HomeMy WebLinkAbout07-044 - Resolutions RESOLUTION NO. 07-044 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT SAID LOT A MORE PARTICULARLY DESCRIBED HEREIN, TO BE UNNECESSARY AND RESTRICTIVE, AND AUTHORIZING AND DIRECTING THE CITY ENGINEER TO EXECUTE THOSE CERTAIN QUITCLAIM DEEDS, COPIES OF WHICH ARE ATTACHED HERETO AS EXHIBIT "A", AND TO CAUSE THE SAME TO BE RECORDED WHEREAS, the excess street easement of La Grande Street at Cameo Street Tract No. 6518, applicable to Lots 93 and 94 of said tract, was determined to be unnecessary and restrictive in nature; and WHEREAS, the Planning Commission of the City of Rancho Cucamonga heretofore made the findings on October 25, 2006, that authorizing the vacation of vehicular access rights would be in conformity with the General Plan of the City of Rancho Cucamonga; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council of the City of Rancho Cucamonga hereby • quitclaims said Lot A excess street easement applicable to Lots 93 and 94 of Tract No. 6518, on file in the office of the City Clerk of the City of Rancho Cucamonga, which has been further described in a legal description which is attached hereto, Marked Exhibit "A", and by reference made a part thereof. SECTION 2: That from and after the date the resolution is recorded, said street easement no longer constitutes a public easement. SECTION 3: That the subject quitclaim shall be subject to the reservation and exceptions for existing utilities of record, including but not limited to City of Rancho Cucamonga drainage easement. SECTION 4: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California. SECTION 5: That the City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force. SECTION 6: The City Engineer is hereby authorized and directed to execute the quitclaim deeds, a full, true and correct copy of which is attached hereto, and cause the same to be recorded forthwith upon adoption of this Resolution. • Please see the following page for formal adoption,certification and signatures Resolution No. 07-044 Page 2 of 8 • The City Clerk shall certify to the adoption of this Resolution.
