Attached is the 'nvoic for your city's membership in the Natio¢al League of
' Cities for the pet~ril 1, 1981, through March 31, 1982.
This invoice is based on the new dues schedule adopted by the NLC Board of
Directors at the meeting held July 18-19, 1980, in Los Angeles. The Boazd
and I recognize that your city adopted its budget last July and, therefore,
you did not have an opportunity to budget funds for the new amount. If
payment of the new amount at this time wculd be financially difficult, please
contact me immediately and I will arrange for your city to pay its dues in
accordance with a mutually agreeable schedule.
By way of review, this has proved to be an extraordinarily difficult year for
the nation's cities. The Admi¢istra[ion and the Congress have been pre-
- occupied with international problems, [he economy, and the recently completed
presidential and congressional elections. As a consequence, certain crucial
city issues and legislative needs have been deferred.
Inspire of the difficulty in focusing federal attention on urban issues, NLC
11as achieved several notable successes, including:
o Reenactment of General Revenue Sharing, the number one NLC
priority,
o A three-year extension of the Community Development Block Grant and
Urban Development Action Grant (UDAG) programs at a funding level
in excess of $19 billion,
o Reauthorization of [he Housing Assistance Act,
o Enactment of the Rural Development Policy Act of 1980 designed to
develop the capacity of local government officials in smaller
communities,
o SuperEund legislation Chat provides $1.2 billion dollars [o
clean-up ha za rdnus waste sites.

Other legislative priorities that receive major attention but have been
deferred to this coming year, include reauthorization of a vastly expanded
Economic Development Assistance Program for localities, new funding for mass
transit, the Co~mnunity Energy Bill, the Fiscal Notes legislation which
requires the preparation of fiscal impact statements before passage of legis-
lation affecting state and local governments, and legislation dealing with
youth employment and juvenile justice.
In addition to our legislative priorities, NLC representatives have been
meeting with the Republican transition teams to present city priorities and
needs. Further, legal issues continue to merit increasing NLC attention. NLC
is providing consulting assistance or filing amicus curiae briefs relative to
the application of the Fair Labor Standards Act to local government mass
transit systems, federal government involvement in land use control as a
method of dealing with environmental pollution, and other aspects of land use
control through inverse condemnation proceedings.
It is clear at this point chat a continuing and concentrated effort by NLC
staff will he required in a wide range of areas. I need no[ remind you
again, of the constantly expanding impact and involvement of the federal
government of virtually all local government activity. The federal govern-
ment has taken and will continue [o take a larger role in managing the
economy. Court decisions are assuming a larger role in federal policy evo-
lution and implemen [anon. And the federal government is expanding its
regulatory influence into new areas. •
For city governments, the expansion of federal activity means that it is more
difficult and requires greater effort to influence federal policy. Because
of the increasingly complex and changing conditions, the support of your city
is essential to NLC given the major effort that will be required to secure
passage of legislation and the adoption of policies favorable to cities. We
look forward to your continued support and the opportunity to serve you in
the coming year,

SUBJECT: Acceptance of Honds and Agreement for Site Approval 79-19
Site Approval 79-19 located at 9533 Foothill Hlvd. was approved
by the Planning Commission on December 10, 1980. The developer,
Atlantic Richfield Co., has submitted an agreement and bonds to
guarantee installation of off-site improvements in the following
amounts:
Faithful Performance $3,500.00
Labor 6 Material $3,500.00
•
RECOMMENDATION
It is recommended that the City Council adopt the attached
resolution and accept the bonds and agreement for Site Approval
79-19.

• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING IMPROVEMENT
AGREEMENT AND IMPROVEMENT SECURITY FOR SITE APPROVAL
NUMBER 79-19.
WHEREAS, the City Council of the City of Rancho Cucamonga,
California, has for its consideration and Improvement Agreement executed
on February 18, 1981 by Atlantic Richfield Company as developer, for the
improvement of public right-of-way adjacent to the real property specifically
described therein, and generally located at 9533 Foothill Boulevard.
WHEREAS, the installation of such improvements, described in
said Improvement Agreement and subject to the terms thereof, is to be
done in conjunction with the development of said real property as referred
to Planning Conmiss ion, Site Approval No. 79-19; and
WHEREAS, said Improvement Agreement is secured and accompanied
by good and sufficient improvement security, which is identified in said
Improvement Agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Rancho Cucamonga, California, that said Improvement Agreement and
said improvement security be and the same are hereby approved and the
• Mayor is hereby authorized to sign said Improvement Agreement on behalf
of the City of Rancho Cucamonga, and the City Clerk to attest thereto.

Contract and Lien Agreement
On January 24, 1979, the Planning Commission adopted Resolution
79-OB approving Parcel Map 4773, located on the east side of
Etiwanda, south of 24th Street and requested a lien agreement
for construction of off-site improvements including a 26 foot wide
paved access from Etiwanda at the time Lot 2 is developed.
The developer, Gary Kortapeter, has submitted the attached lien
agreement and final map for Council approval.
RECOMMENDATION
It is recommended that the City Council adopt the attached
resolution authorizing the City Council and City Engineer to sign
Parcel Map 4773 and accept the Real Property Improvement Contract
and Lien Agreement. ~

WHEREAS, on the 30th day of November, 1978, a formal application was filed
with the City Planning Division; and

WHEREAS, on the 24th day o£ Sanuary, 1979, the Planning CoPVeission held a
meeting to consider said project and continued to February 14, 1979; and
WHEREAS, the Planning Commission on October 24, 1979 reconsidered the previous
approval and modified the conditions as listed herein.
NOW, 1TDiREFOAE, THE RANCHO CUCAMONGA PLANNING CO.MISSION resolved as
follows:
SECTION 1: That the following findings have been made:
1. That the proposed map is consistent with the proposed
General Plan of the City of Rancho Cucamonga.
2. That the design Fox improvements of the proposed
subdivision is consistent with applicable general
and specific plans for the City of Rancho Cucamonga.
3. That the site is physically suitable for the proposed
density of development.
4. That the design of the proposed improvements is not
likely to cause substantial environmental damage or
substantially and unavoidably injure fish or wildlife
or other habitat.
5. That the design nor the type of improvements is not
likely to cause serious public health problems.
6. Thai the design or the type of improvements will not
conflict with easements acquired by the public at large
for access through or use of property within the
proposed subdivision.
SECTION 2: That this land division will not create adverse impacts on the
environment and that a Negative Declaration is issued on February 14, 1979,

2. At the time of development of Lot 2, a 26' wide paved

of Lot 2 shall be installed at the Lot 2 owner's expense.
A lien agreement prepared by the applicant to the
satisfaction of the City Engineer shall be provided and
recorded with the Final Map to guarantee the 26' wide
paved access installation at Lot 2 owner's expense.
3. The applicant shall provide all the construction plans fox
drainage and street improvements for the 26' width of pavement
prior to the recordation of the final map and to the
satisfaction Of the City Engineer from Etiwanda. Avenue to
the end of Lot 2.
4. Sanitary sewers and water systems shall De designed and ~ ...

Section 66436 (C-1) of the Subdivision Map Act of the
division and development of the property will not unreasonably
interfere with Che free and complete exercise of any puhlic
entity oz public utility right-oF-way oz easements. The
signature of any public entity or utility may be omitted
from the final map and written notification of objections
is not filed with the City within the Lime limits specified
in Section 66436 (C-1).
9. The developer shall meet all final map requirements of the
City including, but not limited to, providing traverse
calculation sheets, copies of recorded maps and deeds used
as reference and/or showing original land division tie notes
and bench marks that are referenced thereon.
10. All requirements of the Foothill Fize District shall be complied
with.

WHEREAS, Tentative Parcel Map No. 4773, submitted by
Gary Kortapeter, and consisting of 2 parcels, located on the east
side of Eti Wanda, south of 24th Street, being a division of lot 11,
block "B" of Etiwanda Colony Lands as recorded in Book 2, page 24 was
approved by the City Engineer of the City of Rancho Cucamonga on
February 18, 1981; and,

installation of said improvements in a timely manner, City may at any
time thereafter, upon giving Developers written notice of its intention
to do so, enter upon the property hereinafter described and complete
said improvements and [ecover all costs of come lesion incurred by the

4. To secure the performance by Developers of the terms
and conditions of this Agreement and to secure the repayment to City
of any funds which may be expenued by City in completing said improvements

SUBJECT: ENVIRONMENTAL ASSESSMENT ZONE CHANGE N0. 80-14 - ROBERTS GROUP -
A change of zone from R-1-8500 single family residential to
R-3 (multiple family residential) for 7.3 acres, located on
the northwest corner of 19th Street and Hermosa Avenue -
APN 202-17-010.
RELATED ITEM: TENTATIVE TRACT N0. 11625
ABSTRACT: The Roberts Group has submitted a complete residential development
package for the development of a 99 unit condominium project to be located on
7.3 acres of land on the northwest corner of 19th Street and Hermosa Avenue
(Exhibit A). In conjunction with the development of the property, a change of
zone to R-3 (a multiple family designation) is required. The change of zone
and the detailed development plans have been reviewed and approved by the
Planning Commission. The Planning Commission reviewed the zone change and
development plan at their meeting of December 10th, 1980, at which time the
Commission recommended approval of the zone change to the City Council and
continued review of the development plan in order to resolve concerns voiced
by surrounding residents. Several residents expressed concern that the
development of the site will block views from their existing residences south
of 19th Street. In addition, the Planning Commission had concerns relative
to the scaie of the buildings along 19th Street. Asa result of these
concerns, the Planning Commission requested the applicant to work with the
Design Review Committee to mitigate the stale and visual impacts of the
project. The applicant did meet with the Design Review Committee and submitted
revised development plans to the Pianning Commission for their consideration.
The Planning Commission, at their meeting of January 28, 1981, held another
public hearing to consider the development plan, and approved the development
plan with revisions made by the architect. Please find attached the
December 10, 1980 Planning Commission Staff Report on the zone change, the
December 30, 1980 Planning Commission Staff Report on the development plan,
and the January 28, 1981 Planning Commission Staff Report explaining changes
to the development plan and design. The resolution recommending approval
of the zone change by the Planning Commission is attached for your review
as well as the resolution of approval for the development plan with all
conditions.

• ANALYSIS: The Planning Commission, in continuing the review of the
evd elopment plan, requested that the developer revise the development to
reduce the overall impact and scale of the development along 19th Street.
The Design Review Committee met with the developer and architect; and the
Committee suggested increased setbacks, and lowering the scale of buildings.
The architect provided revised plans which indicate a reduction in stories on
two of the buildings along 19th Street in addition to switching the style
of buildings on the corner that would create less of an impact. The result
of this revision was two (2) less dwelling units in the project. In addition,
the site plan was altered to provide a larger setback along a portion of
19th Street and an existing oak tree was incorporated into the project design.
The Planning Commission approved the development plan contingent upon the
approval of the zone change by the City Council.
CORRESPONDENCE: During the December 30, 1980 Plam~ing Commission pu6l is
hearings, several residences spoke about concerns relative to the project
site. Staff also received a letter from Laurel Hawker, stating opposition
to the zone change (Exhibit "B"). During the December 10, 1980 public
hearing, a petition was also su quitted to the Commission signed 6y residents
south of 19th Street, objecting to the development of the subject site.
Staff at the direction of the Planning Commission, sent letters to all
individuals listed on the petition and those who spoke at the hearing to
notify them of the Planning Commission meeting of January 28, 1981 at which
time the Planning Commission would tons ider the final development plan and
• of the City Council zone change hearing. At the public hearing of January 28,
1981, no residents or property owners spoke, and none appeared to be present.
To date, we have received no further correspondence on this matter.

RECOMMENDATION: The Planning Commission recommends that the City Council
adopt the attached Ordinance approving Zone Change No. 80-14.

At the February 10 meeting of the Historic Preservation Commission
public hearings were held regarding the Chaffey-Garcia House,
the street tree plantings on the northeast and southwest corners
of Victoria and Etiwanda Avenues, and the Alta Loma Honor Roll.
It was unanimously decided by the Commission to recommend Historic
Landmark designation for the above mentioned three City features,

NOTE: In the motion concerning recommendation as City Historic
Landmark for the Alta Lana Honor Roll, it was also recommended
that Council work directly with the Foothill Fire Protection
District Board of Directors in obtaining permission for placement
of the Honor Roll on District Property at the Amethyst Fire Station.

SUBJECT: GENERAL PLAN SCHEDULE FOR CITY COUNCIL
ABSTRACT: This memo will discuss the topics for consideration by the
City Council on the core meeting dates that were previously established.
Recorranendation will be made to consider establishing the General Plan
schedule for review discussion.
DISCUSSION: As the City Council will recall, March 9, 16, 30, and April
6 of this year were established for core meeting dates for consideration
of the review of the General Plan. Ail of these dates are on Monday and
will be at the Lion's Park Community Building beginning at 7 p.m. There
were additional special meeting dates that could be used as necessary.
These are Mar 23, April 13, Rpril 20, ADril 27, and May 4. All of these
occur on Monday and would also be held at the Lion Comnun ity Building
at 7 p.m. if needed.
• The Planning Commission began its review of the General Plan on January
12, 1981, and will complete its review on or shout February 17, 1981
passing its recommendation on to the City Council for consideration of
adoption. As the Council is aware, May 3> 1981 (Sunday) is the date
on which the extension expires for the City of Rancho Cucamonga to adopt
its new General Plan. The new General Plan is composed of three super
elements: Land 'use and Development, Environmental Resources, and Public
Health and Safety. Encompassed in the three super elements are Land Use,
Circulation, Housing, Public Facilities, Scenic Highways, Community Design,
Conservation, Open Space, Energy Conservation, Seismic Safety, Safety,
and Noise. During the process of the General Plan review by the Planning
Commission there have been a number of requests for changes in land uses.
Somewhere between 60-80 requests have been considered by the Planning
Commission. Some, if not all, of the City Council have attended the
Planning Commission meetings regarding these requests. Transmitted to
the Council, from the Planning Commission, will be all of the letters of
request, the staff analysis, recommendation, and Planning Commission ac-
tion on each and every request. Additionally, all the minutes will have
been transmitted to the City Council. The staff will not again raise any
of these issues (special requests) unless the Council requests specific-
a11y that it wants further discussion on one particular item. Further-
more, the Council may wish to hear only new information. ,
The following schedule is suggested far City Council consideration.

The schedule presented above will cover each of the super elements of
the General Plan and the Draft Environmental Impact Report in addition
to allowing consideration of all the letters of request that have been
recommended for action from the Planning Commission to the City Council.
RECOMMENDATION:
It is recommended that the C1ty Council consider the above-outlined
schedule for the review and adoption of the Sedway/Cooke General Plan
and advise staff as to any desired changes.

The Resolution puts into writing the informal arrangement regarding
Staff/Commission roles for Director Reviews established by the Plan-
ning Commission shortly after the City's incorporation. If the Council
concurs, please advise staff to prepare the necessary legislative
documentatio .

THAT THE PLANNING COMMISSION DESIRES TO CONDUCT FULL
REVIEW UPON.
WHEREAS, the Interim Zoning Ordinance of the City of Rancho
Cucamonga permits the City Planner to refer any development project
under the Development Review process to the Planning Commission; and

criteria and guidance for types of projects which should be reviewed by
the Planning Commission under the Development Review process; and
4111EREAS, such criteria is needed to provide clear direction
and guidance to Staff and developers alike.

Cucamonga does resolve that it hereby finds that the following criteria
shall set forth policy for which projects meeting such criteria will be
referred to the Planning Commission for full review and consideration.
1. Any project being proposed along Foothill Boulevard,
Haven Avenue, or any other Special Boulevards, as described
on the General Plan; and
2. Projects which, in the opinion of the Design Review
Conmittee, fall within the sensitive land use areas, or
sensitive environmental study areas; and
3. A71 projects which are master planned, however, once the
master plan has been approved by the Planning Commission
and does not fall on a special boulevard may be approved
by the City Planner.
4. All additions that exceed BOA of the existing structure
or improved site and meet requirements of 1 and 2 shall
require Planning Commission approval.
5. All apartments and condominiums and other multiple family
projects over 10 dwelling units shall require Planning
Commission review.
6. All projects requiring an EIR shall require Planning
Commission reviews.

Subject: Recommendation to City Council for a supportive
Resolution regarding distribution of 1980 Bond
Act Parkland funds
Back round:
In the November, 1980, election Proposition One was a Statewide
Park Bond measure. The voters acceptance of Proposition One has
made possible a distribution throughout San Bernardino County of
2.9 million dollar for the purposes of park acquisition and/or
development.
A key issue of the Bond Act is the formula for distribution. In
the past, such as the Bond Acts of '68, '74, and '76, the County
had full authority to regulate what that allocation system was
• to be. For example, in 1968 all funds were left under direct
management of the County. In 1974 this was again the case. In
1976, however, after bitter fueds errupted between the cities of
the County and the County itself, a 70/30 distribution was agreed
upon with special districts being awarded allotments from the cities'
70 per cent sha^e. There is still much bitterness and resentment
within these cities at being "rough-handled" in the past over an .
equitable distribution formula.
This year, however, the cities are taking a united approach to the
issue and recommending a per capita distribution formula. Exhibits
"A" and "B" attached will give a breakdown to the per capita approach.
It might also be noted at this time that the '80 Bond Act legislation
noting some of the abuses over the past years in distribution formulas
have mandated as part of the Act that 50 per cent of the cities
with 50 per cent of the population within a county must ratify the
Board of Supervisors adopted plan for it to be valid. Failing to
receive this city ratification of the plan by March 15 of this year,
the result will be that San Bernardino County's 2.9 million dollar
allocation will not be distributed in fiscal 81-82, but instead
will be appropriated in the year 82-83.
Staff Recommendation: [t is recommended that Council review and
adopt the attached resolution, and forward the resolution with an
appropriate cover letter to the Board of Supervisors in San Bernardino,

RANCHO CUCANONGA, CALIFORNIA, APPROVING THE PRIORITY
PLAN FOR EXPENDITURES OF THE COUNTY OF SAN BERNARDINO
UNDER THE PROVISIONS OF THE CALIFORNIA PARKLANDS ACT
OF 1980 ON A PER CAPITA BASIS
WHEREAS, the people of the State of California have enacted
the California Parklands Act of 1980, requiring; that each county shall
consult with all cities and districts within the County which are eli-
gi61e to receive grant funds under provisions of Section 5096.156 'of
the Act and develop and submit to the State for approval a Priority
Plan for expenditure of the county's allocation; and
WHEREAS, said Priority Plan shall reflect consideration of
deficiencies within the county in the preservation of historical re-
sources and natural landscapes as well as in the provisions of recreat-
ional areas and facilities; and
WHEREAS, said Priority Plan shall also reflect regional park
or openspace needs as well as community and neighborhood park and re-
creational needs; and
WHEREAS, the provisions of the parks and recreation needs should
also reflect other important statewide priorities, including conservation
of energy resources, recognizing the transDOrtation limitations of lower-
income persons and the handicapped, encouraging the use of mass transit,
• encouraging the planned use of strategically located vacant lands which
have access to utilities and government services and increasing the benefit
of already-existing facilities; and
WHEREAS, the allocation of Bond Act funds was made to counties
on a per capita basis; and
WHEREAS, parks and recreation needs determinations for planning
and development purposes are made on a per capita basis.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City
of Rancho Cucamonga, California, does hereby agree as follows:
SECTION 1. That the Priority Plan be based on a Der capita
allocation of funds, said allocation being based on the preliminary
1980 census figures and reasonable estimates of population from those
census figures for special districts whose boundaries do not coincide
with census enumeration districts and who qualify for funding under
the provisions of the Act, as this method will promote the consideration
of projects that reflect all the aforesaid priorities.
SECTION 2. That said per capita allocation, providing 53.37 per
person, be constituted as set forth in Exhibit A and incorporated into
this resolution.

SECTION 3. That this resolution hereby gives the approval •
of the City of Rancho Cucamonga to the priority plan as one of the
cities and districts representing fifty percent (50%) of the popu-
lation of the cities and districts within the county.

1. CALL TO ORDER
'the regular meeting of the CL[y Council was held in the Lion's Park Community Center,
9161 Base Line Road, Rancho Cucamonga, on Wednesday, February 18, 19 g1. The meeting
was called to order aC 7:03 p.m. by Mayor Phillip D. Schlosser who led in Che flag
salute.
Presen c: Councilmen James C. Frost, Jon D. Mike ls, Michael A. Palumbo, Arthur H.
Bridge, and Mayor Phillip D. Schlosser.
Also present: Community Development Director (acting as City Manager), Jack Lam;
City Attorney, Samuel Crowe; Deputy City Clerk, Beverly Authele[; City Planner,
Barry Hogan; City Engineer, Lloyd Hubbs; Community Services Director, William Holley;
and Finance Director, Harry Empey.
Absent: City Manager, Lauren Wasserman; and Assistant City Manager, James Robinson.
Both were attending a City Manager's Conference in Monterey.
2. ANNOUNCEMENTS
a. Thursday, February 26, 7:00 p.m. at the Lion's Park Community Center, Planning
Commission would be hold a public hearing on [he Victoria Plan.
b. Thursday, February 26, 6:00 p.m. a[ Etiwanda Middle School, a joint meeting
with City Council and Etiwanda School District Board of Trustees.
c. Monday, February 23, meeting is cancelled. The Planning Commission had set
the meeting in case it would be needed. However, the Planning Commsission has
':omple tad [he public hearings on the General Plan, and the meeting is no longer
necessary.
d. Councilman Mikels announced that on Priday, Pebruary 20, a[ 9:00 a. m. there
would be a meeting of the Ontario Airport Ground Access Steering Covsnittee.
e. Ed Hamilton, member of the current County Grand Jury, reported that the Grand
Jury was investigating some unfortunate circumstances involving taxi cabs. The
Grand Jury has asked the County to draft an ordinance to regulate taxi cabs Ln the
unincorporated areas of [he County. He felt that because of the invea[Sgation
there could possibly be Some Chat would try to move into the Clty, and perhaps [he
City should also adopt a similar ordinance fnr protection.
3. CONSENT CALENDAR.
Mr. Lam requested that item "f" be deleted from the Consent Calendar. Councilman

4B. ENVIRONMENTAL ASSESSMENT ZONE CHANGE N0. 80-14 - ROBERTS GROUP. A change of
zone from R-1-8500 (single family residential) to R-3 (multiple family residential)
for 7.3 acres, located on the northwest corner of 19th Street and Hermosa Avenue -
APN 202-17-010. Jack Lam presented the staff report.
Councilman Mike is ask what happened to the oak trees which were supposed to be
preserved. He said he walked the area and only observed some trunks of trees and
sawdust. Mr, Hogan said the ones which were cu[ down were a type of cedar tree no[
the oak. The cedar trees were already dead. He said the oak trees were near the
back perimeter of Che property.

Nr. Hogan seated that [he southeast corner request was for office and professional

Bedway/Cooke general plan designation of low density residential. On [he northeast
cornet there is an existing office site owned by HMG. They have also purchased the
additional land except for [he house that takes access off Hermosa Avenue and
purchased property all the way to the existing eoulevatd Development tract and to
the single family home which is going to be built. Their request was for multiple
family density, and the Planning Consnission approved medium density 5 Co 14 dwellings
per acre. That was a change from the low density residential 2 co 4 dwellings per
acre.

SH. PLANNING COMMISSION DIRECTOR REVIEW PROCEDURE. Mr. Hogan presented the staff
report.
A Resolution from the Planning Commission had been presented which lls led the types
of proj etc which would require a full review by the Planning Commission.
Councilman Mikels stated that the large commercial and industrial projects were
missing. Mr. Hogan stated these would be included under item 3, Master Planned
Projects, or would be included under "Special Boulevard Projects." Mr. Lam also
stated that shopping centers require site approvals which are not Director Reviews.
Councilman Mikels recovsnended that [he Planning Commission's recommendations 6e
drafted into a Reaolu[Son for Council approval. Mr. tam stated this could be don.
by using the Planning Convnisaion Resolution form, assigning a Council number, and
changing a few words. Council concurred,
The City Attorney scared that the word, "Planning Commission," in the title be
changed to "City Council." The word, "Planning Commission," in the second aWhereas

6. CITY ATTORNEY'S REPORTS. Mr. Crowe said he only requested time to discuss
a li ligation matter with the Council in Executive Session.
7. ADJOURNMENT. Motion: Moved by Frost, seconded by Palumbo to adjourn to
an Executive Session to reconvene on February 26 at [he Etlwanda School for a
meeting with the School Board of Trustees a[ 6:00 p.m. Mo[lon approved unanimously.
