The Council, Fire Board and Agency may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individuals desiring to speak. All communications are to be addressed directly to the Council, Fire Board and Agency, not to the members of the audience. This is a professional business meeting and courtesy and decorum are expected. We all know the dangers and addictive nature of tobacco and particularly the toxic and hazardous emissions from a cigarette that affect the health of so many people. More than 53,000 Americans die every year from SHS exposure. These are people that never smoked but succumbed to the deadly toxins. Additionally, the Air Resources Board unanimously found that tobacco smoke harms not only the smoker, but innocent bystanders as well. The California Environmental Protection Agency, Air Resources Board declared SHS to be a Toxic Air Contaminant based on a rigorous four year scientific study that included public comment and independent peer review. SHS joins benzene, arsenic, and diesel exhaust on the Toxic Air Contaminant list. How much longer should the debate continue of the harmful effects of SHS? My sister was a tobacco addict and died at the young age of 45 from smoking-related causes. She left two children and a husband behind. When I saw her in the casket, I was angry and grieving her loss from an addiction that could have been prevented! She is only one of millions that have died as a result of smoking and of SHS exposure. However, that "one" was my loving sister Ana. How many more lives are to be lost? Do we turn a blind eye and just maintain the status quo? NO! We can stand up to BIG TOBACCO AND SAY ENOUGH IS ENOUGH. City ordinances that restrict and prohibit exposure to SHS save lives! It is time to step up to the plate and make Rancho Cucamonga a leader within the southland by sending a strong message to other cities that we care for the health and wellbeing of all citizens within this community, and will no longer tolerate this toxic poison to be inhaled by our children, adolescents and adults! Ask yourselves, what is best for the majority of our citizens? Will we be creating a healthier environment? We will be saving lives? I think you know the answer! I urge you to vote yes on this ordinance! BACKGROUND The City Council has explored the issue of secondhand smoke and "no smoking in public" policies for the last two years. On February 6, 2008 City Council approved Ordinance No. 786, which prohibits smoking at all City-owned property. The new restrictions prohibit smoking at all City- owned public locations and created smoke-free environments in and around all city facilities, such as City Hall, Victoria Gardens Cultural Center, Animal Center, Epicenter (except in designated smoking areas for current tenants with long term lease agreements), community centers, libraries, parks, trails, etc., including the property surrounding these facilities and its parking lots. At that time, staff was also given direction to bring back to the City Council information on the development of Phase II of smoking regulations. Phase II consisted of evaluating smoking restrictions in other parts of the City such as restaurant outdoor dining areas, shopping centers, apartment buildings, hotels, streets and sidewalks, outdoor service lines, transit stops, and other similar common use spaces where the public may be exposed to secondhand smoke. At a special Council meeting in December 2008, the City Council discussed their potential interest in implementing no smoking policies in the aforementioned public places and directed staff to initiate a community and stakeholder outreach campaign in order to gather public input regarding no-smoking policies. The outreach campaign included a community survey and a series of community workshops. The results of the campaign were presented at an October 7, 2009 special Council Meeting. After receiving the information from the campaign, the City Council determined a policy direction on smoking policies at these various public places. For each of these identified public places, the City Council provided policy direction on whether a smoking restriction should be considered a) completely, b) not at all, or c) somewhere "in between." City Council chose not to implement no smoking policies for shopping centers, hotels, and apartments. The following summarizes the Council's policy direction given at the October 2009 special meeting. SUMMARY OF COUNCIL'S POLICY DIRECTION FOR NO SMOKING POLICIES (OCTOBER 2009) Complete Restriction No Additional Restrictions "In-Between" Streets and Sidewalks X- pending further info Hotels-Guest Rooms X Hotels-Common Areas X Outdoor Dining Areas X-pending further info Transit Stops X Outdoor Service Lines X Shopping Centers X Multi-Family Apartment Units X Multi-Family Common Areas X Along with providing this policy direction, the City Council also provided staff with the following direction: • No smoking ordinance: Draft an ordinance prohibiting smoking within 20 feet of transit stops and train platforms and within 20 feet of outdoor service lines • Outreach to restaurant owners/managers: Collect input and comments from Rancho Cucamonga's restaurant community and California Restaurant Association regarding no smoking policies at outdoor dining areas. • Recognition program: Develop a recognition program to encourage smoke-free apartments, hotels, and other businesses. • Streets and Sidewalks: Provide further information on how other cities have restricted smoking on streets and sidewalks. • Smoke-free Victoria Gardens: Meet with Victoria Gardens management to discuss voluntarily implementing smoke-free areas at Victoria Gardens Regional Center. DRAFT NO SMOKING ORDINANCE (TRANSIT STOPS AND OUTDOOR SERVICE LINES) The City Attorney's Office has developed a draft ordinance that restricts smoking at transit stops and at outdoor service lines, per the Council's prior policy direction. The Ordinance is attached as Attachment A. Specifically the draft ordinance would: Prohibit smoking within twenty (20) feet of any transit station located within the City. This includes multi-modal platforms, sidewalks, shelters, benches, and other areas where persons wait for trains, buses, taxis, or other public transit, and includes ancillary areas such as restrooms, pedestrian path or walkways, bicycle parking areas and kiosks. Prohibit smoking within twenty (20) feet of outdoor service lines. "Service line" is defined as an area where one or more persons are entering or waiting to enter into a transaction for DISCUSSION OF PHASE II OF SMOKING REGULATIONS AND POSSIBLE AMENDMENTS TO CIIAPTER PAGE 3 8.21 OF THE RANCHO CUCAMONGA MUNICIPAL CODE FEBRUARY 3, 2010 goods and/or services, regardless of whether such transaction involves the exchange of money, or whether person are standing or seated, and includes, but is not limited to areas surrounding the following locations: Informational kiosks, automated teller machines (ATMs), theaters, restaurants, banks, vending machines, and food, beverage or merchandise stands. Require the posting of no smoking signs wherever smoking is prohibited. Signs need to be clearly, conspicuously and sufficiently posted and is the duty of the owner, operator, manager, or other person having control of such room, building or other place where smoking is prohibited, to post such signs and maintain in good condition. Make it unlawful for any person to smoke in any area posted as a nonsmoking area and make it unlawful for any person who owns, operates, manages, or otherwise controls the use of any premises to permit or allow any other person to smoke in any area posted as a nonsmoking area. A violation is considered an infraction (not a misdemeanor) by a fine not exceeding $100 for first violation, not exceeding $200 for a second violation of the same ordinance within one year, and not exceeding $500 for each additional violation of the same ordinance within one year. OUTREACH TO RANCHO CUCAMONGA RESTAURANT OWNERS/MANAGERS At the October 2009 meeting, the City Council expressed the need to receive feedback from the Rancho Cucamonga restaurant community and the California Restaurant Association before providing policy direction on no smoking policies at restaurant outdoor dining areas. Staff solicited input and feedback from the restaurant community utilizing a number of different avenues. One-on-One Interviews: One of the outreach efforts was onsite one-on-one interviews with restaurant owners or managers that currently have outdoor dining areas. The purpose of the interviews was to collect anecdotal qualitative information and specific comments and feedback that would not be possible to collect through a mailed survey. Twenty restaurants were randomly selected utilizing Microsoft Excel software that assigns a random variable to each of the 300+ food establishments, which were then sorted and the top 20 restaurants with outdoor dining areas were selected for participation. Of these, staff was able to interview 16 restaurant owners/managers; staff was either not able to make contact with the remaining four restaurants or they referred all questions to a corporate office. The restaurants that were interviewed included one (1) fine dining restaurant, eight (8) casual dining full service restaurants, and seven (7) quick service/fast food restaurants. Below is a summary of key points and observations made: • While there were those who stated their support for a no smoking policy, it tended to be lukewarm while those that did not support it were strongly opposed. • Many restaurants already have a corporate no smoking policy • Restaurants along 4"' Street were concerned that smoking patrons will simply go across the street to Ontario restaurants • Several restaurants expressed how difficult it would be to segregate smokers from nonsmokers in outdoor dining areas, regardless of whether they favored a no smoking policy or not. • Restaurants with a significant social atmosphere (ie., happy hour/weekend crowd) strongly oppose a no smoking policy Workshop: The City sent flyers through the mail inviting restaurant owners and managers to a facilitated workshop held at Central Park. A copy of the flyer was also sent to the Chamber or Commerce for publicity in their newsletter as well. The workshop was scheduled on a Tuesday, at 3:00 p.m., the slowest day and hour for restaurants, in order to ensure convenience and attendance. Six individuals attended the workshop including restaurant operators from McAlans, Buffalo Wild Wings, Don Marcos Mexican Restaurant, Lucille's, and Red Hill Cafe. None of the workshop participants supported a no smoking ordinance in any form and, in fact, most were extremely opposed to any such no smoking policy. Many of the concerns expressed at the workshop involved the negative effects a no smoking policy would have on their businesses. Participants communicated that such a policy would have a financial impact oh their business and a loss of business and clientele. There was concern that patrons would instead visit restaurants and bars outside Rancho Cucamonga. One participant attributes 17 percent of his restaurant's sales to the outdoor patio and the smokers that sit out there. Other negative effects mentioned at the workshop include safety/security concerns. A no smoking policy for outdoor dining areas would force smokers to loiter in front of the restaurant and in the parking lot. This in turn could result in ABC complaints as people walk out of the restaurant or bar with their alcoholic beverage. It also creates a security concern as it will result in an increase of people frequently leaving and re-entering the restaurant or bar. It was also noted that forcing smokers out front makes the business look unappealing. Furthermore, it would force others - including families - to walk through smoke when passing by the restaurant or in the parking lot. Other comments expressed at the workshop include: • If nonsmokers don't want to smell the smoke, they can eat inside the restaurant. • Prohibiting smoking in restaurants should be a business decision and not mandated by government. DISCUSSION OF PHASE II OF SMOKING REGULATIONS AND POSSIBLE AIvIENDMENTS TO CHAPTER PAGE 6 8.21 OF TI3E RANCHO CUCAMONGA MUNICIPAL CODE FEBRUARY 3, 2010 ^ Food servers should not have to enforce a no smoking policy. ^ Restaurants were concerned about fairness, and that some restaurants will follow the rules, while others will not. ^ If no smoking policy is enacted, one participant stated he will move his business tv Ontario. For those who could not attend the workshop, the invitation flyer that was sent to the restaurants provided an opportunity for restaurant operators to fax their comments in as well. Twelve such comments were received and are attached for the Council's review as Attachment B. Five (5) comments supported a no smoking policy, three comments (3) expressed their opposition to a no smoking policy, three (3) comments expressed their support for a policy that provides for a limited portion of outdoor dining as smoke-free, and one (1) had no opinion. Restaurant Survey: In November 2009, a survey was mailed to 345 Rancho Cucamonga food establishments asking them for their opinions regarding no smoking policies in outdoor dining areas. The survey was sent to the establishments through U.S. postal mail and included a cover letter and self-addressed stamped envelope. The City received back 80 completed surveys, which represents a 23 percent return rate. Two surveys were received after the deadline. The informal survey was only meant to provide a general "snapshot" of the restaurant community's attitude towards no smoking policies. It should be noted that staff had mistakenly omitted City Hall's return address on the self-addressed stamped envelope that was provided. The survey began with asking some preliminary questions regarding the restaurant's size, type, presence of outdoor dining area, operation, location type, presence of bar, amount of liquor sales, etc. Forty three (43) percent of the survey participants classified themselves as casual dining full service restaurant, forty one (41) percent indicated that they offer outdoor dining at their restaurant, and twenty nine (29) percent indicated that they have a bar. When asked whether they would support a policy prohibiting smoking in outdoor dining areas, 43.6 percent agreed or strongly agreed with this statement and 39.8 percent disagreed or strongly disagreed. Over sixteen percent of survey participants had no opinion. It should also be noted that the survey participants were not interested in a "somewhere in between" alternative where only a certain portion or percentage of an outdoor dining area be designated non-smoking. Over forty one (41) percent said they would consider offering none of their outdoor dining area as non-smoking, while 37.8 percent would offer all of their outdoor dining area as non-smoking. Only 20 percent would offer a certain portion of their outdoor dining area as non-smoking. CALIFORNIA RESTAURANT ASSOCIATION The California Restaurant Association (CRA) represents the interests of restaurants statewide and describe themselves as "the definitive voice of the California food service industry and to protect and preserve its interests." Staff contacted the CRA in order to understand their position on no smoking policies for outdoor dining areas. They expressed their position that they OPPOSE no smoking policies, however, if the City chose to move forward with such a policy, the CRA would be interested in working with the City in crafting an ordinance. CRA worked closely with the City of Los Angeles in drafting their recently-adopted ordinance prohibiting smoking in outdoor dining areas.- The CRA was successful in exempting bars, clubs and private events from the Los Angeles ordinance. STREETS AND SIDEWALKS At it October 2009 meeting, the Council did not make a policy decision on whether to prohibit smoking on streets and sidewalks and requested further iriformation on how other cities have prohibited smoking on streets and sidewalks. While most cities do not prohibit smoking on streets and sidewalks, staff has reviewed ordinances from other California cities and below are some typical examples for the Council's consideration. The approaches taken by the few cities that do prohibit smoking on streets and sidewalks can be generally categorized into two methods: geographic location and proximity. Geographic location: Some cities have prohibited smoking on streets and sidewalks.within a defined geographic area. For example, the City of Burbank prohibits smoking on sidewalks, paseos, and pedestrian paths in Downtown Burbank. This area is defined in the ordinance within the boundaries of certain named streets. If the Council was interested in prohibiting smoking in a specific location/area of Rancho Cucamonga, a similar ordinance can be drafted. Proximity: Some cities, such as Pasadena, Glendale, and Santa Monica allow smoking on sidewalks, except within 20 feet of an area where smoking is restricted. These cities prohibit smoking within 20 feet of any entrance, exit, or open to buildings. For an urbanized "downtown" area such as Downtown Santa Monica or Old Town Pasadena where the storefronts abut the sidewalk, this restriction in effect prohibits smoking for much of these downtown areas. It should be noted, however, that Pasadena allows smoking "while actively passing on the way to another destination." The City of Calabasas allows smoking on streets and sidewalks only if no nonsmoker is present and, due to the time of day or other factors, it is not reasonable to expect another person to arrive. While this may seem reasonable, it would be difficult to enforce and confusing for smokers and nonsmokers alike. Locally, the City of Loma Linda has a complete prohibition on smoking on streets and sidewalks. DISCfJSSION OF PHASE II OF SMOKING REGULATIONS AND POSSIBLE AMENDMENTS TO C1-IAP'IER PAGE 12 8.21 OF THE RANQ-IO CUGAMONGA MUNIQPAL CODE FEBRUARY 3.2010 Summary of Smoking Prohibitions on Streets and Sidewalks City Prohibition Burbank No smoking on sidewalks, paseos, and pedestrian paths in Downtown Burbank Glendale Smoking permitted on streets and sidewalk except within 20 feet of an entrance, exit, or open window of any building open to the public or other location where smoking prohibited. Pasadena No smoking within 20 feet of an entrance, exit, or open window of a building except when actively passing on the way to another destination Santa Monica No smoking within 20 feet of any entrance, exit or open window to a building such as businesses, stores, offices, etc. Calabasas Smoking allowed on streets and sidewalks only if no nonsmoker is present and, due to time of day or other factors, it is not reasonable to expect another person to arrive Loma Linda Smoking prohibited on all streets and sidewalks SMOKE-FREE RECOGNITION PROGRAM Per City Council direction at the October 2008 meeting, staff has developed the basic framework for a recognition program that identifies and recognizes Rancho Cucamonga apartment communities, hotels, and other businesses that have voluntarily taken substantial steps to create a smoke-free environment. The intent of the program is to encourage apartment, hotel, and business owners to adopt smoke-free policies. Those receiving the "smoke-free" distinction will be recognized at a City Council meeting, in City publications, and on marketing materials. Staff anticipates that this program will be incorporated into the City's overall Healthy RC initiative and become a component of a larger Healthy RC recognition program. With the Council's approval, staff will further develop this program and prepare for implementation. A draft summary sheet is attached as Attachment C. VICTORIA GARDENS REGIONAL CENTER Staff met with Victoria Gardens management to discuss opportunities to voluntarily implement smoke-free zones at the Victoria Gardens Regional Center. They expressed an initial interest in doing so and two locations that were discussed include Guasti Gardens and the Orchard. Guasti Gardens is the courtyard area located directly outside of Coffee Bean and Tea Leaf on the east side of the Center and The Orchard is the food court outdoor dining area and playground area between the Food Court and Starbucks. Staff will continue to touch bases with VG management and offer any assistance; if needed, to implement these smoke-free zones for visitors to enjoy. FISCAL IMPACT Implementation of the attached ordinance would require the City to install no smoking signs at all 225 bus stops in the City and several more at the Metrolink Station. This is estimated to cost DISCUSSION OF PHASE II OF SMOKING REGULATIONS AND POSSIBLE AMENDMENTS TO CZ IAPTER PAGE 13 8.21 OF THE RANCHO CUCAMONGA MUNICIPAL CODE FEBRUARY 3, 2010 $6,000 in materials and supplies. With the Council's direction to move forward with this ordinance, staff is seeking Council authorization for an appropriation in the amount of $6,000 into Account 1025 001 5200 (Capital Reserve Fund) for purchase of materials. Should the Council provide direction to prohibit smoking in restaurant outdoor dining areas or other additional public areas, staff recommends developing educational materials such as brochures, . table tents, and beverage coasters to properly educate business owners and the public. Staff would seek an additional $5,000-$7,000 dollars from reserves to implement these educational efforts. CONCLUSION It is recommended that the City Council: Provide policy direction regarding no smoking policies in outdoor dining areas and on streets and sidewalk. Provide policy direction on how to proceed with an ordinance prohibiting smoking in outdoor service lines and transit stops [requires appropriation in the amount of $6,000 into Account 1025 001 5200 (Capital Reserve Fund) for purchase of materials]. Section 1. Section 8.21.020 (Definitions) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to add the following definitions, in alphabetical order: "`Service line' means an area where one or more persons are entering or waiting to enter into a transaction for goods and/or services, regardless of whether such transaction involves the exchange of money, or whether persons are standing or seated, and includes, but is not limited to, areas surrounding the following locations: Informational kiosks, automated teller machines (ATMs), theaters, restaurants, banks, vending machines, and food, beverage or merchandise stands. `Service line' does not include any area in which smoking is prohibited by State law, thereby precluding the City of Rancho Cucamonga from regulating smoking in that area." "`Transit station' means a transit stop and, includes, but is not limited to, multi-modal platforms, sidewalks, shelters, benches, and other areas where persons wait for trains, buses, taxis, or other public transit, and includes ancillary areas such as restrooms, pedestrian paths or walkways, bicycle parking areas and kiosks. `Transit stations' does not include any area in which smoking is prohibited by State law, thereby precluding the City of Rancho Cucamonga from regulating smoking in that area." Section 8.21.130 (Smoking prohibited-Retail Stores) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to read: "8.21.130 Smoking prohibited-Retail stores. Smoking is prohibited and is unlawful within all areas of all indoor retail stores." Section 6. Section 8.21.140 (Smoking prohibited-Banks and other financial institutions) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to read: "8.21.140 Smoking prohibited-Banks and other financial institutions. Smoking is prohibited and is unlawful within all areas of banks and financial institutions." Section 7. Section 8.21.150 (Smoking prohibited-Public buildings and structures) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to read: "8.21.150 Smoking prohibited-public buildings and structures. Smoking is prohibited and is unlawful within all areas of all public buildings and structures." Section 8. Section 8.21.160 (Smoking prohibited-Posting of signs required) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to read: " 8.21.160 Posting of signs required. Except as otherwise provided herein, wherever in this chapter smoking is prohibited, signs containing all capital letters not less than one inch in height and containing at least the words, "Smoking Prohibited," or the international "No Smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) on a contrasting background, shall be clearly, conspicuously and sufficiently posted such that the manner and quantity of posting is reasonably likely to inform individuals occupying such room, building or other place that smoking is prohibited. It is the duty of the owner, operator, manager, or other person having control of such room, building or other place where smoking is prohibited, to post such signs or cause such signs to be posted, and maintain such signs in good condition." Section 9: Section 8.21.180 (Penalties) of Chapter 8.21 (Smoking Regulated or Prohibited) of Title 8 (Health and Safety) of the Rancho Cucamonga Municipal Code is hereby amended to read: "8.21.180 Penalties. A. It is unlawful to fail to post the signs required by this chapter, or to willfully mutilate or destroy any signs required by this chapter. B. It is unlawful for any person to smoke in any area posted as a nonsmoking area. C. It is unlawful for any person who owns, operates, manages, or otherwise controls the use of any premises subject to regulation under this chapter to fail to comply with any provisions of this chapter, or to permit or allow any other person to smoke in any area posted as a nonsmoking area. D. It is unlawful for any person, firm, partnership or corporation to violate any provision or fail to comply with any of the requirements of this chapter. Any person, firm, partnership or corporation violating any provision of this chapter or failing to comply with any of its requirements shall be deemed guilty of an infraction and upon conviction thereof shall be punishable as follows: 1. A fine not exceeding one hundred dollars for a first violation; 2. A fine not exceeding two hundred dollars for a second violation of the same ordinance within one year; 3. A fine not exceeding five hundred dollars for each additional violation of the same ordinance within one year. E. Every such person, firm, partnership or corporation shall be deemed guilty of a separate offense for each and every day or any portion thereof during which any violation of any of the provisions of this chapter is committed, continued or permitted by such person, firm, partnership or corporation and shall be deemed punishable thereof as provided in this chapter. F. A violation of any provision of this chapter is an infraction, which is punishable as provided in Section 1.12.030 of this code." Section 10. If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections hereof. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, clause and phrase hereof irrespective of the fact that any one or more other sections, subsections, clauses or phrases be declared invalid. Villenas rCt cityofrc.us ATTACHMENT C Draft Smoke-Free Recognition- Program Summary Sheet CITY OF RANCHO CUCAMONGA CITY MANAGER'S OFFICE SMOKE-FREE RECOGNITION PROGRAM Apartments, Hotels, and Businesses DRAFT PURPOSE: Identify and recognize Rancho Cucamonga apartment communities, hotels, and other businesses that have taken substantial steps to create asmoke- free environment. The program is intended to encourage others to join in adopting similar smoke-free policies on a voluntary basis. INCENTIVES: Eligible businesses will receive the distinction of being a designated Healthy RC smoke-free Partner. Incentives include recognition at a City Council meeting, on City publications, and on the Healthy RC website at www.healthvrc.info. Materials declaring their "smoke-free" designation will be provided to display in the apartment community clubhouse, rental office, hotel lobby, or business entrance. CRITERIA: Businesses will enact a voluntary no-smoking policy that significantly reduces the exposure of secondhand smoke for a majority of its residents, patrons, or employees. Smoke-free policies must address smoking in public areas where the public and employees are commonly exposed to secondhand smoke such as entryways, pedestrian paths, outdoor dining areas, courtyards, and pool areas. Apartment's communities must establish a minimum of 50% smoke-free units. Participants will be required to conspicuously post and maintain no-smoking signs in areas where smoking is prohibited ADMINISTRATION: The Healthy RC smoke-free recognition program will be administered through the City Manager's Office as part of the Healthy RC initiative.
