COMMUNICATION FROIN THE PUBLIC: This is the time and place for the general public to address the City Council on any item listed on the agenda. State law prohibits the Council from addressing any issue not previously included on the Agenda. The Council may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individuals desiring to speak. All communications are to be addressed directly to the City Council, not to the members of the audience. This is a professional business meeting and courtesy and decorum are expected. Medina, Management Analyst II/Emergency Management Program Subject: December 2011 Wind Storm-Local Emergency Proclamation Amendment Recommendation Recommendation that specific language requesting the California Disaster Assistance Act (CDAA) as well as all applicable Federal Assistance be added to the recent Local Emergency Proclamation from the December 2011 Wind Storm Event in the City of Rancho Cucamonga as follows: "And that the California Disaster Assistance Act (CDAA) and all applicable Federal Assistance be enacted to assist in the disaster recovery process." Background Upon further review of the Local Emergency Proclamation created on December 9`h, 2011 for the severe wind storm event that occurred in the City of Rancho Cucamonga, it was determined that not all specific disaster assistance was requested from the State of California. The addition of this language will enable the City to have all State and Federal funding streams considered with regard to disaster recovery from this incident. xANCHU CUCAMONGA CALIFORNIA Proclamation PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY WHEREAS, the Director of Emergency Services does hereby find: 'that conditions of extreme peril to safety and property has arisen within the City of Rancho Cucamonga, caused by an extreme wind storm event that initially occurred on Wednesday, November 30, 201 l; impacted the northwest portion of the City to include all areas north of the ? l0 Freeway, east ol'Haven and included the communities of Victoria and Terra Vista; resulted in the loss of approximately 500 eucalyptus, pine, sycamore, oak, crepe tnyrtle, jacaranda and other various species of tree; resulted in extensive damage to public sidewalks, irrigation systems, fencing, and block walls throughout the City; caused the loss of power for approximately 24 hours to portions of the City; resulted in the execution of over X50 calls for service; required the entire workforce of the Public Works Department to manage the sustained operation; necessitated the activation of the Public Works Department Operations Center as well as the City's Emergency Operations Center, and will require an extensive period of clean up before areas can be returned to normal function That the aforesaid conditions of extreme peril warrant and necessitate the proclamation of the existence of a local emergency; and That the City Council of the City of Rancho Cucamonga is not in session and cannot immediately be called into session: NOW, TIEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exis~s through the City; and [T 15 FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers and duties of 161te emergency organization of the City shall be those prescribed by State law, by ordinances and resolutions of this City, and by the current City of Rancho Cucamonga Emergency Operations Plan, as approved by the City Council. IT IS FURTHER PROCLAIMED AND ORDERED that said local erncrgencysliall be deemed to continue to exist until its tcrrnination is proclaimed by the City Council or it is terminated by operation of law. WHEREAS, it has now been found that local resources alone are unable to cope with the effects of said cmcreency: NOW, THEREFORE, IT IS FURTHER HEREBY PROCLAIMED AND ORDERED that a copyofthis proclamation be forwarded to the Governor of the State of California with the request that Ire proclaim that a State of Emergency exists; and that the California Disaster Assistance Act (CDAA) and all applicable Federal Assistance be enacted to assist in the disaster recovery process. IT IS HEREBY ORDERED that a copy of this proclamation be forwarded to the State Director of the California Emergency Management Agency. Gillison City Manager RESOLUTION NO. 11-180 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY UNDER GOVERNMENT CODE SECTION 8630 AND RANCHO CUCAMONGA MUNICIPAL CODE SECTION 2.36 WHEREAS, Government Code Section 8630 authorizes the City Council to proclaim the existence of a "local emergency" and, WHEREAS, Government Code Section 8558(c) defines a "local emergency' to include "conditions of disaster of extreme peril to the safety of persons and property within the territorial limits of a City which are beyond the control of the services, personnel, equipment and facilities of the City;" and, WHEREAS, an extreme wind storm event initially occurred on November 30, 2011 causing the Director of Emergency Services of the City of Rancho Cucamonga, California to declare conditions to extreme peril to safety and property, and, WHEREAS, the wind storm event impacted the northwest portion of the City to include all areas north of the 210 Freeway, east of Haven and included the communities of Victoria and Terra Vista. The wind storm resulted in the loss of approximately 500 eucalyptus, pine, sycamore, oak, crepe myrtle, jacaranda and other various species of trees and resulted in extensive damage to public sidewalks, irrigation systems, fencing and block walls throughout the City; and, WHEREAS, the wind storm event resulted in the loss of power in the City of Rancho Cucamonga for approximately 24 hours to potions of the City and resulted in the execution of over 350 calls for service. The wind storm event required the entire workforce of the Public Works Department Operations Center as well as the Emergency Operations Center. The conditions described above are beyond the normal capabilities and control of the services, personnel, equipment and facilities of the City of Rancho Cucamonga, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, County of San Bernardino, State of California, in emergency session assembled on December 14, 2011, that this Council hereby Finds and Declares to exist a state of local emergency in the City of Rancho Cucamonga. BE IT FURTHER RESOLVED that the City Clerk shall forward a copy of this resolution to the Governor, to the State Office of Emergency Services, to the San Bernardino County Emergency Services Division, and to all other appropriate state and federal agencies with an interest therein. BE IT FURTHER RESOLVED AND ORDERED that all City officials and employees cooperate and coordinate efforts with officials and employees of other political subdivisions and officials and employees of the state and federal government in bringing the present condition of local emergency and disaster under control. BE IT FURTHER RESOLVED AND ORDERED that the City Manager is in charge of directing City efforts during this emergency and that all City officials and employees cooperate with this person in bringing this emergency and disaster under control. BE IT FURTHER RESOLVED AND ORDERED that the City Manager is hereby designated as the authorized representative of the City of Rancho Cucamonga for the purpose of receipt, processing and coordination of all inquiries and requirements necessary to obtain available state and federal assistance.
