Attached is a copy of the minutes of the Board of Supervisors of December S
properly certified as brought to you from the Clark of the Board of Super-
visors.
It to hoped you can expedite this matter so that a construction permit can
be Segued promptly. An Initial construction permit has iten issued for
curbs and gutters and site grading has been basically complete. -We need
the zone extension in order to have actual construction permits issued.
We are aware that the County Planning Department will provide their packet
of materials later, but in order to expedite Rancho Cucamonga's approval,
we are enclosing copies of the conditions established at the zoning hearing
and at the site approval with our guarantee that all conditions will be
complied with.
Also attached is a copy of the Western. Properties' letter requesting the
zone extension dated November 1$ You will note that compliance with the
freeway location required complete redesign of the project.
In order to start construction on the Von's Market building, to meet lease
requirements, we need approvrl as quickly As it is possible to arrange it.
It shouad also be noted that adjustments wore mado in the landscape and
development plat to most the recommendations of the Alta Loma Zoning Advisory

building permits. We ware doleved for causes beyond our control A
froevay off ramp is shown along cuo north portion of our property. We
own the land and Cal Trans will not buy St. 11owavor, we were forced
by the Cecnty not to build on this portion of land even theuahr we own
it, ray taxes on 'it and Cal Trans will not buy it. This resulted in
completely redesigning nor project.
Wa did accomplish this and have gone in for plan check. Duo to the
heave work load in the County, at the Building Department, it has taken
the r ildiog Department quite a while to check the plans. Please do
not cunstrue that as a criticism of the County Building Department as
they havo been extremely cooperative. In any event, we would appreciate
the extension. We have completed the site grading and ha•)a Installed _
the curb and gutter. All of those items were done unaur proper permit.

Staff now has additional information available regarding a
possible "T" Standard. The Board may wish to rotor this appli-
cation back to the donning Comnlasion for consideration of
the "T" Standards or review and approve them at this time.
If the "T" Standards are adopted, it is also recommended that the
enabling ordinance be hithheld for a period of ono (1) year;

One set of complete building elevations shall be submitted to the
Planning Department, Design Review Section In adeition, said
plans shall show precisely the location and height of mechanical
equipment and proposed screening devices.
All mocharical equipment installed on the roof shall be screened.
The screening device shall be considered as an architectural element
and shall be designed to blend with the building. Nigher parapets
for the purpose of screening should be considered.
Proposed buildings along both arterial street frontages shall be
designed with facades oriented toward said streets, or acceptable
alternative.
The lording area at the rear of the market shall be incorporated
into the design of the buildings facade. Said area shall be

Road sections bordering the development are to be constructed to
Valley Standards and as per Road Department policies and re.quire-
ments.

Rat mention of Now High school
The Chaffoy Joint Union 1119h School District has dot, considerable
research to ustablish that a new high school is needed In the tri- ccemunity
area to accommodate the increased student enrollmonts which have created
an overcrowded situation at Alta Loma Nigh School. The Chnffey district
has ta.con action to investigate the availability of a new site for a new
high school and has recently taken action to investigate the possibility of
an exclango of real estate property to acq.Llre a site and also has taken
action to outhorir4 the district to place an issue on the !allot for March Its
:978 for the die'.ricc electorate to vote upon a tax race Lec_roase to aaquiro
a site and corstruct a new high school.
A now site has bean selected within the boundaries of the now city of
Rancho Cucamonga and specifically located appxoximntely 4631 south of Baseline
Avenue and adjacent to the extension of :lilliken ^venue north of Foothill
Boulevard as shown on the enclosed maps. The geographic location is
epproxinetoly centered between the existing Alta Lome High School and the
district's existing future site in Etiwattda. The site has also been chocked
fot availability of utility services close by, current and possible future
residential development, flood control, street access, etc
The Education Code requires that prior to acquiring title to property
for a new school site, the district shall give the planning commission having
jurisdiction notice in writing of the proposed acquisition. The planning
cc.miosicn shall investigate the proposed site and within 30 days after receipt
of such notice, they shall submit to the district a written report of the
Arveotigation and its rocommcndations concerning acquisition of the site.
The San Bernardino County Planning Department has already been notified of
this proposed ebto acquisition and this notification is hereby being forwarded
to the City of Rancho Cucamonga since you have recently become an officially
recognized city and this school site now falls within the territorial Limits
of your city

CALL TO ORDER The first regular meeting of the City Council was
hold at crm=unity Service Building, 9161 Base Line
Road, Rancho Cucamonga, on Wedi,esday. December 7,
1977.
The mocring was called to order at 7:35 p.m. by
Mayo- James C. Frost.
The pledge of allegiance to the flag was lad by
Mayor James C Frost.
The invocation was of fazed by Roy Houtz.
BOLL CALL PRESENT: Count :l members Jon D Mikels, Michael
Palombo, Phillip D. Schlosser, Charles
A. West; Mayor James C. Frost.
Interim City Manager H. K. Hunter, and
Interim City Attorney Samuel Crowe.
ABSENT: None.
MINUTES fiction: Moved by West, seconded by Palombo and
carried unanimously to postpone the reading of
the minutes of the special meeting of December 2,
1977, until the next regular meeting of December
21, 1977.

AN ORDINANCE IMPOSING A SALES AND USE TAX
TO DE ADMINISTERED BY THE STATE BOARD OF
EQUALIZATION AND PROVIDING PENALTIES FOR
VIOLNTIONS AND PROVIDING FOR ITS ADOPTION
AS AN URGENCY ORDINANCE
being an ordinance imposing a local sales and use
tax of 1% operative January 1. 1978, and pro-
viding for its adminiatratfon and collection, is
introduced as an urgency ordinance and is given

duced and was given its first reading and was
carried over to the next Regular Council meeting
to be hold December 21, 1977.

APPROVAL and 9377, wore presented for approval by the County

Motion: After a lengthy discussion a motion was
made by Schlosser, seconded by Palombo, and unani-
mously carried to delay a decision on these tracts,
and reconsider them at an adjourned meeting next
Wednesday, December 14, 1977, at 7:30 p.m.
TRI- COMMUNITY A summary of planning activity of the Tri- Community
CITI7FNS Citizens Advisory Committee was made by Linda Frost,
ADVI'DRY Chairporson of Land Use Subcommittee.
COMMITTEE
The Council favored continuing the Committee, but
wanted more time for working out the details.
Motion: A motion was made by Palombo, seconded by
Mikols, and unanimously carried to continue the dis-
cussion until next Wednesday, December 14, 1977.
TRI - COMMUNITY A proposed City Charter study was requested by the
INCORPORATION Tri - Community Incorporation Committee and was pro -
COMMITTEE sented by Catherine V. Bridge.
Motion: A motion was made by West, seconded by
Palombo, and carried unanimously, to form an advi-
sory committee to investigate a city charter and
report back to the Council - -tho details of forming
the committee to be later determined.
RECESS The Chair declared a recess, and at 9:45 p.m. the
meeting reconvened with all members of the Council
present.
NEW CONSTRUCTION In response to a request from Ralph D'Errico for
TAX FOR SCHOOLS consideration of a tax for school purposes on now
residential construction, the Council, through
the interim City Attorney, Samuel Crows, informed
Mr. D'Errico that the direct tax is beyond the
authority of the City.
REQUEST FOR In response to a written communication, dated,
ABANDONMENT OP December 5, 1977, from Edward J. Feduniw, Presi-
ROADWAY dent of H & M Wholesale Lumber, Inc., the Council
hoard the request for abandonment of undedicated
roadway (between Base Lino Road and Southern Pa-
cific Railway tracts shown as a continuation of
Rochester Avenue), After much discussion the
following motion was made by Palombo, seconded
by Mikels, and carried unanimously.
Motions To move approval of the grade level sub-
ject to the condition that it 6 M Wholesale Lumber,
Inc., convey all of its right to access to Roches -
tar Avenue to the City of Rancho Cucamonga in a
form approved by the interim city attorney.
CONSIDERATION The Council's response to a letter dated, December 5,
OF TRACT 9472 1977, from U. P. Kapp and Associates, Inc., relative
to Tract 9472, was in the form of a motion.

THREE EMPLOYEES Hunter, on the progress of the transfer of three
(3) employees from the district to the city.
A request was made for authorization to spend $30
per employee for an actuarial report from Public
Emoloyoo Retirement System that is necessary in
ordor to make the transfer. The survey would do-
terming what the city's coat would be for the
retirement system.

CITY MANAGER Mr. H. K. Hunter, Interim City Manager, informed

PLASMiHC Msyor Frost stated that the next item on the Agenda was
WORK6HOF a workshop presented by the Planning Department of the
County of San Bernardino.
Robert R. Rigasy, Agency Administrator for the Environmental
toprovemat Agency of Son Bernardino County spoke and then
introduced Ken Topping, Planning Director for the County,
who was in charge of the Planning Workshop for the evening.
Ken Topping introduced the West Valley Planning Team
consisting of Tom Stephens, Senior Planar; Ann Pinan,
Aasociste Planar; and Marianne Cordova, Planner I.
The Council was told by Ken Topping that according to State
law, the Council could either appoint a Planning Commission
or comprise one of their ow -- but that there neat be a
Planner.
A Lengthy presentation by Ken Topping of background infor-
mation was presented to the Council in order that they would
understaml the various procedural steps in the planning
process governed by law.

SITIZENS ADVISORY informtion about the General Plan, activities of the
L INCIL Committee, and 4100 the Council's racoamendatlons.

AVAILABILITY Advisory Committee, that rope for the next Council meeting

be made available in advance at the Community Servlca
Building.
Ron Topping responded saying that he was not aura the City
was ready to maintain a file as thara would be a security
problem of how, to keep these valuable records.
Interim City Manager concurred with Mr. Topping Baying that
the City was not ready to maintain a file of these records at
this time.
ADJOURNMENT The Chair entertained a motion for adjournment.

unanimously that tho mating be adjourned. Meeting adjourned
