CALL TO ORDER The adjourned regular meeting from December 7,
1977, of the City Council, was hell at Commun'ty
Service Building, 9161 Base Line Road, Rancho
Cucamonga, on Wednesday, December 14, 1977.
The meeting was called to order at 7:40 p.m. by
Mayor James C. Frost.
The pledge of allegiance to the flag was led by
Mayor James C. Front.
ROLL CALL PRESENT: Ccuneil member! Jun D. Mikela, Michael
Polombo, Phillip D. Schlosser, Charles
A. West; Mayor James C. Frost.
Interim City Manager H. K. Hunter, and
Interim City Attorney Samuel Crowe,
ABSENT: None.
MINUTES Motion: Moved by Hest, seconded by Seh:osror
and carried unanimously to apprcve the minutes
of the special meeting cf December 21 19771 and
of the reguiar meeting of recember 7, 1977.

A .1ESOLUTION OF THE CITY COUNCIL OF THE
CITY OF RANCHO CUCAMONGA APPOINTING THE
DIRECTOR OF BUILDING AND SAFETY OF THE
COUNTY OF SAN BER!NARDINO, STATE OF CALI-
FORNIA, AS CHIEF BUILDING OFFICIAL OF THE
CITY OF RANCHO CUCAMONGA
The Resolution was read by title only (complete
text in Resolution Book).
Moved by Falombo, ceconded by Schloeser and
unanimously carried to waive father reading.

Motion: Moved by Palombo, seconded by West and
una —iii mously carried to adopt Resolution No. 77 -28.
Mr. Robert J. Mitten, Director of the Building
and Safety Department for the E..vironmental Im-
provement Agency of Sun Bernardino County was
introduced as the new Chief Building Official
of the City.
APPROVAL OF A letter frcv the County Surveyor, Eugene P. Ehe,
TTRAI-V= dated December 1977, regarding two subdivision
TROfff-M. final maps for:
Tract No. 9329, Rancho Remona Eetateq and
Tract No. 9377, Bub Jansen, Builder,
for the Council's consideration that were carried
over from the last meeting of the Council on
December 7, 1977.
The Council was also in receipt of letters, dated
December 7, 1977, from Acting City Engineer, John
R. Shona, regarding these two tracts to be con-
sidered.
Motion: Moved by West, seconded by Schlosser that
we accept both of these tracts together. Motion
carried with Mikels opposed.
ACCEPTANCE A request was made to the City Manager, Ken Hunter,
Zr_ZURY_ by a letter,datod, December 7, 19771 from Harold
�N Zenz, for a zone extension for Western Properties.
30PPINO Ken Topping, San Bernardino County Planning Direc-
Z'ENTEii tor, recommended that the Council proceed with
the Zone Extension request of sixty (60) days, on
a community shopping center of 8.21 acres, located
at the Northeast corner of 19th Street and Carnelian
Avenue in Alta Loma.
Motion: Moved by Weot, seconded by Mikels and
card unanimously that we extend it for 60
days as requested.
PROPOSED SITE The Planning Department of the City of Rancho

Interim City Manager, H. K. Hunter, said this
was for the Council's information and required
no action.
SMOKING Councilman Palombo requested that a place in
WR= the room be designated for the smokers and a
ISbONATED place for the non - smokers.
Mayor Frost desilsmated that the East Section of
the Community Room would be set aside for the
smokers and the West Section for the non - smokers.

PLANITING
Mayor Frost stated that the next item on the

Agenda was a workshop presented by the Planning
Department of the County of San Bernardino.
Robert R. Rigney, Agency Administrator for the
Environmental Improvement Agency of Son Bernar-
dino County, spoke, and then introduced Ken
Topping, Planning Director for the County, who
was in nharge of the Planning Workshop for the
evening.
Ken Topping introduced the West Valley Planning
Team consisting of Tom Stephens, Senior Planner;
Ann Finan, Associate Planner; and Marianne
C -dova, Planner I.
The Council was told by Ken Topping, that ac-
cording to State Law, the Council could either
appoint a Planning Commission, or comprise one
of their own - -but that there must be a Planner.
A lengthy presentation by Ken Topping of back-
ground information was presented to the Council
in order that they would understand the various
procedural steps in the Planning Process governed
by law.

Ken Topping responded sayir.g that he was not
sure the City was ready to maintain a file,
as there would be a security problem of how
to keep these valuable records.
Interim City Manager, H. K. Hunter, concurred
with Mr. Toppi ^q saying that the City was not
ready to maintain a file of these records at
this time.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO CUCAmONGA.APPOINTING
UE ACTING CITY TREASURER
WHEREAS, the City of Rancho Cucamonga was incorporated
on November 22, 1977, as a general law city of the State of
California; and
WHEREAS, it is necesnary that an Acting City Treasurer
be appointed imaediately in order that the affairs of the City
may be proparly administered;
NUN, THEREFORE, THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. is hereby appointed
Acting City Treasurer of the City of Rancho Cucamonga to servo
at the pleasure of the City Council.
Section 2. The Acting City Treasurer will furnish a
corporate surety bond to be approved by the City Council in
such amount as cay be determined by the said City Council, and it
shall be conditioned upon the satisfactory performance of the
duties imposed upon the City Treasurer as herein prescribed.
Any premium fo: such bond shall be a proper charge agal=i the
City of Rancho Cucamonga.

AN ORDINANCE OF TILE CITY OF RANCHO
CUCANONGA ESTABLISHING SALARIES FOR
:•tE:HiERS OF THE CITY COUNCIL
THE CITY COUNCIL OF THE CITY OF PAACHO CUCA14ONGA
DOES ORDAIN AS FOLLOWS:
Section 1. This Ordinance io enacted pursuant to
she provis ona of Section 36516 of the Government code of the
State of California, authorizing the Council to provide by
ordinance that each member of the Council sball receive a
prescribed salary, the amount of which shall be based upon
the population of the City as determined by estimates made
by the State Department of Financn.
Section 2. As of November 30, 1977 the latest
estimate o popu ation of the City made by the State Depart-
ment of Finance is ¢40,470.
Section 3. Each member of the Council shall raceivu
as salary Ure sum of :200.00 per month, as prescribed in Section
36516 of the Government Code of the State For cities in th•.
35,000 to 50,000 population group. Said salary shall be paid
at the sale tire and in the same manner as salaries are paid
to other officers and employees of the City.
Section 4. Following any new and later authorized
estimate o7-P-3-Fu t on or census placing the City in a popula-
tion group other than that set Porth in Section 2 of this
ordinance, the salary payable to each member. of the Cotwcil .
shall be increased or decreased accordingly to equal the aim
prescribed for that population group in said Section 36516 of
the Government Code of the State; provided, however, the salary
so increased cr decreased shall become payable only on and
after the date upon which one or more members of the Council
become eligible therefore by virtue or beginning a new term
of office follaaing the next succeeding general municipal
election held in the City.
Section S. The salaries prescribed in this
ordinance s-Ta =o exclusive of any amounts payable to
each member of the Council as reimbursement for actual and
necessarl oxpenses incurred by a member of the Council in
the o3rformance of nfficial duties for the city.

1. Prior to the final adoption of the plan amendment, a specific
plan shall be approved by the Planning CoTdnlssion and adopted
by the Board of Supervisors
2. Said specific plan shall provide for the following:
a. Development shall conform to the San Dernardino County's
standards for Planned Unit Developments
b. Development shall be designed so as to minimize vehicular
access to adjacent subdivisions.
3. Prior to the adoption of the plan amendment, the San Bernardi

Gentlemen:
T. b S Development Inc., 1s hereby requesting a one year extension
of ous• approved development plan for a Neighborhood Shopping Center
on 7 '2 acres. located at the SEC of 19th Street and Carnelian Avenue
in Rancho Cucamonga, California.
We submitted a letter to the San Bernardino County Planning Department
on 'Io%ember 2, 1977, for a request and were subsequently heard by the
Sub - division Committee on December 9, 1977. We were told that we must
be heard by the City Council of Rancho Cucamonga and to contact Mr
H. Y,. Hunter, the City Manager, and file for an application for a
hearing. The Sub - division Committee related to us, at that time, that
they had no ob;ection to the extension, although, they could not act
upon the extension request, as Rancho Cucamonga is now an incorporated
City.
The reason for the extension request, is due to lengthy negotiations
with our major market tenant. We have now finalized our lease and
are on the way with working drawings on the market and shops and current
ly under negottettons with a bank an the immediate corner We do ex-
pect some minor changes in the site plan, although, we can conform to
all standards contained in the conditions of appproval of the development
plan and T- standards, as required and approved by the San Bernardino
Planning Commis.ion and the County Board of Supervisors.
It is also our intent to continue to work closely with the Citizens
Committee and the City Council in developing a shopping center that
will be a credit to the City of Rancho Cucamonga and, hopefully will be
pointed to as a set of standards for all commercial projects in the
futurii for the City.
Our current schedule calls for construction to begin in spring of 1978.

1 Building permits shall be obtained and construction diligently
2 pursued to completion within ono (1) year from the date of the
3 initial Planning Commission approval, unless extended by the
4 Planning Commission, or termination proceedings will be initiated.

Carnelian Avenue shall be designed as a wator- carrying street.
Adequate provisons shall be pro••tdod adjacent to Carnolian to
prevent Carnelian Avenue flows ..:eying the site. Such provisions
could include adequate site elevation or a masonry block wall. The
protection should be extended an adequate distance easterly along
Nineteenth Street to prevent flows from entering the site from the
northwest corner of the site.
Adequate provisions shall be made for dowatering the site in a
manner which will not adversely affect adjacent or downstream
property.
Grading and /ir improvement plans shall be submitted to the =_County
Flood Control District office for review.
The conditions enumerated above are continuing conditions. Failure of
the applicant and /or operator to comply with any or all of said
conditions at any time shall result in the revocation of the permit
granted to so use the property.
A faithful performance bond in an amount equal to the estimated cost
of uncompleted required improvement" plus the cost of administration
shall be posted with the Road Dopartment and /or the Building and
Safety Dept. if the required improvements have not been completed at
time the occupancy permit is sought.
Prior to any occupancy, a Certificate of Final Completion shall be
issued by the Department of Building and Safety, after which, an

The application for the abandonment of Haven Avenue West from Lemon Avenue
South 322' in the Alta Loma area was submitted by Hone and Associates, Inc.
This is a paper street that was to be eeveloped to County Standards in 1968
under a proposed development plan. The proposal never materialized. A
shopping center is now being proposed and the frontage road concept is not
desirable at this time.
A sub - committee consisting of representatives from the Planning Department,
Flood Control District and Transportation Department met and it was deter-
mined that since the frontage road concept is no longer feasible and that
no parcel will be denied access, that the Committee v:.u.:aends the abandon -
rent. The existing non - access along Haven Avenue ii to be retained.
Motion was rude, seconded and passed to recommend do abandonment of Haven
Avenue Hest, from Lemon Avenue south 3221.

STAt1DARD REQUIREXENTS:
The water system and ftre hydrants shall be installed in accordance
with the requirem -ants of the State Health and Safety Cods, and in
accordance with plans approvad by the San Bernardino County Health
Department and the governing fire protection authority.
Easements and improvements shall be provided and drainage coordin-
atod in accordance with tho standards and roquirer..ents of the
County of San Bernardino an--' the County Planning Ca =ission.
Where a bond is to be posted in lieu of installation of the
improvements
The domestic water plan and /or sower plan, shall be reviewed
by a civil engineer, registered in the Stats of California,
and said engineer, sha.1 determine the amount o'_ bond
necessary to install the improver_enta. This a„.ount plus ten
percent shall be posted with the County of San Bernardino.
The presently required certificates on water maps for the
water company and engineer must still be placed on the map.
In addition, a statement shall be transmittod to the Public
Health Department signed by tho registered civil engineer
for the water purveyor stating that rho amount of bond
recommended is adequate to cover the cost of installation
of the improvement.
Further, prior to roloase of the bond for the improvement,
the Cucamonga County Water District shall submit a signed
statement confirming that the improvement has been installed
according to the approved plans and moots the requirements
of all appropriate State and County laws portaining to such
improvement.
In canoe where the water agency or saworing agency is a
govornmontal subdivision, prior to final recording of the
tract map, the governmental agency shall submit a statement
dirvctod to the County stating that the improvement has boon
installed according to the approved plans or stating that
bond in the amount of 110 percent of the coat of installa-
tion of the improvement has bean placed with the agency.
A commitment shall be obtained, in writing, from the saworing
agency. Said conmitmont to indicate that the agency has the
capacity to furnish said sower service to the subject project,
and that all necessary arrangements have boon made with said
agency to supply such service. A copy of the commitmonc t; be
filed with the Planning Director.
Sidewalks shall be provldcd throughout the tract including all
peripheral stracts.
Street lighting shall be provided throughout'the tract including

Ordinance 19.28 shall be filed with and approved by the Director
of Building and Safety prior to recordation of the final cap.

Hermosa Avenue flows from entering onto the lots. The block wall
should extend around the return of Lot 16.
Adequate protection shall be provided along the northwest corners
of Lots 16 and 56 to preclude Hermosa Avenue flows from entering
onto those lots.
Adeeuato provisions shall be made to intercept local drainage flows
from the north and convey them around or through the tract. Adequate
provisions could include a ditch and dike section or other methods.
Adequate rolls shall be provided on Victoria and Monte Vista Streets
at Hermosa Avenue to control Hermosa Avenue street flows.
Adequate provisions shall be mide for %andling onsitc drainage and
dewatering the tract in a manner wnt_h Mill not adversely affect
adjacent or downstream properties.
Grading and improvement plans shall be submitted to the County

Existing zoning is R -1 -T.
All lots shall have a minimum area of 720D- square feet, a minimum
depth of 100 feet and a mininum width of 60 feet, (70 feet on
corner lots). In addition, each lot on a cul -de -sac or on a
curved street where the side lot lines thereof are diverging from
the front to rear of the lot, shall have a width of not less than
sixty (60) feet measured at the building setback line as de-
lineated on the final tract .nap.
Variable front building setback lines of at least 22 feet and
averaging at least 25 feet and aide street building setback lines
of fifteen (15) feet shall be delineated on the final tract map.
A minimum number of one inch caliper, multi- branched t -nes shall
be planted in the parkway for each of the following types of
lots:

Any existing eucalyptus trees to be retained shall be topped
to 30 feet, trimmed along the lower 15 feet, and cleared of all
dead leaves and branches.
A perimeter wall along Hermosa Avenue shall be designed and con-
structed to incorporate design features such as tree plantar
wells, variable setback, split block face, columns, or other such
features to provide visual and physical relief along the we
face. Prior to recordation of the final map, the developer hall
obtain Planning Director approval of the design of the proposed
wall.
Street trees of a minimum fifteen (15) gallon size on forty (40)
foot centers, appropriate ground cover, as wall as an approved

THIRD: The OWNER shall indemnify and hold harmless the COUNTY, the Director
of Transportation and all officers and employees of the COUNTY from all dolts or
actions of every nomad, kind, or description brought for, or as a result of any
injuries or damagoa racoived or sustained by any person or parsons, by or from the
OWNER, his contractor or agents or employees of them, in the performance of the
work herein.

FOURTII: It is further agreed that the OWNER will at all times, up to the comple-
tion and acceptan:e of said work or improvements, give good and adequate warning to
the traveling public of every defective and dangerous condition existent within public
rights of way, and will protect the traveling public from said hazardous conditions.
It is understood and agreed that until the completion of all required improvements,
the subject road or roads shall not be nccepted into the County Maintained Road System.
OWNER may, with approval of the Director of Transportation, close all or portions of
any street when deemed necessary to protect the traveling public during the construc-
tion and /or installation of tl.e required improvements.
FIFTH: It is further ogre -d by the parties hereto, that the OWNER will furnish
good and sufficient bonds in an amount not less than the asttmated cost of said work
and improvements as specified herein for the paym ut and faithful performance of the
terms and conditions of this contract. Said bonds may be in am or veto of the follow-
ing forme: (l) cash deposit, (2) bond by one or more duly authorized corporate sure-
ties. (J) instrumnt of credit from one or more financial institutions subject to
regulation by the State or Federal government pledging that the funds necessary to poet
the performance are on deposit and guaranteed for payment and agreeing that the funds
designated by the instrument shall become trust funds for the purposes or sot forth
above. Should said securities become insufficient, the OWNER agrees to provide supple-
mental surety ai required within ton days of notification. All bonds shalt remain in
full force and effect until all work is completod and accepted by the COUNTY.
SIMI: It is further agreed by and between the parties hereto, including the
surety or sureties on the bonds attached to this agreement, that in the event it is
deemed necessary to extend the allowable construction time for the completion of the
work as requited under this agreement said extension may be granted or denied by the
Board of Supervisors and such action shall in no way affect the validity of this agree -
ma nt or release the surety or sureties on the bonds attached hereto., In the event of
such extension of time fur completion of the work required hereunder, the County may
re- estima te the value of incompleted work based upon current unit prices and adjust
bond amounts accordingly as required, and in the event that the COUNTY brings suit
against OWNER for alleged non - compliance with this agreement and judgment is recovered,
OWNER shall pay all costs incurred by COUNTY is bringing such suit, including s reason-
able attorney's fee, to be affixed by the court.

WHEREAS, the Government Code states that one of the purposes of a
Local Agency Formation Comnisslon Is the discouragement of urban sprawl
and the encouragement of the orderly formation and development of IOC3I
governmental agencies based upon local conditions and circumstances; and
WHEREAS, the Government Code states one of the objects of the
Local Agency Formation Cmmission Is to make studies and to obtain
and furnish Information which will contribute to the logical and reason-
able development of local governments In each county and to shape the
development of local governmental agencies so as to advantageously
provide for the present and future needs of each county and its
communities; and
WHEREAS, the San Bernardino County Local Agency Formation Commis-
Ion has the power to Initiate and make studies of existing governmental
agencies; and
WHEREAS, in order to carry out Its purpose and responsibllttlgs,
the San Bernardino County Local Agency Formation Commission is charged
with developing and determining the sphere of Influence of each total
governmental agency within the County.
UOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Upland does encourage. the present and future members of the San
Bernardino County Local Agency Formation Commission to purposefully
study the capacities of all titles in order to rightfully designate
spheres of Influence and proper areas for annexation to existing local
governmental agencies.

Subjects Temporary Office Space
The City of Rancho Cucamonga will have office space avail-
able at 8037 Archibald Avenue (in the block north of Foothill)
on December 22. This space is being loaned to us wtthout rental
for two months to permit us to determine more accurately our
space needs. Telephone service will be open on December 27 and
the office open for business.
It is expected by March 1 we will know our intermediate
space requirements and then look for a move to a new location.
We are reserving sufficient telephone capacity so that we will
have a City of Rancho Cucamonga telephone number published in
the next directory. That telephone will be installed December 27.

Dear Hr. Mayor:
Congratulations on your appointment as Rancho Cucamonga's first mayor.
Undoubtedly you must to about swooped with the problems of establishing
a now city, including the location of a city hall. The newspapers have
covered the issue and the short term solrtion of a meeting hall but have
said nothing about planning beyond the irnodiate present. I have a
suggestion I hope you will consider: locating the city hall at the old
Garrett and Company (Virginia Dare) Winery.
Using an abandoned winery as the seat of city government will probably
cause some amusor_ent and wisecracking for a while, but there are same
yood reac,ans for using this particular site.
First, it is centrally located to the three communities and should be
the least objectionable from that standpoint. Sectional rivalries that
ware apparent during the incorporation should is minimized with the Haver.
and Foothill site.
Second, the road system as it exists now and as it is planned in the
future is ideal. Haven Avenue and Foothill Boulevard are both major
arterials: they are both built to their ultimate width with left turn
Imes and signalized with the moat modern devices now in use. Foothill
is a state highway connecting Rancho Cucamonga to Pontoon and Rialto to
the east and Upland and Ontario to the west. Haven in a main access to the
existing San Bernardino Freeway and will be in the future to the Foothill
Freeway.
Third, the area across the street is planned for a regional shopping center,
one of a largo magnitude, making it likely that Haven and Foothill will
become the center of commerical activity in the future since none, exists
now and no other plrns are in the works to my knowledge. The only existing
area which my be considered, Foothill and Archibald, has soma objectionable
points. The location of the existing school, and the ragionai park are two
min points, along with the lack of expansion capabilities as caaparad to
Haven and Foothill.

Fourth, recent studies show the building can met building and earthquake
Codes, even thoU0. steel reinforcing was not used in the concrete walls.
Fifth, the building is, or can be, architecturally pleasing. It is also
known as the Mission Winery because of its design, which incidentally,
was done by the Cam man that designed the Mission Inn in Riverside.
Sixth, the building should give Rancho Cucamonga some recognition among
Southern Californians because of its appearance in so many movies and
telovision shows.
Sevanth, the building is a reminder that although Rancho Cucamonga is the
newest city in the state, its ties go back into the early history of
California. The building was constructed in 1910 and is historic in itself,
but it is aloo representative of the wine industry and Cucamonga's role in
the development of that industry.
There my be many other reasons why the Garrott Winary would make a good
city hall, but I believe these to be sufficient to at least investigate
in eon detail.

The Environmental Improvement Agency has received a copy of
the Environmental Impact Report on the Mira Loma /Lugo
Transmission Linn Project, which traverses portions of your
city. The Public Utilities Commission has requested that
any comments on the EIR be submitted prior to January 15, 1978.
Sara Hoffman, Energy Coordinator, had worked with the Tri-
Community Advisory Committee in review of the project.
Several issues of concern had been discussed, including
painting the transmission line towers along the hillside to
minimize visual impacts.
The County will be commenting on the EIR. If you would like,
she could also meet with the City Council, or appropriate
representatives of the City, to discuss the project and the
EIR.

of Boyd and Hillside i-% Alta Law. The escrow has been unable to

a mnxJmum of three access drivas; one access drive shall be devoted

hundred fifty (150) foot from the northwest cornor of the subject
property measured along their respective property lines. In
addition, all access drives are to be a location and width standard

The regular meeting of the City Council was hold at the
Cummuntty Service Building, 9161 Baseline Road, Rancho
Cucamonga, on Wednasday, December 21, 1977
The seating was called to order at 7:35 p.m. by Mayor
Jame C. Frost.
The pledge of allegiance to the flag was led by Mayor
Frost.
The invocation van offered by Rev. Ran Nettles of the
Victory Chapel, Foursquare Church.

Art Bridge said that the T 6 S Development Company came before
the Coamnity Planning Committee and did modify the plans.
Peter Tolatoy said he did not see the nerl for this development.
Linda Frost spoke ircm the audience saying that this development
far exceeds the gaality any other development plan brought
before the committee.

Hunter stated that all the conditions had been pet with the
exception of an essament whicL is in process. Harry Crowell,
the developer, spoke regarding the progress on the aasement.
Kan J111la, Executive Director of the Building Industry
Association, Baldy View Chapter in Upland, presented a letter
dated December 21. J977 in regard to Review of Tentative Maps
heard by Subdivision Review Committee based on San Bernardino
County Planning Department statistics. Hr. Willis also offered
assistance from the BIA to compile information from the builders
for the use of the Council.
A list of approved tertutive maps for the City of Rancho
Cucamonga compiled December 19, 1977 was presented from the
County Surveyor.
After a lengthy discueslon, the following motion was mados

ABANDONMENT Abandonment of Haven Avenue Outer Highway West, south
of Lawn Avenue received from Ho:: Associates of Tustin
California, recommended that this Item be eat for a public
hearing.
Upon the recvmaundation of Mr. Hunter of setting the public
hearing for the regular meeting of February IS, 1978, the

carried to set a public hearing for this petition of Abandonment
for the regular City Council meeting of February 15, 1978,

ACCEPTANCE OF John Shone. Acting City Engineer, in a memorandum, dated
SURETY BOND OF December 8, 1977, recommended acceptance of a surety bond
$38.000 of 538,000 from Ameron, Arrow Route, Etivanda, for road
improvements.

65,000,000 Company, dated December 14, 1977 regarding the 65,000,000
UMBRELLA POLICY Umbrella Liability Policy with Fireman's Fund Insurance,
recommended approval of coverage effective December 21, 1977.
The Interim City Manager also recommended that the Council
officially recognize the State Harmless Claus* that the
Council had received from the County dated December 140 1977.
Motion: Moved by Palumbo, seconded by Hikels and carried
unanimously to accept Mr. Hunter's recommendation of approval
of the 65,000,000 umbrella policy and to recognize the State
Harmless Clause from the County.

Mr. Hunter also recommended that he be authorized to purchase

furniture and to accept, free of charge, the use of the
