaping and replacement of tenant sign panels on the existing freestanding signs for center. No significant trash or litter (e g bottles) have been observed near or around the subtect use. No signrficant trash or litter around the site and in the neighborhood have been observed by staff or reported by the surrounding residents or businesses. The logs kept by Marganta Beach indicate that checks of the area are being routinely performed. Phvsical Improvements - A revised floor plan has been submitted and is on fde with the Planning Department (Exhibit C). Speed bumps have been installed in the drive aisle across the rear of the property, and the signs directing patrons to park at the rear of the budding have been removed. Inside the budding, an additional urinal has been installed in the men's restroom, and automatic spot lights have been placed over the rear doors to turn on whenever the rear doors are opened. The purpose of the spot lights is to indicate to management and security that the rear doors are open and need to be closed to keep in the noise and discourage unauthorized entry/exit into the establishment. According to the proprietor, kitchen improvements are being planned and wdl be installed by August of 2006, as required by the conditions of approval. Budding permits wdl be requred for the kitchen improvements • Regulatory Street Scans -The placement of two street regulatory signs indicating "Dead End" or . "Not a Through Street" at the entrance to Estaaa Court and Pasito Avenue is in process. The City Engineer is in the process of finding a location, determining costs, and timing for installation in the near future Security/On-Site Parking Enforcement -The business has purchased black colored jackets and t-shirts (for warm summer evenings) marked with "Security" for use by its security team. Security team members monitor on-site parking, work to discourage patron parking in local neighborhoods during peak hours, and control access in and out of the place of business. No concerns or complaints from the local residents have been received by staff Complaints and Calls for Service - To date, staff has not receroed any complaints from the residents or merchants surrounding the Marganta Beach establishment. According to the Police Department, a total of 10 "calls for service" were received between the dates of March 1 to April 24, 2006, for the Margarita Beach area (Exhibit D) No serious crimes were reported, and only two calls appear to have been received from the public regarding noise in the area behind Margarita Beach One of these calls involved noise being generated by a lot sweeper, contracted by the property owner to maintain the center Fire Department -The Fire Department has conducted recent inspections of the business as part of their routine procedures No violations were reported. On April 27, 2006, Fire Inspector Nee accompanied staff during a visit to the business, and again, found no violations ABC Regulations -Staff contacted the Department of Alcoholic Beverage Control (ABC) to ascertain if any violations of their regulations had occurred ABC offiaals indicate no reported violations, and that they will continue to periodically monitor as part of their routine schedule and in . response to specific complaints when they receive them PLANNING COMMISSION STAFF REPORT CONDITIONAL USE PERMIT 88-45 AND ENTERTAINMENT PERMIT 91-03 May 24, 2006 Page 3 Menu Chanoes -The proprietor of the business is aware that the service of alcoholic beverages may only occur in contunction with a full food menu. Last call for food items is 1:00 a.m (to allow for preparation and consumption of the food item), the bar closes at 1.40 a.m. Menus have been modified to include text copy to indicate that "All menu items available during all business hours." In addition to laminated paper menus being placed at each table, a reduced size copy of the same menu has also been adhered to a bottle placed on all tables. A copy of the menu is provided (Exhibit E) Meetinos with Police and Neiohbors - As required by conditions of approval, every 60 days the business proprietor must meet, or at least offer to meet, with the Police and adfacent residents. Captain Pete Ortiz has met with Mr. Davidson and discussed issues related to the operation of the business On or about April 13, 2006, the neighbors in the vicinity of the business were sent a letter from Mr. Davidson inviting them to meet or contact him regarding the present operation of the business According to Mr Davidson, no one expressed a desire to meet at this time. A copy of the letter sent out by Mr Davidson is provided (Exhibit F). Conclusion Overall, staff believes that Margarita Beach is operating in accordance with the modified conditions of approval approved by both the Planning Commission and City Council.
