HomeMy WebLinkAbout12-196 - Resolutions RESOLUTION NO. 12-196 A RESOLUTION OF THE CITY COUNCIL OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING AN UPDATED FEE SCHEDULE FOR APPLICABLE TO COMMUNITY DEVELOPMENT AND OTHER VARIOUS MUNICIPAL SERVICES, AMENDING RESOLUTION NO. 06-032 AND REPEALING RESOLUTIONS 04-293, 06-283 AND 12-101. A. Recitals. 1. The California Government Code allows the City to establish fees and charges for municipal services, provided such fees and charges do not exceed the estimated reasonable cost to the City in providing the service to which the fee or charge applies. 2. Data indicating the estimated or actual cost to provide each service, for which the fees and charges set forth herein apply, was made available to the public at least ten (10) days prior to the date of the public hearing. 3. On December 19, 2012, City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the amendment. 4. All legal prerequisites prior to the adoption of this Ordinance have occurred. B. Resolution. The City Council of the City of Rancho Cucamonga finds and resolves as follows: SECTION 1: The City Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. SECTION 2: The City Council hereby specifically finds that the fees and charges set forth in Sections 3, 4, 5 and 6 for do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied. SECTION 3: The City hereby adopts the following fees for photocopy services. Copy Type Copy Charge Black and White, all standard sizes $0.10 per page Color, all standard sizes $0.23 per page SECTION 4: The City Council hereby adopts the following fees for services performed by the Building and Safety Department, including a technology fee of 4.5%. repeals Resolutions 04-293, 06-283 and 12-101 which previously set fees for the Building and Safety and Planning Departments effective 60 days from the effective date of this Resolution. SECTION 8: The fees set forth in section 3 of this Resolution shall take immediate effect. SECTION 9: Subject to the provisions of Section 10, in accordance with California Government Code Section 66017, those fees and charges set forth in Sections 4, 5 and 6, that constitute "a fee or charge...upon a development project...which applies to the filing, accepting, reviewing, approving, or issuing of an application, permit, or entitlement to use" shall become effective and payable sixty (60) days from the date of adoption of this Resolution. SECTION 10: Each fee set forth in Sections 4 and 5 shall be adjusted annually, commencing on July 1, 2014, and each year thereafter, without further action of the City Council, based on the Employee Cost Index for State and Local Government Employees, Total Compensation, during the 12 month period ending on December 31st of the immediately preceding year, as released by the U.S. Department of Labor's Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the City Council, shall be utilized.
