2 dwelling units per acre) West - Very Low Residential District (1 - 2 dwelling units per acre) D Site Characteristics The site is located at the southwest corner of Haven Avenue and Vista Grove Street and has a total area of 8 86 acres Locator and Aerial Maps are included as Exhibits A and B The Hillside Community Church property is currently developed with a 7,700 square foot multi-purpose building (Family Center), modular Sunday school classrooms, Activity Pavilion, fields, and parking areas The church is in the process of constructing a new 76,019 square foot worship center and a parking structure that was ITEM A PLANNING COMMISSION STAFF REPORT UPDATE ON ISSUES REGARDING HILLSIDE COMMUNITY CHURCH April 25, 2007 • Page 2 approved by Development Review DRC2004-01019, Variance DRC2005-00321, Variance DRC2005-00322, and Variance DRC2005-00323 in July 2005 The area surrounding the church is developed with single-family residences E Background for the Update Request On March 28, 2007, a resident spoke during public comment and raised issues with the approved development at the church Planning Department staff placed a report item on the April 11, 2007 Planning Commission meeting agenda for a status report of the City's efforts to address the concerns of neighbors surrounding the church The item was continued from the April 11, 2007 Planning Commission meeting During the April 11, 2007 Planning Commission meeting, the Planning Department staff requested a continuance of the item to provide adequate time for review of the issues and for the preparation of a report to respond to the issues included on two separate lists provided by the resident adjacent to Hillside Community Church on April 4, 2007 ANALYSIS A Development of Hillside Community Church The Planning Commission approved Conditional Use Permit 82-29, which approved the church use along with regular team sport activities and the parking of vehicles on the field on February 9, 1983 On September 28, 1988, Conditional Use permit 88-10 was approved along with a Master Plan for the architectural design of the sanctuary The Master Plan that was approved in 1988 contemplated the intensification of the church, which anticipated the site would include a sanctuary, administration building, education/nursery building, and family center During the review of Conditional Use Permit 88-10 and the Master Plan, it was found that the two Conditional Use Permits (Conditional Use Permit 82-29 and Conditional Use Permit 88-10) were compatible The City approved the conceptual development of the church site prior to the development of the majority of the nearby residential uses Although the church completed its first permanent Family Center building in 1994, the approved Master Plan for the property anticipated the current expansion of Hillside Community Church During the review of Development Review DRC2004-01019, Variance DRC2005-00321, Variance DRC2005-00322, and Variance 2005-00323 m July of 2005 for the construction of the 76,019 square foot worship center and 101 stall parking structure, a total of four neighborhood meetings were held on the following dates • January 5, 2005, • January 24, 2005, • February 1, 2005, and • April 14, 2005 The following list summarizes the issues raised at the various neighborhood meetings held m 2005 • Adequate off street parking, • Height of the sanctuary, • Noise from church activities, and • Existing drainage culvert near the southwestern corner of the property is inadequate to accommodate runoff A-2 PLANNING COMMISSION STAFF REPORT UPDATE ON ISSUES REGARDING HILLSIDE COMMUNITY CHURCH • April 25, 2007 Page 3 To alleviate the concerns brought up at the various neighborhood meetings in 2005, the architect for Hillside Community Church made modifications to the design prior to bringing the project to the Planning Commission for approval The Planning Commission approved Development Review DRC004-01019, Variance DRC2005-00321, Variance . DRC2005.l30322, and Variance 2005-00323 with Conditions of Approval on July 27, 2005 See Exhibits C and D for the approved site and landscaping plans Although the aforementioned project was approved on July 27, 2005, the church is currently in the construction phase B Recent Inquiry and Public Comment Regarding Hillside Community Church During the March 28, 2007 Planning Commission meeting, public comment was received by a resident who resides adJacent to Hillside Community Church The resident stated at the Planning Commission meeting that the recent activities at Hillside Community Church created adverse impacts During the meeting on March 28, 2007, the Planning Commission requested that this resident provide a list of the issues On April 4, 2007, the resident provided the Planning Department with two separate lists of concerns, which are attached as Exhibits E and F Also, attached is Resolution 05-60 as Exhibit G, which is referenced m the lists, provided by the resident The following is a summary of the issues provided by the resident on the two separate lists (Exhibits E & F) along with staff's response Exhibit E (Lisf 11 The neighbors around & near H~lls~de Community Church_ alleged • v-olat~ons and rssue for review/revrs~ng HCC's CUP • Issue #1. Citation to Section B 5 of Resolution 05-60 (Planning Department Condition Number 6) regarding the field According to the resident, the Condition states that field parking shall be utilized commencing with the issuance of the Certificate of Occupancy of the sanctuary The church has been utilizing the field for at least two years for parking, therefore, they have utilized the fields prior to the issuance of the Certificate of Occupancy Staff Response to Issue #1 • Conditional Use Permit 82-29 approved parking of vehicles on the field, provided that the fields were compacted The fields were graded and constructed to 95% compaction of sub-grade materials during construction to specifically support automobile traffic Hillside Community Church obtained approval to utilize the fields for parking since 1983 and anticipates the future use of these fields, therefore, the church is anticipating continuing the use of the fields for parking after the sanctuary has been completed The City developed Condition Number 6 to require the church to continue utilizing the fields for parking after the completion of the sanctuary It is anticipated that the church will be at full occupancy after the completion of the sanctuary, therefore, requiring the church to utilize the fields after the completion of the sanctuary was intended to prevent the parking of vehicles along residential areas • Issue #2- Citation to Section B 5 of Resolution 05-60 (Planning Department Condition Number 4) regarding noise The church is allowed to produce noise, 15 hours a day, which adversely impacts the property owners The resident stated that Condition Number 4 was prepared utilizing Section 17 02 120E 1 (Exhibit H) of the Development Code, which referred to private schools This Section 17 02 120E 1 of A-3 PLANNING COMMISSION STAFF REPORT UPDATE ON ISSUES REGARDING HILLSIDE COMMUNITY CHURCH April 25, 2007 Page 4 the Municipal Code with a reference to private schools was not applicable to the project Staff Response to Issue #2 According to Hillside Community Church, the field is utilized 14 weeks/year for baseball and 11 weeks/year for soccer, sln~pections of the site revealed that there has been no indicator that the church is in violation of Planning Department Condition Number 4 Planning Department staff is in the process of reviewing if it was appropriate to utilize Section 17 02 120E 1 of the Municipal Code in developing Planning Department Condition Number 4 • Issue #3• Citation to Section B 3 d of Resolution 05-60 regarding findings that the project would not be detrimental to public health or materially injurious to property in the vicinity Outdoor sporting events created public nuisances and noise issues Staff Response fo Issue #3• The field had been contemplated during the processing of the original Conditional Use Permit 82-29 in February 1983 and Conditional Use Permit 88-10 in September of 1988 The fields have been m operation for many years There have been no new operations/activities conducted on the fields See staff response to issue #2 regarding noise issues Also, a representative from the Code Enforcement Department will be present at the April 25, 2007 Planning Commission hearing to further address Issue #3, if necessary • • Issue # 4. Citation to Section B 5 of Resolution 05-60 (Planning Department • Condition Number 4) regarding noise Outdoor cheering or use of amplified noise, bullhorns, concerts, movies, recreational games, and outdoor camp outs are example of activities that are exempt from the requirement of obtaining Special Use Permits Staff Response to Issue #4. Although the field had been contemplated during the processing the original Conditional Use Permit 82-29 m February 1983 and the subsequent Conditional Use Permit 88-10 in September of 1988, the fields have been m operation for many years, the Planning entitlements and Planning Department Condition Number 4 accommodated the existing uses on the site There have not been any new unapproved activities on site, hence, no intensification of the use has occurred at the fields Issue #5 Citation to Section B 2 h of Resolution 05-60 regarding parking Concerned if long-term parking will be available at Chaffey Community College Staff Response fo Issue #5. 1,500-seat sanctuary that `- ~' was ori~irially approved The current proposal, as all previously approved proposals, includes the use of the lower (south) ball field for parking This ball field was constructed and compacted to accommodate vehicles The two portable buildings that function as Sunday school classrooms will be removed with the construction of the new sanctuary Also proposed is a bi-level parking structure that will provide 101 parking stalls The parking structure has been designed to maximize the use of the grades on the site, with the first level being underground and built into an existing slope The second level will take access from the north parking lot The parking structure has been designed to blend with the proposed sanctuary and the existing Family Center buildings, utilizing a river rock base on the south and west elevations Landscape slopes buttressed by a keystone retaining wall surround the three exposed sides (west, south, and east elevations) of the parking structure • e The applicant conducted four neighborhood meetings to inform the surrounding neighborhood residents of the proposed protect and to obtain their feedback Residents from the surrounding area attended the meetings and provided design suggestions that improved the protect and minimized the impact of the sanctuary building As result of the neighborhood meetings, the applicant made changes to the sanctuary height, building pad elevation, and modified the protect to include a bi-level parking structure and the installation of the 6-foot high sound wall at the south property line, and . f The sanctuary will have a seating capacity of 1,400 persons In 1988, Conditional Use Permit 88-10 was approved, which included a master plan fora 1,500-person sanctuary in the same location as the 1,400-person sanctuary, and g The project, together with the recommended conditions of approval, complies with all minimum development standards for the City of Rancho Cucamonga,
