HomeMy WebLinkAbout09-058 - Resolutions RESOLUTION NO. 09-058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AUTHORIZING THE CREATION OF REVENUE ENHANCEMENT ZONES WITHIN THE CITY FOR THE PURPOSE OF GENERATING ADDITIONAL PROPERTY TAX REVENUE FOR THE CITY OF RANCHO CUCAMONGA WHEREAS, the County of San Bernardino (the "County"), through its amended Standard Practice No. 02-14SP, (the "Standard Practice') implemented County Policy No. 02- 14, Sharing Property Tax Revenues with Cities (the 'Policy'), which establishes procedures concerning applying for and approving Revenue Enhancement Zones ("REZ") within Qualifying Cities (defined in the Standard Practice), pursuant to the Policy and provides that it is the policy of the County's Board of Supervisors ("Board") to provide for the equitable allocation of ad valorem Property Tax Revenues (defined in the Standard Practice), between the County and its incorporated cities; and WHEREAS, the Board approved the creation of Revenue Enhancement Zones in order to provide for the equitable allocation of therg owth of ad valorem Property Tax Revenues between the County and incorporated cities that receive an allocation of less than 7% of the 1% General Tax Levy Distribution Percentage (defined In the Standard Practice), within its incorporated boundaries. WHEREAS, the property tax revenue growth distributed to the Qualifying City and County in each Revenue Enhancement Zone approved by the Board will be divided equally (50/50 split) between the Qualifying City and the County, but in no event shall a Qualifying City receive more than a 7% share of the 1% General Tax Levy Distribution Percentage if the Qualifying City has any Redevelopment Areas within its incorporated boundaries; and WHEREAS, the Standard Practice identifies the City of Rancho Cucamonga as a Qualifying City and the County has determined that all land within the proposed Revenue Enhancement Zones is Qualifying Land (defined in the Standard Practice) for the parcels listed in Attachment A, and incorporated herein by reference; and WHEREAS, the Standard Practice requires each Qualifying City to enter into an agreement with a 25-year term setting forth the details of the Property Tax Revenues transfer for each Revenue Enhancement Zone; and WHEREAS, on April 1, 2009, the City held a duly noticed public hearing in accordance with Revenue and Taxation Code Section 99.02 to consider the proposed effect of the transfer of Property Tax Revenues for each Revenue Enhancement Zone. Resolution No. 09-058 Page 2 of 5 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, HEREBY FINDS AND RESOLVES AS FOLLOWS: Section 1. The facts set forth in this Resolution are true and correct. Section 2. The Council authorizes the establishment of Revenue Enhancement Zones for the parcels listed in Attachment A for the purpose of generating additional property tax revenue for the City as growth occurs. Section 3. The form of Standard Agreement for Revenue Enhancement Zones, by and between the City and the County of San Bernardino, is hereby approved, and the Mayor and City Manager, or either of them, are hereby authorized and directed, for and in the name and on behalf of the City to execute the Standard Agreement for Revenue Enhancement Zones in substantially the form on file with the City Clerk and presented at this meeting, with such changes therein as the officer executing the same may approve, such approval to be conclusively evidenced by such execution and delivery thereof. Section 4. The City Clerk shall certify to the adoption of this Resolution.
