HomeMy WebLinkAbout474 - Ordinances - Not approvedNOT APPROVED CeDINANCE NO. 474 AN ORDINANCE OF THE CITY OOUNCIL OF THE CITY OF RAN(I{O C~3CAMDNGA, CAr .IFOMqIA, APPROVING VICIORIA PIANNMD OCM~KlqlTY AMENEMBNT 91-03, SUBAREA G, AM~qDING THE VICIDRIA PIANNtD ~ LAND USE MAP FRCM MBDIII~ RESIDMqTIAL (8-14 DW~.rING UNITS PER ACRE) TO LOW-MBDIUM RESIDMqTIAL (4-8 [~n~I.TNG UNITS PER ACRE) FOR 11.87 ACRES OF IAND LOCATED ON THE NORIMEAST CORNER OF KMqYON WAY AND APN: FORT/ON OF 227-011-26 A. Recitals. (i) On May 20, 1981, the City of Rand~o Cucamonga approved the enactment of the Victoria Planned Oa~,munity through the adoption of O~ No. 143. (ii) On August 5, 1991, the City of Rancho Cucamonga filed an application for Victoria Planned C~ti~unity ~t No. 91-03, Subarea G, as described in the title of this Ordinance. Hereinafter in this Ordinance, the subject Victoria Planned Oa~,,t~unity Amendment is referred to as "the application." (iii) On October 9, 1991, the Planning C~at,~ssion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution 91-158 reoa~i~ending to the City Council that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Ordinance. (v) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follc~s: (a) The application applies to 11.87 acres of land located on the northeast corner of Kenyon Way and Woodruff Place and is presently undeveloped. Said property is currently designated Meiium R~sidential (8-14 dwelling units per acre); and Ordinance No. 474 Page 2 (b) Tne property to the north of the subject site is designated C~m~ulity Facility and is vacant; the properties to the south are designated Park and School and are vacant; the property to the east is designated Low- Medium Residential (4-8 dwelling units per acre) and is developed with single family reside; and the property to the west is designated Village ~cial and is developed with a c~m,ercial shopping center under construction; and (c) This amendment does not conflict with the ]'arid Use Policies of the General Plan and Victoria Planned C,~_at,,tm3rlity arid. will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) Tnis amendment promotes the goals and objectives of the Land Use Element; and (e) The properties located in Subarea G of the application are suitable for the uses permitted in the proposed district and are cc~oatible with existing and adjacent land use designations as evidenced by the location of properties with the same land use designations bordering the subject site to the east; (f) This amendment would not have a significant impact on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Study; and 3. Tnis Council hereby finds that the project ba.~ been reviewed and considered in c~-~liance with the California Environmental Quality ~Et of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves Victoria Planned C~m.unity Amendment 91-03, Subarea G, amending the Victoria Planned Oap..unity Land Use Map from Medium Residential (8-14 dwelling units per acre) to Low-Meiium Residential (4-8 dwelling units per acre) for 11.87 acres of land located on the northeast corner of Kenyon Way and Woodruff Place as shown in Exhibit "A." 5. The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
