The site has been cleared of all vegetation, graded, and phase one completed with 2 office buildings at the northwest corner of 26th Street and Haven Avenue. The phase one improvements also included • landscaping all frontages of the project. General: The overall Project is within the Haven Avenue Office Overlay zone and the design is in conformance.with the Office Campus environment provided for under the Industrial Specific Plan. As previously approved the Project has 3 Office Complex areas composed of a 3 story office building on the corner of Arrow Route and Haven Avenue, 2-3 story buildings at • the corner of Haven Avenue and 26th Street (currently completed), and a 6 building, 1 story complex at the rear center of the site. Each of the 3 office areas have a rich plaza treatment area, and in addition the site has a strong architectural statement at the Haven driveway entrance with flanking Center Monument Identification signs designed with integrated pedestrian trellis and column elements that match the building architecture. Additional amenities include a vineyard planting, specimen size trees (Haven Avenue and Arrow Route intersection), seating walls (26th and Haven Plaza area), and a water element (central single story. complex plaza area). There is also an attractive sign program that was previously approved as part of the development package. The current application would further divide the property by creating 2 additional parcels, one for each of the completed office buildings and the required parking for each. B. Design, Grading, and Technical Review Committees: Staff determined that as there will be no changes to the architecture of the buildings, site grading, or impact on public improvements, no further review by the Committees is necessary. C. Environmental Assessment: The Planning Department staff has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301 Existing Facilities as no additional construction beyond what has already been reviewed and approved is proposed or necessary. Medical denotes that the Office Space is parked at the allowance of 5 spaces per thousand • square feet but it may be used by general office as well. Fact: That the tentative parcel map for 2 parcels is consistent with the General Plan, Development Code, and Industrial Specific Plan; and 2. Fact: The design or improvements conditioned and designed as part of the of the tentative parcel map is consistent with the Industrial Park/Haven Avenue Office Overlay requirements of the General Plan, Development Code, and Industrial Specific Plan; and 3. Fact: The site is relatively flat with street access on 3 sides and infrastructure reasonably available demonstrating that the subdivision is physically suitable for the type of development proposed; and 4. Fact: The site is developed with 2 office buildings and parking is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and 5. Fact: The tentative parcel map is designed to allow for an existing office project, which will meet all applicable City requirements and therefore is not likely to cause serious public health problems; and 6. Fact: The information submitted with the design of the tentative parcel map • demonstrates there will not be a conflict with any easement acquired by the public at large, now of record, for access through, or use of the property within the proposed subdivision. CORRESPONDENCE: This item was advertised as a public hearing in the Inland Valley Daily Bulletin newspaper, the property was posted, and notices were mailed to all property owners within a 660-foot radius of the project site. I t tlt1 !g!t a o - 8 8 0 • RESOLUTION NO. 09-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP SUBTPM19179 - HILLWOOD INVESTMENTS - FOR A 2-LOT PARCEL MAP FOR A PORTION OF AN EXISTING OFFICE PROJECT, LOCATED AT THE NORTHWEST CORNER OF HAVEN AVENUE AND 26TH STREET - APN: 0209-092-07, 08 & 09. A. Recitals. 1. Hillwood Investment Properties filed an application for the approval of Tentative Parcel Map No. 19179, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map request is referred to as "the application." 2. On the 10th day of June 2009, the Planning Commission of the City. of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: • 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to 'this Commission during the above-referenced public hearing on June 10, 2009, including written and oral staff reports,together with public testimony, this Commission hereby specifically finds as follows: a. The, application applies to the property located on the Northwest corner of Haven Avenue, and 26th Street with a street frontage of 588.26 feet on Haven Avenue and of 551.60 feet on 26th Street and is presently improved; and b. The property to the north of the subject site is two-story apartment buildings and a vacant abandoned vineyard across Arrow Route zoned Medium-High and Industrial Park/Haven Office Overlay, the property to the south consists of "HCS Cutler," which is an industrial and commercial supply business zoned Industrial Park/Haven Office Overlay, the property to the east, across from Haven Avenue is an Office Business Park use zoned Industrial Park/Haven Office Overlay, and the property to the west is triplexes and single-family detached residential under construction, zoned Low-Medium Residential. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: • a. Based upon the facts and information contained herein,together with all written and oral reports included for the environmental assessment for the application, the Planning Commission finds that there the Planning Department staff has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's • CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301 Existing Facilities as no additional construction beyond what has already been reviewed and approved is proposed or necessary. 5 Based upon the findings and conclusions set forth in paragraphs 1, 2,and 3,above,this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Department 1) Adequate provision shall be made and continue in perpetuity to assure that access and maintenance between all parcels established under Tract 16909 and DRC2006-00557 will be provided. Engineering Department • 1) Per City of Rancho Cucamonga Municipal Code, all parcel maps shall be surveyed and confirmed by "meets and bounds" measurements (RCMC Chapter 16.22.020). 2) Show all rights of vehicular ingress and egress, easements for sidewalk, municipal utility, service and emergency access purposes dedicated to the City of Rancho Cucamonga on Tract Map No. 16909. • 3) Show all the private easements for reciprocal ingress and egress • purposes between and over all lots as previously reserved on Tract Map No. 16909. I was off from work for the week of the 15-19th expecting company. At about 10:04AM I was in bed watching TV and I was startled with the sounds of Sirens, Screaming, Yelling, Clapping, Voices of adults on microphones and or megaphones. I opened my bedroom window the noise was shattering. I could tell the noise was coming from Hillside Community Church. I went downstairs. When I opened the door it was so loud I can't even describe the volume. It sounded like they were in the parking structure. I could not believe they were using microphones and maybe megaphones inside the parking structure with what sounded like a hundred or more children. As we all know parking structures echo then add amplified noise. It was unbearable. I called the church and spoke to Elaine. I told her the noise was excessive and they need to stop making so much noise. She said "You don't understand were having a program" I told her you don't understand you are breaking the noise laws. You guys can't be that loud. I told her if the noise continued I would have to call the police. She said she would speak to someone about the noise and see what they could do... But then she repeated that they were having a program.That told me they had no intention to quiet down. That what they were doing was more important than any thing else. , About 5 minutes later the noise was just as bad or worse than earlier. So called the police. Deputy Guevara came to my house when I opened the door he said " man it sounds like I am in the middle of a stadium." When he arrived the noise was still bad but much less than when I called. I told him this is a residential neighborhood we should not have to put up with this kind of noise. I explained problems in the past with the church and noise. I also told him that they tell any officer that goes over that they have their CUP and they can make as much noise as they want. He said he would go to the city first and find out about their CUP... but he also said that no matter what CUP or not they could not break the noise laws and there was no doubt all noise laws were being broken. I asked if he could go over and speak to them. He went to the city and then to the church. When he came back to my house he said I am sure glad you told me they would use the CUP line, because that was the first words out of their mouths. He said he explained to the pastor that the noise was excessive and they could not break the noise laws even with their CUP. They told him they would try not make so much noise tomorrow. I also called James Troyer explaining the noise problem. Later that day he called me back and said he had called Hillside Community Church. They told him they would not.use microphones in the parking structure tomorrow. That didn't give me much if any comfort. I asked James who in the world would take a bunch of kids into a parking structure that backs up right next to the neighbors homes with microphones sirens etc. and have them make that much noise? Considering all of the problems with noise and the neighbors in the past. Does no one over at that church have a bit of common sense? James said their explanation was it was raining. I asked James why couldn't they do that kind of active inside the church? We had just been through a 2 year construction mess with the church doing a major expansion. We were all told that having the larger church would help with the noise issues....So my question is why were they inside the parking structure that backs right up to our homes making that amount of noise? Why were they not inside the new church facilities? Was the amount of noise to bothersome to them? So was their answer to put them outside in the parking structure next to the neighbors? This indicates to me that all of the meetings, complaints and problems about the noise did not mean a thing to the church. It is back to business as usual. Not caring about the neighborhood they are in. Only caring about what they want to do and the money they can make from their programs. They use their CUP as free pass to break the law. By them using the parking structure for a extremely loud program with amplified noise and thinking that was OK to disrupt the entire neighborhood, this indicates they do not care about anyone except the church and what the church wants. They have no concern or regard for the neighbors. SO THESE ARE MY QUESTIONS Why do they think their CUP gives them the right to terrorize the entire neighborhood with their excessive noise? Why can't Hillside Community Church be good neighbors? Why do they continue to break the law with excessive noise and nothing happens to them? How can we be assured that the next time they have a program that they will not use the parking structure for a amplified sound stage yet again? Where are the neighbors rights to live in a peaceful environment? These are problems that need to be address again. So the reason I am here is to ask what can be done to eliminate the part of their CUP that allows them to use amplified noise outdoors and to force the church to use the parking structure for what is was designed for. PARKING and parking only, not church programs.
