A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING A NEW
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
STORMWATER PERMIT IMPLEMENTATION AGREEMENT
WITH SAN BERNARDINO COUNTY FLOOD CONTROL
DISTRICT
WHEREAS, on October 19, 1990, the City of Rancho Cucamonga became a co-
permittee with the San Bernardino County Flood Control District in National Pollutant Discharge
Elimination System (NPDES) Stormwater Permit No. CA8000200 (now CAS618036); and
WHEREAS, on May 5, 1992, the City Council approved Implementation Agreement No.
92-315 (CO 92-032)to fund the Federally mandated NPDES Stormwater Program; and
WHEREAS, on June 21, 1995, the NPDES co-permittee representatives approved the
revision of the formula utilized to calculate each co-permittee's cost-share percentage for costs
associated with the area-wide NPDES Stormwater Program; and
WHEREAS, on November 15, 1995, the City Council approved Amendment No. 1 to the
Implementation Agreement No. 92-315 (CO 92-032) revising the cost-share formula used to
calculate co-permittee's cost-share percentage; and
WHEREAS, on February 21, 2007, the NPDES co-permittee representatives approved a
new NPDES Implementation Agreement, which includes a revision of the formula utilized to
calculate each co-permittee's cost-share percentage for costs associated with the area-wide
NPDES Stormwater Program. After extensive review by the co-permittee's legal counsel, the
updated Implementation Agreement was finalized in June 2010; and
WHEREAS, The Implementation Agreement requires formal approval from each of the
co-permittee's governing body.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Rancho
Cucamonga approves a new NPDES Stormwater Permit Implementation Agreement replacing
NPDES Stormwater Implementation Agreement No. 92-315 (CO 92-032).
BE IT FURTHER RESOLVED, that the City Manager is hereby authorized and
empowered to execute, in the name of the City, all necessary documents to implement and
carry out the purposes of this Resolution.
