The proposed use is in compliance with each of the applicable provisions of the Development Code, and d The proposed use, together with the conditions applicable thereto, wdl not be detrimental to the public health, safety, or welfare or materially incurious to properties or improvements in the vicinity 4 The Planning Department Staff has determined that the protect is categorically exempt from the regwrements of the California Environmental Quality Act (CEQA) and the City's CEQA Gwdelines The protect qualifies under the Class 15 exemption under State CEQA Gwdelines Section 15315 Minor Land Divisions because the land division creates less than four parcels and is in conformance with the General Plan and zoning code in additron, there is no substantial evidence that the protect may have a significant effect on the environment The Planning commission has reviewed the Planning Department's determination of exemption, and based on its own independent tudgment, concurs in the staff's determination of exemption 5 Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subtect to each and every condition set forth below and in the Standard Conditions, attached hereto, and incorporated herein by this reference Planning Department 1) The applicant must meet all conditions of approval for related protect • D RC2004-01199 Enoineerinc Deoartment 1) An in-lieu fee as contribution to the future undergroundmg of the existing overhead utilities (telecommunications and electrical) on the opposite (north) side of 8th Street shall be paid to the City prior to the issuance of Building Permits The fee shall be one-half the City adopted unit amount times the length of the frontage of the site (Frontage is measured to street centerline intersections ) 2) The existing overhead utilities (telecommunications and electrical) on the protect side of Belmont Avenue shall be undergrounded from the first pole on the north side of 8th Street to the first pole off-site south of the protect boundary, prior to public improvement acceptance or occupancy, whichever occurs first All services crossing Belmont Avenue shall be undergounded at the same time (A reimbursement agreement to recover one-half the City adopted cost for undergroundmg from future redevelopment, as it occurs on the opposite side of the street, does not apply here Single-family residences on existing lots are exempt ) 3) The existing overhead utilities (telecommunications and electrical) on the protect side of the alley along the south property line shall be undergrounded, prior to public improvement acceptance or occupancy, whroheveroccurs first All services crossing the alley along the south property line shall be • undergrounded at the same time I~ PLANNING COMMISSION RESOLUTION NO 06-84 SUBTPM17998 - OPTIONS The Planning Commission, in consideration of this matter, has three options: The Commission may determine that the current regulation adequately addresses horse keeping and take no further action, or • The Commission may direct staff to prepare a Development Code Amendment clarifying that the 70-foot rule only should be applied to the primary residence, hence, should not be applied to guest houses and second dwelling units.
