A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT SAID
EASEMENT, MORE PARTICULARLY DESCRIBED HEREIN, TO
BE UNNECESSARY, AND AUTHORIZING AND DIRECTING
THE CITY ENGINEER AND CITY CLERK TO EXECUTE THAT
CERTAIN DEED, A COPY OF WHICH IS ATTACHED HERETO
AS EXHIBIT "A", AND TO CAUSE THE SAME TO BE
RECORDED
A. RECITALS.
(i) The City of Rancho Cucamonga has an easement for storm drain purposes
generally located at 12645 Sixth Street, west of Etiwanda Avenue in the City
of Rancho Cucamonga, County of San Bernardino, California, and herein
referred to in this Resolution as "said easement' A full, true, and complete
description of said easement is set forth in Official Record 84-292832,
County of San Bernardino
(ii) Said easement was acquired by the City of Rancho Cucamonga for storm
drain purposes, the need for which has been superseded by an alternate
alignment for the storm drain and a new easement
(iii) The new easement has been executed by the property owner
(iv) Said easement is obsolete now that the storm drain has been removed from
it
(v) The Planning Commission of the City of Rancho Cucamonga heretofore
made the finding on February 28, 2007 that disposing of said easement, as
herein contemplated, would be in conformity with the General Plan of the City
of Rancho Cucamonga
(vi) All legal prerequisites to the adoption of this Resolution have occurred
B. RESOLUTION.
NOW, THEREFORE, the City Council of the City Of Rancho Cucamonga does
hereby find, determine, and resolve as follows
1 All facts stated in the Recitals, Part A of this Resolution hereby are found to
be true and correct
2 This Council hereby finds that the quitclaiming of said easement described in
said deed will benefit the City of Rancho Cucamonga
3. The City Engineer and City Clerk hereby are authorized and directed to
execute the deed, a full, true, and correct copy of which is attached hereto as
Exhibit "A", and cause the same to be recorded forthwith upon adoption of
this Resolution

4. The City Clerk shall certify to the adoption of this Resolution
PASSED, APPROVED, AND ADOPTED this 7th day of March 2007

87, PAGES 11 THROUGH 13, INCLUSIVE, OF PARCEL MAPS IN THE OFFICE OF THE COUNTY
RECORDER OF SAID COUNTY INCLUDED WITHIN A STRIP OF LAND 1500 FEET WIDE, AN
EASEMENT FOR STORM DRAIN PURPOSES, DESCRIBED AS STRIP "B° IN A DEED TO THE CITY
