HomeMy WebLinkAbout460 - Ordinances ORDINANCE NO. 460 AN ORDINANCE OF THE CITY OOUNCIL OF THE CITY OF RANC~O ~, CAT.TFORNIA, ADOPT/NG, BY REFBR[NCE, ORDINANCE NO. 3349 OF THE COUNTY OF SAN BERNARDINO P~AINING TO THE B~TABLIE OF RUI.m, REGULATIONS AND P~O~I[RES PROGRAM OF THE COUNTY OF SAN BERNARDINO, INCLUDING THE ES~ABLI~ OF CERIRIN FRFR AND PBNALT/ES A. Recitals. (i) The City of Rancho Cucamonga ba~ entered into an agreement with the County of San Bernardino to participate in the County's vehicle abatement proem-am regarding abandoned, dismantled, inoperative, junked and wrecked vehicles within the City of Rancho Cucamonga. Pursuant to the requ~remente of that agreement, the City is required to adopt, by reference, Ordinance No. 3349 of the County of San Bernardino pertaining to the rules and regulations establishing the County Vehicle Abatement and Removal Program. (ii) Article 2 of Chapter 1 of Part 1 of Division 1 of Title 5 of the California Govet Code (Sections 50020, et seq.), authorizes the adoption, by reference, of certain state and local ordinances, including the County of San Bernardino Vehicle Abatement and Removal Program as adopted by Ordinance No. 3349 of the Board of Supervisors of the County of San Bernardino. (iii) At least one (1) copy of said Ordinance certified as a full, true and correct copy thereof by the City Clerk of the City of Rancho Cucamonga, has been filed in the Office of the City Clerk of the City of Rancho Cuc~__~onga in accordance with the provisions of California Goverrm~nt Code Section 50022.6. (iv) Prior to the adoption of this Ordinance, this City Council conducted a duly noticed public hearing, as requ~ed by California Gove~-x-~_nt Code Section 50022.3. (v) All legal prerequisites prior to the adoption of the Ordinance have occurred. B. Ordinance. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follc~s: SECTION 1: In all respects as set forth in the Recitals, Part A, of SECTION 2: The City Council of the City of Rancho Cucamonga hereby adopts the provisions of the San Bernardino County '~rehicle Abatement and Renoval Program" as adopted by Ordinance No. 3349 of the Board of Supervisors of the Oounty of San Bernardino. Ordinance No. 460 Page 2 SECTION 3: The City Council declares that should any provision, section, paragraph, sentence or words of this Ordinance be rerdered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the reining provisions, sections, paragrat~ls, sentences, and words of this Ordinance shall re~ain in full force and effect. SECTION 4: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general c/rculation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
