Troyer, AICP, Planning Director BY: Mayuko Nakajima, Assistant Planner SUBJECT: NOTIFICATION OF RED-TAGGED CONDITION OF STRUCTURES LOCATED AT 10241 WILSON AVENUE - APN: 0201-182-07. The review is in response to the unsafe condition of the structures. PROJECT AND SITE DESCRIPTION: A. Background: The property located at 10241 Wilson Avenue is currently developed with three small structures. These structures have been deemed unsafe to occupy, and the property owner was sent a "Notice & Order" letter from the Building Official on April 8, 2010 (Exhibit A). The matter had been brought to the attention of the Planning Department staff by Code Enforcement who sent the applicant several letters regarding the current condition of the home and its violation of basic Code requirements. Staff from the Planning Department, Building and Safety Department, and Code Enforcement performed a site inspection with the property owners. The Building Inspector confirmed that the structures are severely deteriorated. The wood is dry-rotted and has evidence of termite damage. The roof members • are severely stressed and the roof is nearly to the point of collapse. If the property owner chooses to prepare a repair plan, the structures would have to be almost completely rebuilt. The house is currently listed as "Survey Undetermined Significance (SUS)" in the "Designated & Potential Historic Site List." Staff has been researching the structures to determine their significance. The Historic Preservation Ordinance (Section 2.24.150) provides a provision that the Building Official may issue the appropriate measures when necessary, to either correct or demolish the unsafe or dangerous conditions of a site or building. This measure (Demolition Permit) may be authorized prior to the Commission's review, if necessary, of any property that is not landmarked. Based on the determination of the Building Official, the structures were deemed unsafe; therefore, this report is given for informational purposes only. B. Site Characteristics: The subject site is located on the south side of Wilson Avenue, and east of Hermosa Avenue. The site is about an acre in size and is zoned Low Residential. The surrounding properties are zoned Low Residential to the south, east, and west. The land to the north is zoned Very Low Residential. There are three small structures on the site, which were used as a single-family home and outbuildings/accessory structures. ANALYSIS: A. Architectural Description: The existing structures on the site are single-story, Bungalow style with gabled roofing, wood frame and siding, and a river rock foundation. The structures are set back from the street within dense landscaping and are not immediately visible from the street. • Item A HISTORIC PRESERVATION COMMISSION STAFF REPORT 10241 WILSON AVENUE May 12, 2010 Page 2 • B. Historic Significance: Information and history regarding the structure is very limited. Staff contacted both the Ontario City Library and the Etiwanda Historical Society for information on the site. This area is not listed in any of the older City directories, nor is it mapped on any of the old Sanborn maps. However, a 1959 aerial reveals that the immediate setting is almost entirely agricultural and the property likely contained housing for persons working in surrounding agricultural production (Exhibit B). Based on the Bungalow style architecture and the era in which agriculture production was booming, we presume the house to be built • around the 1920's. We also consulted with Chattel Architecture, the historic preservation consultants that surveyed our City as part of the 2010 General Plan Update. Their determination of the historic significance of the property was a "5S3," which means it "appears to be individually eligible for local listing or designation through survey evaluation." They reasoned that although the property is in deteriorated condition, it received a 5S3 because it retains a high level of architectural integrity. C. Correspondence: When staff, Code Enforcement, and Building and Safety met with the property owner in February of 2010 to discuss options for these Code violations, the owner expressed concern with the condition of the property and the inability to address all of the outstanding violations. A neighbor informed staff that the woman that lived here previous to the current property owner passed away in the house 20 years ago and the house has been vacant ever since. The neighbor also informed staff that the woman had no children and • donated the property to one of the local colleges. Subsequently, the current property owner purchased the property from the college. CONCLUSION: Although it appears that there may be some significance regarding the structures, (it is of the age and has architectural integrity, according to our consultants) it is all that is remaining of the original site and use. There is little or no information regarding the actual structures. No other information regarding the dwelling unit or site was available. Therefore, the historic significance of this home is undetermined. Since the property is deemed "unsafe to occupy," staff was not able to enter the structures to document the floor plan or significant features, but staff will include any documentation of historical information as part of the file and will continue to add information to the file as it is discovered. Staff is currently in the process of updating the Historic Preservation Ordinance. As part of that update, language will be added to address and help prevent "Demolition by Neglect" as much as possible. The draft ordinance is currently being reviewed by the City attorney, and after the adoption of the 2010 General Plan Update, staff intends to release a draft to the stakeholders and ultimately present it to the Historic Preservation Commission for review. Environmental Assessment: The Planning Department has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA A-2 l HISTORIC PRESERVATION COMMISSION STAFF REPORT 10241 WILSON AVENUE • May 12, 2010 Page 3 Guidelines Section 15301(1) (1&4) (Demolition and removal of individual small structures) because the units are defined as small structures, and there is no substantial evidence that the project may have significant effect on the environment. RECOMMENDATION: Staff recommends that the Historic Preservation Commission receive the Staff Report and file for future reference.
