A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF RANCHO CUCAMONGA
APPOINTING THE INTERIM CITY ATTORNEY
{AREAS, the City of Rancho Cucamonga was incorporated
on November 22, 1977, as a general law city of the State of
Callfornias and
WHERPAS, it is necessary for the efficient operation
of the affairs of the City that the City Council appoint an
Interim City Attorneys
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. Samuel Crows of the law firm of Covington 6
Crowe is hercEy nppointed as Interim City Attorney to serve at
the pleasure of the City Council.
Section 2. Robert E. Dougherty and Edward A. Hopson
of the law T rimes- Covington s Crows are hereby appointed as
Assistants to the Interim City Attorney to serve at the pleasure
of the Interim City Attorney and the City Council.
Section .t. The Interim City Attorney shall receive
as compensates- legal services randered the a,= of $1,500.60
per month for attendance at all regular Council and Planning
Commission meetings, and up to eight (8) hours of additional time
on a weekly basis and for such additional services as are
desired by the city Council the Interim City Attorney shall
receive a foe in the sum of $50.00 per hour.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA ADOPTING
THE SAN BERNARDINO COUNTY CODE AND OTHER RELEVANT NON -
CODIFIED SAN BERNARDINO COUNTY ORDINANCES AS CITY
ORDINANCES FOR A PERIOD OF ONE HUNDRED TWENTY DAYS AND
PROVIDING FOR ITS ADOPTION AS AN URGENCY ORDINANCE
THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DOES
ORDAIN AS FOLLOWS:
Section 1. Pursuant to the provisions of Section 34328.5
of the Government Code of the Stat: ` California, All ordinances of
the County of San Bernardino, codit in the Son Bernardino County
Code, and all other ordinances of ti ounty of San Bernardino,
theretofore applicable, ate hereby adopted as ordinances of the
City of Rancho Cucamonga and shall remain in full force and affect
as City Ordinances for a period of one hundred twenty (120) Jaye
from the effective date of this ordinance, or until the City Council
Enacts ordinances vuperseding them, whichever shall first in time
occur.
Section 2. The following amendments are made to the
County of San Bernardino Ordinances referenced herein:
(a) Whenever "Board of Supervisors" or "Board" is used in
the Ordinance, it means tits Rancho Cucamonga City
Council.
(b) Whenever "County" is used in the Ordinance, it means
the geographical limits of the City of Rancho Cuca-
monga unless a different geographical area is clearly
i_.11cated by the context.
(c) Whenever "COts,ty ", "County of San Bernardino ", or
"Unincorporated Territory of the County of San
Bernardino" in used, it means the City of Rancho
Cucamonga.
Section 3. No City Ordinance enacted within one hundred
twenty (120)�ayn from the effective date of this ordinance shall he
deemed to supersede any County Ordinance referenced herein unless
the City Ordinanca spnelfically refers thereto and states an
intention to supe ^node it.
Section 4. This Ordinance is required by the provisions
of SoctiorCYT5T93 -uf the Government Cade of the State of California.
Tt,lo Ordinance is therefore necessary for the protection of public
health, welfare, and general safety and shall take effect immediately
upon itn adiption as an urgency ordinance.

All ORDINANCE OF THE CITY OF RANCHO CUCAMONGA CREATING
DAD ESTABLISHING THE OFFICE OF CITY MANAGER, DEFINING
THE DUTIES AND POWERS THEREOF AND PROVIDING COMPENSATION
THEREYOR, AND PROVIDING FOR ITS ADOPTION AS AN URGENCY
ORDINANCE
THE CITY COUNCIL OF THE CITY OF PANCEO CUCAMONGA DOES
ORDAIN AS FOLLOWS:
Section 1. Office Created. The office of the City Manager
of the City--o-f Rancho Cucamoniga s hereby created and established.
The City Manager shall be appointed by the City Council wholly on the
basis of his administrative and executive ability and qualifications
and shall hold office for and daring the plaasuro cf the City Council.
Section 2. Residence. Residenoe in the City at the time
of appointment f-a City Manager shall not, be required as a condition
of the appointment, but within one hundref. eighty (180) days after
reporting for work the City Manager must become a resident of the
City unless the City Council approves his residence outside the City.
Section 3. ��Eligqib��iM�R�. No member of the City Council
shall be ellgibl�or app�mant as City Manager until one year has
elapsed after such Council member shall have ceased to be a member
of the City Council.
Section 4. Bond. The City Manager and Acting City Mararar
shall furn_s a corporate surety bond to be approved by the City
Council in such sum as may be determined by the said City Council,
and shall be conditioned upon the faithful performance of the duties
imposed upon the City Manager and Acting City Manager, as herein
prescribed. Any premium for such bond shall be a proper charge
against the City of Rancho Cucamonga.
Section S. Acting City Mana�ar. The Assistant City Manager
shall serve as manager pro tempera during any temporary absence or
disability of the City Manager. In the event there is no Assistant
City Manager, the City Manager, by filing a written notice with the
City Clerk, shall designate a qualified city employee to exercise
the powers and perform the duties of City Manager during his temporary
absence or disability. In the event the City manager's absence or
disability extends over a two month period, the City Council may,
after the two month period, appoint an Acting City Manager.
Section 6. Com2ensation. The City Manager shall receive
such compensatlon as t e Ch ity Council shall from time to time
determine. In addition, the City Manager shall be reimbursed for
all actual and necessary expenses incurred by him in the performance
of his official duties.

On termination of employment of the City Manager by
reason of involuntary removal from service other than for willful
misconduct in office, the City Manager shall rocaive cash
reveranco pay in u lump sum equal to two months' pay for every
year of ointinuous service or fraction thereof as City Manager,
up to a total of six months' pay, such pay to be computed at tl,q
highect salary received by the City Manager during his service
with the City. Involuntary removal from service shall include
reduction in pay not applicable to all employees of the City.
Section 7. Powers and Duties. The City Manager shall
be the a n strat ve ead o e government of the City under the
direction and control of the City Councii except as otherwise providel
in this ordinance. He shall be responsible for the efficient
administration of all the affairs of the City which are under his
control. In addition to his general powers as administrative head,
and not as a limitation tnerec it shall be his duty and he shall
have the powers not forth in the following subsections.
Section 7.1 Law Enforcement. It shall be the duty of
the City Manager to enforce as aws and ordinances of the City and
to see that all franchises, contracts, permits and privileges granted
by the City Council are faithfully observed.
Section 7.2 Authority 0" E_mployeos. It shall be the
duty of the City Manager, and l eha ave the authority to control,
order and give directions to all heads of departments and to
subordinate officers and employees of the City under his jurisdiction
through their department heads.
Section 7.3 Power of Appointmont and Removal. It shall be
the duty o e C ty Manager to, and he ahafl app- - o n remove,
promote and demote any and all officers and employees of the City
of Rancho Cucamonga, except the City Attorney, City Clerl: and
Treasurer.
Section 7.4 Administrative Reorganization of Offices. It
shall be t e uty an rospor.s i_ ty o e C ty Managor o conduct
studies and effect such administrative reorganization of nffi.ces,
positions or units under h!s direction as may be indicated in the
interest of efficient, effective and economical conduct of the
City's business.
Section 7.5 Ordinances. It shall be the duty of ti,e City
Manager and-ie sh =a re':ommend to the City Council for adoption such
measures and ordinance& as he deems necessary.
Section 7.6 Attendance at Council Meetin s, it shall be
the duty o tE— f�e C ty Manager to attnn all meet nryn of the City
Council unless at hie request he is excused there°_rom by the Mayer
Individually or the City Council, except when his removal is under
consideration.

Section 7.7 Financial Ro orts. It shall be the duty of
the City FLinager to keep the Cft-yc-�ounc 1 at all times fully advised
as to the financial condition and needs of the City.
Section 7.8 Prod at. It shall be the duty of tie City
Manager to prepare and s mkt the proposed annual budget and the
proposed annual salary plan to the City Council for its approval.
Section 7.9. EEx enditure Control and Purchanin it shall

submitted or recommended to the City Council except an approval of
the City Manager or his authorized representative. The City Manager,
or his authorized representative, shall be responsible for the
purchase of all supplies for all the departments or divisions of
the City.
Section 7.10 invests ationr. and Con laints. It shall be
the duty o t e C ty Manager to make nvost gat ens nto the affairs
of the City and any department or division thereof, and any contract
or the proper performance of any obligations of the City. Further,
it shall be tiu, duty of the City Manager to investigate all complaints
in relation to matters concerning the administration of the City
government and in regard to the bervic:o maintained by public utilities
in said City.
Seccion 7.11. Public Buildings. it shall be the duty of
the City F:.�n•igcr an e a a 1 exorc ee ganeral supervision over all
puLlic buildings, public parka, and all other public property which
are under the control and jurisdiction of the City Council.
Section 7.12. Additional Du•ies. It shall be the duty of
the City Manager to perform such of er -gu—LSes and exercise such other
powers as may be delegated to him from time to time by ordinance or
resolution or other official action of the City Council.
Section 8, internal Relations.
Section 8.1. Council -Mans er Relations. The City Council
and its mem ers s a doe w t t e a m s stratrve services of the
City only through the City Manager, except for the purpose of inquiry,
and neither the City Council nor any member thereof shall give orders
or instructions to any subordinates of the City Manager. 'rhe City
Lanagor shall take his orders and instructions from the City Council
only when sitting in a duly convened meeting of the City Council
and no individual councilman shall give any orders or instructions
to the City Manager.
Section 8.2. Departmental Cooperation. It shall be the
duty of all subord sate officers and the City Clerk, City Treasurer
and City Attorney to assist the City Manager in administering the
affairs of the City cifi:icntly, economically and harmoniously.

Section 8.3. Attendrnce at Commission Meetinns. The
City lfanager or gut orized sepresontat vas may attend any and all
meetings of the Planning Commission and any other commissions,
boards or committees created by the City Council, upon his own
volition or upon direction of the City Council. At such meetings
which the City Manager attends, he shall ba heard by such commissions,
boards or committees as to all matters upon which he wishes to
address the members thereof, and he shall inform said members as to
the status of any matter being considered by the City Council, and
he shall cooperate to the fullest extent with the members of all
commissions, boards or cammnittees appointed by the City Council.
Section 9. Removal Procedure.
."section 9.1. Removal of city Manager. The removal of the
City Managilr s a e of'ieete only y a majority vote of the whole
City Council as then constituted, convened in a regular Council moot-
ing, subject, however, to the provisions of the next succeeding
subsections. in case of his intended removal by the City Council,
the City Manager shall be furntshad with a written notice stating the
Council's intention to remove him, at least thirty days before the
effective date of his removal. if the City Manager so requosti, the
City Council shall provide in writing reasons for the intended
removal, which nhall bn provided the City Manager within seven days
after the receipt of such request from the City Manager, and at least
fifteen days prior to the effective data of such removal.
Section 9.1. Hearing. Within seven days after the delivery
to the City Manager rif auc notico of intention to remove, he may by
written notification to the city Clerk, request a hearing before the
City Council. Thereafter the City Council shall fix a time for the
hearing which shall be held at itn usual meeting place, but before
the expiration of the thirty day period, at which the City M:uager
shall appear and be hoard, with or without counsel.
Section 9.3. Sus onsion Pendin Hearing. After furnishing
the City Manager IT}" wr tten not e:e o nten c remova= the City
Council may suspend him from duty, but hie compensation bhall continue
until his removal by action of the Council passed subsequent to the
aforesaid hearing.
Sect'.on 9.4. Discretion of Council. in removing the City
Manager, t ee-C ti y Councilshall use Its uncontrolled discretion and
its action shell be final and shall not depend upon any particular
showing or dogrce of proof at the hearing, the purpose of which is
to allow the City Manager to proseat to said City Council his grounds
Of opposition to his removal prior to its action.
Section 9.5. Limitation on Removal. Notwithstanding the

during or wJthin a period of ninety (90) days next succeeding any
general muni.cipal clneticn held in the City at which election a
member of the City Council is elected or when a new City Councilman
in appointed; the purpose of this provision is to allcw any newly
elected or appointed me•.aber of the City Council or a reorganized
City Council to observe Ute actions and ability of the City Manager
In the parformanco of the powers and duties of Us office. After
the expiration of said ninety (90) cay period aforementioned, the
provisions. of Section 9 as to the removal of said City Manager shall
apply and be effective.
Section 10. Rareemencs on Employment- Nothing in this
ordinance s u construe as a m to on on the power or authority
of the City Council to enter into any supplemental agreement with the
City Manager delineating additional terms and. conditions of employment
not inconsistent with any provisions of this ordinance.
Section 11. Urgency and Effective Date. The City of Rancho
Cucamonga was ncorporateon November 22, end in order to provide
for the orderly function of government within the city, there must be
ostablished immediately is fogs of government. The City Council
determines that it is necessary in order to preserve and protect the
Public peace, health, anfacy and general welfare, that this ordinance
be adopted as an urgency ordinance and that the same take effect
immediately upon its afioption.

AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA
ESTABLISHING A SPECIAL GAS TAX STREET If "ROVE-
MENT FUND IN THE CITY OF RANCHO CUCAMONG,
AND DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA
DOES ORDAIN AS FOLLONS:
Section 1. To comply with the provisions of
Section 2117of�e Streeta and Highways Coda and to avail
itself of its benefits of Sections 2106 and 2107 thereof, there
is hereby created in the City treasury a special fund to be
known as the "Special Gas Tax Street Improvemont Fund ".
Section 2. All monies received by the City from
the State or—Ga =ornia under the provisions of the Streets and
Highways Code for the acquisition of real property or interests
therein or for engineering or for the construction, maintenance
or improvement. of streets or highways by the City, and all
interest received from the investment thereof, shall be paid
into said fund.
Section 3. All monies in said fund shall be
expended exc -usl y for the purposes authorized by and subject
to the provisions of the Streets and Highways Code.
Section 4. The City of Rancho Cucamonga has just
been incorporate Zr and has no funds whatsoever to provide for
maintenance and improvement of City streets. It is necessary
that the City acquire funds for such purposes and without delay.
This Ordinance is therefore necessary for the protection of
the public health, welfare and general safety and shall take
affect immediately upon its adoption as an urgency neasure
pursuant to Sections 36934 and 36937(b) of the Government Code.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF RANCHO CUCAMONGA, CALIFORNIA,
ESTABLISHING A SELECT SYSTEM OF STREETS
THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the Streets and Highways Cods of the State
of California provides for the establishment of a Select
System of city stroate for the purpose of expending funds
apportioned to the City from the State Highways Fund and
expenditures of matching funds from other sources; and
WHEREAS, the Streets and Highways Code of the State
of California provides for the establishment of a Select
System before such funds can be apportioned to the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Rancho Cucamonga as follows:
Section 1. That the San Bernardino County Select
System of Streets yang within the incorporated limits of the
City of Rancho Cucamonga be accepted as the Select System of
Streets of the City of Rancho Cucamonga.
Section 2. That the appropriate department of the
State of Ca ern a is hereby requested to approve the Select
System referred to above subject to such modifications as may
be necessary.
Section 3. That the Acting City Clark of the City
Of Rancho Cucamonga is hereby directed to transmit certified
copies of this Resolution to the District Director of the
State Departm9nt of Transportation for transmittal to the
proper State authority.

WHEREAS, by reason of Section 34328 of the Government
Code of the State of Caliiornia the City Council of the City of
Rancho Cucamonga is required to cause to be filed a Statement
of Boundary Creation required by Section 54900 of the Government
Code:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA DOES RESOLVE AS FOLLOWSt
Section 1. The Mayor and City Clerk are authorized
to prepare Zi execute the Statement of Boundary Creation of
the City ° Rancho Cucamonga, California, to file the same with
all appropriate State and County officials, and to pay any filing
fee therefore as may be required by Section 54902.5 of the
Government Code.
Section 2. The City of Rancho Cucamonga shall utilize
tho regular County Assessment, role of the County of San Bernardino,
California.
Section 3. Any affected property will be taxed for
any existing boffin aindebtednese or contractual obligations.

on November 22, 1977, as a genera. law city of the State of
California; and
WHEREAS, the City by law is entitled to adopt a
City seal;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. The City Seal of the City of Rancho

THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONCA DOES
ORDAIN AS FOLLOWS:
Section 1. Assessor and Tax Collector. Pursuant to the
outhority grarsterl y Section 51501 of e Government Code of the
State of California, the assessment and tax collection duties
porformed by the City Assessor and Tax Collector hereby are
transferred to the Assessor and Tax Collector of the County of
San Bernardino.
Section 2. The City of Rancho Cucamonga has just in-
corporated an as res that the duties relative to the assessment
of property and the collection of real property taxes be performed
by the County Assessor and Tax Collector for Dan Bernardino County.
The City Council determines that the public pence, health, and
general welfare require the adoption of this Ordinance as an
urgency ordinance, and the some shall take effect immediately upon
its adoption.

HEREBY RESOLVES AS POLLOWS2
Section 1. Adoption of conflict of Interest Code.
In compliance WitTSection 87300 of the Government Code, the
City Council hereby adopts this Conflict of Interest Code.
Section 2. Application of Code. This Conflict of
Interest CZUe shall be applicable to members of the City
Council, whether acting as a Council member or as governing
board member or agency member of any City, Board or Agency.
Section 3. Disclocure. Members of the City Council
are require T, pursuant to Government Code Section 87200, to
disclose investments, interests in real property and income.
No other or no additional disclosure requirements are imposed
by this Conflict of Intereet Code.
Section 4. Circumstances Requiring Disqualification.
Any member of tFie City Council, whether acting as a Council
member or Agency member of any City, Board, or Agency, must
disqualify nimself or herself from making or participating in
the making of an,, decisions which will foreseeably have a
material financial effect, distinguishable from its effect on
the public generally, on any financial interest, as defined in
Government Code Section 87103. No member shall be prevented

Section A. Short Title. This chapter shall be
known as the Rea Froporty Trier Tax Ordinance of the City
of Rancho Cucamonga" It is adopted pursuant to the authority
contained in Part 6.7 (commencing with Section 11901) of Division
2 of the Revenue and Taxation Codo of the State of California.
Section 2. Imposition. There is Imposed on each
deed, instrument or wri ng by jib ich any lands, tenements, or
other realty sold within the city shall be granted, assigned,
transferred or otherwise conveyed to, or vested in, the purchaser
or p.,rchasers, or any other person or parsons, by his or their
direction, when the consideration or value of thu 'interest or
property conveyed (exclusive of the value of ary lien or en-
cumbrances remaining thereon at the time of sale.) exceeds
one hundred dollars, a tax at the rate of twenty -seven and one -
half cents for each five hundred dollars or fractional part
thereof.
Section 3. Payment-. Any tax imposed pursuant
to Section 7-s Hain-Le paid by any person who makes, signs, or
issues any document or instrument subject to the tax, or for

SECTION 1. Intent and Purpose.
The City council of the City of Rancho Cucamonga
hereby declares a tax on all new residential develooment within
the City for the sole purpose of producing revenue for the
acquisition, development and initial equipment of new parks
or additional park lands. This is declared pursuant to the
taxing power granted to the City of Rancho Cucamonga by the
Government Code of the State Of California.
The puroose of the tax is to assist in financing the planning,
acquisition and development of oarY.a to maintain the level of
park vervice as the City's population increases.
SECTION 2. Definitions.
a. "City" shall mean the City of Rancho Cucamonga.

when existing structures are remodeled, added to or otherwise
altered to increase the number of dwelling units.
c. "Dwelling Unit" shall include each single fanily
dwelling, each unit of an apartment, duplex dwelling group or

mobile home space designed to contain a mobile hume trailer on
a semi - permanent or pernanent basis.

SECTION 3. Taxi Imoosition and AnDlication.
A tax Is hereby imposed in the amounts herein not
forth and shall be applicable to every dwelling unit as above
defined constructed in the City after the effective date of
this Ordinance and shall be known as the Parka and Recreation
Tax.
SECTION 4. Taxi Amount.
Every person constructing any dwelling unit within
the City of Cucamonga shall pay the City the following:
For each single family dwelling unit, the sum of $300.00
For each multiple dwelling unit, the sum of $150.00
For each mobile home unit $150.00
SECTION 5. Tar.: When Payable.
The tax imposed in this chapter shall be due and
payable noon issuance by the City of r building permit for the
construction of any dwelling unit and shall be refunded only in
the event that the building permit issued has expired and no
construction has been commenced.
SECTION E. Disposition of Tn•: Rocaiiits.
There is heretrf established a Park Development Fund.
All sums collected pursu.,nt to this chapter shall bo aeposited
in said Park Development Fund and shall be rsed solely for
acquisition, development and initial equipment of new parks
or the expansioi, of land or services on existing parks in
accordance with the nark, Parkway and Opor Space element of the
Rancho Cucamonga General Plan.

to a short term month to month car lease:

month to month basis for $200.00 per month
including sales tax and all maintenance.
It is recommended that thu City Manager be authorized
to sign a month to month lease with Croydon Murphy Oldsmobile
Agency for a used 1976 Oldsmobile Cutlass. There is an additional
$10.00 per month to cover collision and colgmrohensive insurance

Ordinance No. 8 DEVELOPMENT AND PROVIDING FOR THE ADMINISTRA-
TION, AMOUNTS AND CREDITS THEREOF, REPEALING
SAN BERNARDINO COUNTY ORDINANCE NO. 2126, AND
DECLARING THE URGENCY THEREOF.
Being an ordinance providing for the levy of a tax
on now residential construction for which a building
pormit is hereafter issued in the amount of $300 for
each single family dwelling unit, $180 for each multiple
dwelling unit, and $150 for each mobile home unit
providing for the purpose of the tax and providing a
procedure for collection, administration, refund and
credits in introduced as an urgency measure and Is given
