SUBJECT: APPROVAL OF APPROPRIATION TO THE 1992/93 BUDGET FOR
LIABILITY AND UNEMPLOYMENT INSURANCE

It is recommended that the City Council appropriate:
1) $250,000to account #O1-0285-3961, General Liability, and;
2) $130,000 to account #01-4265-3962, Unemployment Insurance.

Approximately two years ago, the City's insurance rate for liability coverage was
significantly increased. At that time, the City's insurance premiums for liability
were approximately one-half of what they currently are. The City a insurance
carrier for liability adjusted the rates upward to a level that more closely met the
exposure. For the last two years etafT has monitored claims, along with the
insurance costs, which we experience eacl~ year. They have now reached a level
which staff feels ie stable and for which we can budget on an annual basis. However,
in order to not overstate our losses and our expenses, we have during the past two
years transferred funds from the City's self-insurance reserve account. This
account is established by the City's auditor and represents a contingency amount
which can be made available in the event of an extraordinary loss.
The City's self-insurance reserve account currently contains $1 million. It is
recommended that the transfer of $250,00 for liability insurance, and $130,000 for
unemployment insurance be transferred from this reserve. This reserve is
replenished at the beginning of the new fiscal year. This is coneietent with the City's
practice of the last two years.
Beginning fiscal year 1993/94 staff proposes to incorporate within the proposed budget
an amount that more closely reFlecta the actual coats during the fiscal year for
liability and unemployment and cease the transfer and replenishment method.
Since the City now has a two year record, staff' feels that it ie appropriate to budget the
true coat for these expenses.

COUNTY OF LOS ANGELES OF DEFERRED COMPENSATTON FUNDS
TO BALANCE THE COUNTY'S BUDGET
RECOMMENDATTON
It is recommended that the City Council of the City of Rancho Cucamonga adopt the
attached Resolution, noting its opposition to the County of Los Angeles' use of deferred
compensation funds to balance the County~s budget.
BACKGROLIlVD
The City has noted a recent proposal by the County of Los Angeles to borrow assets of
the Count}~s 457 Deferred Compensation Fund to help in offsetting an expected budget
deficit within the County. Deferred Compensation Funds under the Internal Revenue
Code, Section 457, are an asset of the governmental agency but are being held in the
interest of its employees.
Several yeazs ago the State of California acted similarly by borrowing funds from the
Public Emptoyees Retirement System to assist in balancing its budget. The City
perceives such maneuvers by governmental agencies as an infringement on employee
benefits and a trend that could confinue once such action has been taken.
The County of Los Angeles, as well as public jurisdictions within the State, has a
responsibility to balance its budget each year. Such one time borrowing from a deferred
compensation plan does not indicate sound fiscal management. Established revenue
sources and other cost cutting measures should be taken to balance the County's budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
C UCAMONGA, CALIFORNIA, NOTING ITS OPPOSITION TO THE
PROPOSAL BY THE COUNTY OF LOS ANGELES, TO UTILIZE
DEFERRED COMPENSATION FUNDS TO ASSIST IN BALANCING THE
COUNTY'S BUDGET
WHEREAS, it has been noted that the Los Angeles County Board of
Supervisors proposes to borrow assets of the County's 457 Deferred
Compensation Plan to fund a budget deficit; and,
WHEREAS, Section 457 of the Internal Revenue Code allows any eligible
gave rumen tal agency, including cities, to create a 451 Deferred Compensation
Plan. Currently, a significant number of local governments offer these plans
which are widely promoted as supplemental retirement for employees; and,
WHEREAS, participating employees in 457 plans consider these savings
to be an essential component of their retirement, and while the money remains
an asset of Lhe governmental agency, participants have a degree of control
over the asset, including where the money is invested and the circumstances
under which it may be withdrawn; and,
WHEREAS, Lhe City of Rancho Cucamonga is aware of a recent proposal
by the Los Angeles County Board of Supervisors to borrow f250 million of the
County's 457 Deferred Compensation Plan funds to help meet an estimated budget
shortfall of approximately E600 mi117on. The County has indicated that the
funds would be borrowed only temporarily, and that they would be repaid over a
period of six to seven years at an interest rate of approximately 6% to 6-1/2%
annually; and,
WHEREAS, the City of Rancho Cucamonga believes that once the.
integrity of the 457 assets has Dcen violated, the confidence of Lhe employee
has peen breached and opens the door for yet further "borrowing" of these
dS5P,L5.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve that it is opposed to the County of Los Angeles making use of
457 funds to assist in balancing its budget, and that such assets should only
be used for the purposes intended.

designation of the H. W. Minor House ae an Historic Point of Interest
with the adoption of the attached resolution.
H11CIHiRUpID: The H. W. Minor residence, cone trusted in approximately
1927, was rnnatructed in the classic California bungalow style
architecture covwon to the era. Several alterations to the structure,
including aluminum aiding and a patio enclosure, have been added over
the years; but since these elements ere reversible, the house could
eventually retain its original character and a landmark designation
pursued. The owners and developer of the related Tentative Tract 15531
are proposing to preserve this house on one of the 30 lots within the
subdivision.
Wilbur Minor, a butcher in the Cucamonga and Alta Loma area, cro natructed
this house and was associated with the property until 1945. Several
historical resources tie Mr. Minor with the Kincaid Market in Cucamonga
and lacer the G. A. Bil].inga Grocery in Alta Loma, where he operated his
Catcher shop and delivery business which served as an important service
in the cortmunity.
This property also includes a mature citrus grove and the Alta Loma e9q
ranch store and associated structures, which are proposed to be removed
with the development of Tentative Tract 15531. The Historic
Preservation comaisaion has reco;maended that these elements be
documented prior to removal find an historical plaque incorporated into
the tract perimeter fencing, near the intersection of 19th Street end
Mayberry Avsnue. This would be conditioned with approval of the related
Tentative Tract Map.

Residence, located at 10304 19th Street, as a Historic Point

BACKGROUND: Staff has been working with Hix Development oust the past
two months in the processing of Tentative Tract 15531, which includes
the H. W. Minor residence and the associated Alta Loma Egg Ranch within
its boundaries. The Minor residence was originally listed as a SUS
(Surveyed with Undetermined Significance) on the Clty'e Historic Site
List (see Exhibit "HPC-1").
On November 10, 1992, the Historic preservation Commission reviewed the
conceptual plans for the tentative tract map, which includes the Minor
residence preserved in place on one of the 30 lots within the
subdivision. The Commission directed staff to schedule this item for
public hearing to formally consider the residence as a local historic
Point of Interest.
SITE LOCATION AND DESCRIPTION: Situated on the northeast corner of 19th
Street and Mayberry Avenue, the .7q-acre parcel is relatively flat,
sloping from north to south at approximately 4 percent. The site
contains the N. W. Minor residence, the Alta Loma Egg Ranch store,
several chicken coops, and a mature citrus grove.
SITE LAND USE, 20N ING, AND GENBPAL PLAN DESIGNATION: The re ai den ce is
currently utilized as a single family residence and the egg ranch et ore
is open during regular business hours and on weekends. The si to is
designated Low Residential (2-4 dwelling unite per acre) by the General
Plan and Development Dis tricte Map.

PHYSICAL DESCRIPTION OF RESIDENCE: The H• W. Minor residence,
constructed in approximately 1927, is a single-story bungalow with
several low gables and wide overhanging eaves. Many modifications to
the structure, including a patio enclosure and horizontal aluminum
siding, have been completed over the years. A detached two-car garage
probably closely emulates the architecture of the house as it was
originally constructed. It appears that a portion of the citrus grove
was replaced with the egg ranch sometime after 1949. Further details
about the site and any structures thereon can be found in the attached
State Historic Resource Survey Form completed in 1988 (refer to Exhibit
"HPC-3").
ANALYSIS/HISTORICAL SIGNIFICANCE: The structure cnn strutted in
approximately 1927 and was the home of Wilbur Minor, who was a butcher
in the Cucamonga and Alta Loma area. Several historical resources
indicate that Wilbur Minor was associated with the RSncaid Market in
downtown Cucamonga as early as 1912 and drove a wagon to deliver fresh
meats in the community. Be was later associated with the G. A. Billinga
Grocery in Alta Lome, ranting the north half of the building for a meat
market. Ha also continued hie home meat delivery by truck, with his
route extending out as far east as Htlaanda and wear to San Antonio
Canyon. Hie association with the property can be documented until
1945. Due to the importance of the achievements of Wilbur Minor in
supplying the young community with a much-needed service, this residence
should stand to represent his achievements.
ARCHITECTURAL SIGNIFICANCE: Again, the overall form and material use
exhibited for the Minor Residence is typical of the bungalow style
utilized coamonly during the 1920s and 1930x. Because of the numerous
exterior mod ifica[iona completed on the residence over the years, staff
concurs with the State Hietoriane that determined that the Minor house's
significance has been diminished by these alterations, especially the
aluminum aiding and replacement of the wood-frame windows with alwoinum
sliding windows. However, because many of the alterations are
reversible, the Minor house could potentially be restored to Sta
original condition in the future and a Landmark designation could be
pursued.
ISSUES: In reviewing the request io preserve the Minor residence in
place, staff notes Che following iaeuee for the Comml aslon to conaiden
Perimeter ^`all/Pence Situation: Uuring the proneeaing of
Tentative Tract 15531, staff has been encouraging the developer
of the pro)ect to utilize open perimeter fencing in front of
the etrvcture to open views of the residence to 19th Street.
In conversations with the developer, they concur that this
theue can be addreaeed [eadily through the uae of open tubular
Fencing with rack pile etere and cap, similar to the deal gn used
around the perimeter of another hlatoric structure, the Lord
House on the east Bide of Hellman Avenue.

pe to ched Garage: As noted earlier, a detached two-car garage
currently exists north and west of the Minor residence.
He cause of the citc~~la tion conflicts created with the
development of the subdivision, the applicant intends to
demolish this garage and construct a new detached two-car
garage that is accessed through the new Socal street system
within Tentative Tract 15531• Staff has stressed to the
developer the importance of providing a new detached two-car
garage that closely emulates the historical character of the
Minor residence, subject to close scrutiny of the Planning
Division staff. If the Historic Preservation Conm;i ssion
concurs, stafF will review the designs for the new garage
addre ssirg any Commission concerns and ensuring the
architecture is in close compliance with the residence prior to
issuing building pe zmits for the garage.
Egy Ranch/Citrus Grove: Throughout much of the ai re's history,
the primary use and function of the property was a working
citrus grove. Aogever, eometia;e after 1949, this complex was
modified to a working egg ranch in conjunction with the citrus
groring industry, which is a long-standing tradition in Alta
Loma. With the future development of the property as a
residential subdivision, the developer intends to remove all
s tructuree associated with the egg ranch and citrus trees on
the property. Therefore, staff would recosurend that the
significance of the egg ranch and citrus glove be documented by
incorporating a plaque or a similar historic monument with
text, subject to staff review and approval, near the
intersection of 19th. Street and Mayberry Avenue.
ENVIRONMENTAL ASSESSMENT: Aistorlc Point of Interest designations are
exempt under CF.QA per Article 19, Section 15308. This designs ilon ie
accompanied by a duly advertised public hearing.
FACE FOR FINDINGS: In Section 2.24.090 of the City's Historic
Preservation Ordinance, the following findings are made concerning the
designation:
A. Historical and Cultural SignifiCanoe:
Finding: The proposed Point of Inte re at ie particularly

Fact/s: The house in question ae rues as an example of the

Staff recommends that the City Council approve, by minute action, the
proposed amendments to the 1990-91 and 1991-92 Final Statements allowing
t'ne transfer of funds in the amount of 5188,600 to orovide adequate
funds for the construction of the Sierra Madre street improvements from
9th Street to 300 feet south of Chaffey Street.
ABSTRACT
Since 1948, public improvements funded through the Community Development
Block Grant program have for axed on the Southwest Cucamonga area as an
on-going, multi-pear project. Improvementa north of Arrow Rovte have
been r_omplet_d as we 11 as improvemen to Eor Sierra Madre Street between
brow Route and 9th Street (see Exhibit "A"). The Engineering Division
is now ready to begin construction on the third and Ei nal phase of the
S i~~rra Madre street improvements. The design work for this project was
completed at the end of the last program year.
Funds in the amount of $79,900 were allocated in the 1991-92 program
year for the Srnithwesc Cucamonga street improvement project. However,
$55,500 of those funds ware utl llzed to complete prior year projects
leaving $22,500 available for the Sierra Madre project. Rased upon
recent enginoer inq estimates, the cost for construction of the third
phase of Sterrn Madre is anticipated to be $161,763. Therefore, an

additional $118,600 is required to be transferred to the 1991-92
Southwest Cucamonga program allocation. This $118,600 will be
transferred from the 1990-91 Southwest Cucamonga program allocation,
lea vi ny $8,468, which will eventually be used for completion of future
projects. It is anticipated that Vinmar Avenue, between 9th Street and
Chaffey Street, wi 11 to the next improvement project to begin once the
third phase of the Sierra Madre street improvement project is completed
(see Exhibit "B").
Should the City Council adopt the recommendation, staff will amend the
1990-91 and 1991-92 Final Statements for submission to the cepartment of
Housing and Urban ceve lopment.
BACICGROBND
The City's Citizen Participation Plan for the CDBG program requires
that, prior to approving any change to the allocation of CDBG funds that
would add, delete, or change any CDBG project oc funding allocation by
25 percent or more, the public he notified and provided an opportunity
to comment on the change. A public notice was published in the Inland
Valley Daily Bulletin newapape r. Upon consideration of the proposed
transfer of Eunda by the City Council under the Consent Calendar, the
Citizen's Pe riicipation requirement9 will be met.

It is recommended that the City Council approve an amendment to Professional
Services Agreement CO 91-053 with NBS/Lowry for an amount not to exceed
512,000 for continued tax and bond consulting of Community Facilities District
(CFD) 88-2. This agreement is to be funded fmm account 75-4130-6025 and will
not affect the general fund.
Because of the unique circumstances surrounding this special district, a great
number of bond and tax alternatives have been examined in attemp[ to fulfill
the purpose of this district, Because of the increased time spent on this project
and the number of scenarios that have to be evaluated, it is felt that it is in the
City's best interest to continue the contract with NBS/Lowry. As the City's
consultant NBS/Cowry will continue to examine the different scenarios to
insure that the City's interests are protected and subsequently the interests of
the citizens of the special distric!.
The cost for this amendment will not exceed 512,000. This cost is based on an
estimate of time required to evaluate the tax levy in the district and the related
banding capacity of the district. Again, this work is being done so that we may
meet the obligations of Purchase/Financing Agreement 89-111 without
creasing undo hardship for contractors who have performed work in the
District in good faith.

RECOMMENDATION:
It is recamnended.that the City Council accept Lhe Arrow Route Bridge
Widening at Cucamonga Creek Improvement Project as complete, authorize
the City Engineer to file a `Notice of Completion," authorize the release
of the Faithful Performance Bond in the amount of 5336,736.60, release
the Labor and Materials Bond to the amount of 5168,368.30 six months
after recordation of said notice 1f no claims have been received and
authorize the release of the retention 1n the amount of 535,468.07 35
days after acceptance.
BACKGROUND/ANALYSIS
The sub,iect project has been completed in accordance with the approved
plans and specifications and to the satisfaction of the City Engineer.
The ftnal contract amount 1s f354,680.67 which includes four minor Change
orders in the amount of f7,6D4.00. The original amount approved by
Council was 5370,410.26.

Jerry Uribe Jerry has served as the Vice-Commander of the
Rancho Cucamonga Sheriffs Explorer Post and has
volunteered over 2,500 hours of his time to this
community since November, 1988. Jerry has
entered the Sheriffs Academy and wili soon be
seying as a full time Sheriffs Deputy.
Daniel Cortez Although Daniel can't be here this evening, as he is
now in Army Basic Training, we would like to
recognize him this evening as well. Daniel became a
Sheriffs Explorer in September, 1988 and served as
the Post Commander. He also has volunteered over
2,500 hours of his time to this community.
The young men and women of the Sheriffs Explorer program are to
be commended for their spirit of community service and for the
positive example they set for other young people, The city council
would like to express its thanks to these two young men for their
contributions to Rancho Cucamonga. We would also like to wish them
luck in their new endeavors.

Staff recommends that the City Council approve, by note action, the
proposed amendments to the 1990-91 and 1991-92 tatements allowing
the transfer of funds in the amount of ,60 0 orovide adequate
funds Eor the construction of the sierra street improvements from
9th S<reet to 700 feet south of Chaf Eey Street.

Since 1988, public improvements funded through the Conmunity Development
91 ock. Grant program have focused on the Southwest Cucamonga area as an
nn-going, multi-year project. Improvements north of Arrow Route have
been romp leted as well as improvements for Sierra Madre Street between
Acrow Route and 9th Srreet (see Exhibit "A")• The Engineering Division
is now ready to begin construction on the third and final phase of. the
Sierra Ma dte street improvements. The design work Eor this project was
compl_ted at the end of the last program year.
F un;ls in the amount of $79,700 were allocated in the 1991-92 program
year for the Southwest Cucamonga street improvement project. However,
555,500 of those `ands were utilized to comp late prior year projects
lnav ing 522,500 available fur the Siarra Madre project. Based upon
re rent engineering estimates, the cost for construction of the third
phase of Sierca Madre is anticipated ro be $141,063• Therefore, an

Southwest camon3a program allocation. This 8,6 will be
transferred from the 1990-91 Southwest Cucamonga program allocation,
leaving $8,368, which will eventually be used for completion of future
projects. It is anticipated that Vinmar Avenue, between 9th Street and
Chaffey Street, wail be the next improvement project to begin once the
third phase of the Sie rza Madre street improvement project is completed
(see Exhibit "B").
Should the City council adopt the recommendation, staff will amend the
199D-91 and 1991-92 Final Statements for submission to the Department of
Housing and Vrban ceve lopme nt.
BACICGAOOPD
The City's Citizen Participation Plan for the CDBG program requires
that, prior to approving any change to the allocation of CDBG funds that
would add, delete, or change any CDHG project or funding allocation by
25 percent or more, the public be notified and provided an opportunity
to comment on the change. A public notice was published in the Inland
Va 11ey Daily eul le tin newspaper. Upon conaide ration of the proposed
transfer of funds by the City Council under the Consent Calendar, the
Citizen's Participation requirements will be cat.
