HomeMy WebLinkAbout12-193 - Resolutions RESOLUTION NO. 12-193 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DIRECTING STAFF TO USE THE CALIFORNIA AIR RESOURCE BOARD ALLOWANCE REVENUE SOLELY TO BENEFIT ITS RETAIL ELECTRICITY CUSTOMERS WHEREAS, the California Air Resources Board ("ARB") implemented the California Cap-and-Trade Program in which an Allowance is a limited tradable authorization to emit up to one metric ton of greenhouse gases; WHEREAS, Rancho Cucamonga Municipal Utility ("RCMU") is an Electric Distribution Utility as defined in ARB's regulations, and shall receive a direct allocation of Allowances for each vintage year from 2013 until 2020 in an amount that is prescribed in the ARB regulations; WHEREAS, RCMU is required to consign these Allowances to ARB's Allowance auction for the respective vintage; WHEREAS, RCMU shall receive the revenue when its Allowances are sold in the auction; WHEREAS, subject to any limitations imposed by the City Council, RCMU is required to use the Allowance revenue solely to benefit its retail electricity customers in a manner consistent with the Global Warming Solutions Act of 2006 ("AB 32"); WHEREAS, Senate Bill 2 (1X) established the California Renewable Portfolio Standard which requires RCMU, subject to certain exemptions, to implement minimum targets for procuring eligible renewable resources as a percentage of total kWh sold to RCMU's retail electricity customers; WHEREAS, the ARB Scoping Plan provides policy guidance for the implementation of AB 32 by local governments using a comprehensive local approach, among other things, by increasing the amount of eligible renewable resources procured by a municipal utility to serve its retail electricity customers, and by a municipal utility increasing its energy efficiency programs; WHEREAS, the Rancho Cucamonga Utilities Division Manager is authorized to do all things necessary and proper for operating RCMU. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. RCMU shall establish an Allowance Revenue Account for the purpose of holding, tracking, and disbursing all revenues received by RCMU from the sale of its Allowances in the California Cap-and-Trade Program auction. Section 2. The City Manager, or his/her duly authorized designee, is directed to use the Allowance revenue to procure eligible renewable resources to serve RCMU's retail electricity customers. Section 3. The City Manager, or his/her duly authorized designee is directed to establish a program to ensure that funds from the Allowance Revenue Account benefit the RCMU retail electricity customers, and to communicate this program to all RCMU retail electricity customers. Section 4. Except for matters specifically reserved under the Cap-and-Trade program for action by the City Council, as governing board of the City, the City Manager or his/her duly authorized designee is authorized and directed to do and perform all acts required to implement a Cap-and-Trade Program to fulfill obligations pertaining to the City under AB 32. Section 5. The City Clerk shall certify to the adoption of this Resolution. Section 6. This Resolution shall take effect immediately upon its adoption.
