The attached list takes action on many of the bonds in these situations. Labor and Material bonds are to secure a lien on the bond holder to pay claims from subcontractors and materials suppliers. If claims are not presented against the bond within six months of the release of the Per- formance bond, the Labor and Material bonds are automatically released. • The next few agendas will catch up on these item. County of San Bernardino, pursuant to section 3 of the Housing and Urban Develop- ment Act of 1968, as amended, 14 U.S.C. 1701u. L PURPOSE The purpose of this plan is to comply with those section 3 require- ments so that to the greatest extent feasible, opportunities for training and employment shall be given to lower income residents of CDBG assisted project areas, and that contracts for work in connection with such projects be awarded to businesses located in or are owned in substantial part by project area residents. To facilitate compliance with t'.:e section 3 regulations on CDEG funded contracts, the County shall initiate the following actions to insure utilization of lower i==a Project Or target area , residents as employees or trainees., 1. The County shall establish and maintain a direct-ory of servici organizations, job referral agencies and maapewer training programs operating within or servicing project or target area residents. Z. The County ahall disseminate this affi=&t.ive action Plan to those agencies and organizations listed on the above referenced directcr7, as well as to contractors organizations and labor unions. 3. The County shall disseminate its affirmative aetios policy to the public via news media sc=ow that serve project or target area residents. 6. The County shall provide the directory of organizations and i agencies serving project or target area residents to the contractor for use in recruiting needed labor. ' 10. The contractor shall notify these community organizations of available e.=ployment opportunities and shall maintain records of response from these organizations. • 11. The contractor shall make continual personal recruitment efforts directed at all service organizations, schools with lower income resident students, recruitment organizations and lower intone resident training organizations with which he is familiar. 12. The Contractor shall maintain a file of the name and addresses of each low income resident worker referred to him and what action was taken with respect to each such referred worker, and if the worker was not employed, the reasons therefore. 13 The Contractor shall promptly notify the County when the union or unions with whom the contractor has a collective bargaining agreement has not referred to the contractor, a • the low income resident worker sent by the contractor or contractor has other information that the union referral process has impeded him in hij efforts to meet his goal. 14. For prise contracts that exceeds $500,000 and to "very sub- contract on that job exceeding $50,000, the County shall require prospective contractors to submit with their bids affirmative action glans which, at a minimum: - Establish goals for utilisation project on target area residents and businesses. !' - Establish steps taken or to be taken to accomplish these S goals. Establish steps which have been taken or will be taken to necurs the cooperation of subcontractors and unions in meeting thesa goals. i 15. In order for a contractor to establish that he has made a good faith effort to employ or fill training positions with lower r income project or target area residents he shall, as a minimum, R provide evidence that he has: (a) Attempted to recruit from the project or target area ilocal advertising media, signs placed at the job site, + and community organizations, public and private agencies operating within or serving the project or target area, / such as the State Employment Development Department, Urban League, Operation Second Chance, Wastside Community Development Corporation or Inland Manpower Association. (b) Maintained a list of ail lover income area residents who have applied either on their own or on referral from any i source and employed such persorz if otherwise qualified and if Opun Aga exist. r _4y1 B. To increase the utilization of businesses located in or owned in substantial part by persons residing in the project area, the County shall initiate the following actlonsi 1. The County shall develop a list of business concerns within the project or target area doing business in professions or occupations identified as needed. 2. The County shall advertise for bids in news media sources serving the project or targot area. 4. The County shall sand invitations to bid to appropriate project or target area businesses identified in 2 above. r S. Prior to award of any contract, the County shall require a l signed assurance from the contractor that to tLe greatest s extent feasible, subcontracts for labor and materials will be lot to qualified project or target area subcontractors and vendors. 6. The County shall provide the list of project or target area businesses (2. above) to contractors upon award of contract. 7. The contractor shall contact project or target area contractor organizations or organizations likely to yield project or target area contractors for referral of prospective sub- contractors. C. The County shall require that the "Contract Cities", "Special Districts ", and 'Self Governed- Speciel Districts ", as well as it's contractors and subcontractors establish as part of their Section 3 Affirmative Action Plan for employment and Lueiness opportunities, steps as described in A and B above, to assure that to the grsatest extent feasible opportunities for training and employment are being given to lower income project or target area residents, and that contracts are awarded to business concerns located in • the project or target area. 2. The "Contract Cities ", "Special Districts', and "Self Governed - Special Districts" shall reference in their section affirmative action plan for employment and business, the County of San Bernardino's Section 3 Affirmative Action Plan for employment and business opportunities. 3. The County shall require that the "Contract Cities ", "Special Districts", and "Self Governed - Special Districts", shall report on forms described by the County, on n monthly basis, thair results of extending employment and Wsiness opportunities under Section 3. (b) The tern "Taxing Body" shall mean the State or any PolItiCdl subdivision or taxing unit thereof in which a Project is situated and which would have authority to assess or levy real or personal property taxes or to certify such taxes to a taxing body or publt�c • officer to be levied for its use and benefit with respect to a Project if it were not exempt from taxation (c) The term "Shelter Rent" shall mean the total of all charges to all tenarts of a Project for dwelling rents and nondwelling rents (excluding all other income of such Projects), less the cost to the Local Auth rity of all dwelling and rondwelling utili- ties. (d) The term "Slum" shall mean any area where dwellings predomin- ate which, by reason of dilapidation, overcrowding, faulty arrange- ment or design, lack of ventilation, light or sanitation facilities, or any combinattur of these factors, are detrimental to safety, health, or morals n U The Local Authority shall in coordination with the Local Govern- ing nod y endeavor (a) To secure a contract or contracts with the Government for loans and annual contributions covering one or more projects comprising a total number of duelling units of lov -rent housing to to built or rehabilitated, not to exceed SS of the total dwelling units within the Municipality and (b) To develop and ndmintater such project or projects, each of which shall be located within the corporate limits of the Munlcinality. (a) Under the constitution and statutes of the State of California, all Projects are exempt from all real and personal property taxes e and specinl assessments levied or imposed by any Taxing Oody Vi[Ir respect to any Project, so long as either (1) such Project 1a owned by a public body or governmental agency and 1s used for low -rent housing purposes, or (11) any contract between the Local Authority and the Government for loans or annual contributions, or both in connection with such Project remains in force and effect, or (111) any bonds issued in connection with such Project or any monies due to the Government in connection with such Project remain unpaid, whichever period is the longest, the Municipality agrees it will not levy or impose any real or personal property taxes or special assessments upon such Project or upon the Local Authority with respect thereto During such period, the Local Authority shall make artual payments (herein called "Payments in Lieu of Taxes ") In lieu of such taxes and special assessments and in payment for the Public services and facilities furnished from time to time without other cost or charge for or with respect to such Project. Each such annual Payment in Lieu of Taxes shall be mado at the time when real property taxes on such Project would be paid if it- were subject to taxation, and shall be in an amount equal to either (1) ten percent (10%) of the Shelter Bent charged by the focal Authority in respect to such Project during the 12 months' period ending Sentrmber 30 before such payment 1s made, 6b /or (ti) the amount permitted to be paid by applicable state law in effect on the care such payment is made, whichever amount is the • lover The Municipality shall distribute the Payments i.1 Lieu of Taxes among the Taxing Bodies in the proportion which the real property taxes which would hive been paid to each Taxing Body for such year if the Project were not exempt from taxation bears to the total real property taxes which would have been paid to all of the Taxing Bodies for such year if the Project were not exempt from taxation; Provided, however, that no paynent for any year shall be made to any Taxing Body in exress of On amount of the real property taxes which would have been paid to such Taxing Body for such year if the Project were not exempt from taxation Upon failure of the Local Authority to cake any Payment in Lieu of Taxes, no lien aga.nst any Project or assets of the Local Authority shall attach, not shall any interest or penalties accrue or attach on account thereof 4 During the period commtncing with the date of the acquisition of any part of the site or sites of any Project and continuing so long as either (1) such Project is owned by a public body or governmental agency and is used for low -rent housing purposes, or (ii) any contract between the Local Authority and the Government for loans or annual contributions, or both, in connection with such Project remains in • force and effect, or (iii) any bonds issued in connection with Duch Project or any monies duo to the Government in connection with such Project remain unpaid, whichever period is the longest, the Municipality without cost or charge to the Local Authority or the tenants of such Project (other than the Payments in Lieu of Taxes) shall: (a) Furnish or cause to be furnished to the Local Authority and the tenants of such Project public servicen and facilities of the same character and to the same extent as are furnished from time to time without cost or charge to other dwellings and inhabitants in the Municipality; (b) Vacate such streets, roads, and alleys within the area of such Projec� as may be necessary in tha development thereof; and convey without charge to the Local Authority such interest as the Municipality may have in such vacated areas; and, in so far as It 1s lawfully able to do so without cost or expense to the Local Authority or to the Municipality, r use to be removed from such vacated areas, in so far as it may be necessary, all public or private utility lines nd equipment; (c) In so far as the Municipality may lawfully do so, • (i) grant such deviations from the building code of the Municipality as are reasonable and necessary to promore economy one efficiency In the development and adminis- trntion of such Project and at the same time safeguard health and safety, and (11) make such changes in any raaff� of the site and surrounding territory of such Project as are reasonable and necessary for the develop- ment and protection of such Project and the surrounding territory; (d) Accept grants of easements necessary for the develop- ment of such Project; and (e) Ccoperate with the Local Authority by such other lawful action or ways as the Municipality and the Local Authority may find necessary in connection with the development and administration of such project 5 In respect to any Project the Municipality further agrees that within a reasonalle time after receipt of a written request therefor from the Local Authority: (a) It will accept the dedication of all interior st,teta, roads, alleys, and adjacent sidewalLs within the area ,f such Project, together with all storm and sanitary Dewar mains in such dedicated areas, after the Local Authority, at its own expense, has completed the grading, Improve- ment, paving, and installation thereof In accordance w.th specifications acceptable tom the Municipality: / J r / t/ (b) It will accept necessary dedication of land for, and will Grade. improve, pave, and provide sidewalks far, all streets • bounding such Project or necessary to provide adequate nccees thereto (in consideration whe eof the Local Luthority shall pay to the Municipality such anount as would be assessed agnlnst the Project Site for such work if such site were privately owned); These units once construct- ed would be owned, maintained, and operated by the local Housing Authority and leased to lower income households. The San Bernardino County Housing Authority has filed an application for the currently available units which propcses construction on scattered sites within the incorporated and unincorporated portions of the County It is estimated that 8 -10 units will be construoted on each site To date specific sites have not been proposed The site selection process will be completed in cooperation with City staff COOPERATION AGREEMENT Prior to HUD approval of the current application, Cooperation Agree- ments must be executed between the Housing Authority and all local governmental jurisdictions where potential housing sites are located. In general, the Cooperation Agreement Indicates the City's support for public housing development. There are questions remaini,ig as to the ap- plicability of the funding program to the proposed project and inter- agency coordination will be difficult if a grant is obtained. The only method of answering many of these questions is to take the first step to obtain a better assessment. On the issue of inter- agency coordination, it should be • pointed out that the City cannot legally apply for this program by Itself. Federal and State law require a regional "subdivision of the State" to make application For this reason., it is proposed that Flood Control District will act as lead agency At this time, the District has not fully consented to act to the role of lead agency and has requested that the cities review the program to obtain Counc41 approval of the $2,000 allocation At the time each agency has com- mitted, the District and Board of Supervisors will review the program and prepare the necessary agreements To date, none of the cities has committed for funding. I wish to inform you of my latest activities and discussions and to request a more formal statement of Interest on the part of Cities in pursuing this project. Our review of grant and loan procedures with Bureau staff indicates the program will involve a substantial amount of "red tape ". The Corps of Engineers will review flood protection cost benefits and several depart- ments of the Bureau will have application review input It occurred to us that these processing issues might better be coordinated by a local agency that has a number of experienced staff members We then decided to discuss the program with Supervisors Townsend and McElwain End S3n F,ernardino County Flood Control District staff District staff is experienced in dealing with the Corps and several of the proposed storm drains tie to existing District facilities We met with the Supervisors and Mr Dino D1Pietro. Agency 170 CITY OF RANCHO CUCAMONGA MEMORANDUM DATE: July S. 1979 TO: City Council E City Manager FROM: Lloyd Hubbs, City Engineer Bill Holley, Director of Community Services SUBJECT- LANDSCAPE MAINTENANCE DISTRICTS Attached for Council review is preliminary information developed for the proposed formation of Landscape Maintenance District No. 1 and Lighting District No 1 Attached are the list of the tracts to be included, the procedures for establishing the District under the Landscape and Lighting Act of 1972, preliminary cost data for maintenance of the District and pertinent correspondence with the Planning Commission and Ar '-my Committees. The tracts to be included in these Districts were chosen because they have not yet left the control of the developer and remain as me ownership This fact will facilitate the formation process • The attached memo on cost describes those methods of cost distribution throughout the District and gives samples of typical costs under each option This information was reviewed by the Citizen's Advisory Committees, who recommended a two phased approach. The Committees were strongly in favor of developing a parkway maintenance program, but felt that the program should be Citywide with approval of the taxing authority by ballot measure Prior to this action, the combined maintenance district for the recommended tracts was approved This is the Plan 2 option described in the attached memo from Mr. Holley The Planning Commission reviewed this proposal at its June 13, 1979 meeting and requested the additional information provided in the attached June 27 memo The Commission shared the concern of the Advisory Committees and supported a Citywide maintenance concept Tht Planning Commission will again review this matter at its July 2 meeting and should have a recommendation for Council at the time of the Council meeting ISSUES AhD ALTERNATIVE A great deal of concern has been voiced throughout the Community on the state of parkway maintenance. Notification of Property Comers All effective property owners will be notified of the Council hearing and in- tention to form the district 3. Preparation of the Resolution of Intention The Department will prepare a Resolution of Intention for City Council approval. 4. Preparation of District Yap The Engineering Division shall prepare a map showing the boundaries of the District, the lots to be assessed, and the relationship of the final tra•-t to the overall street pattern. S. Adoption of the Resolution of Intention The City Council will adopt the Resolution of Intention, setting a time and place for hearing protest against the District. The time and date for hear- ing protest mutt be set at least 10 days after the date of the Resolution of Intention 6. Posting Notice of Improvement The Engineering Division will prepare a Notice of Improvement The Engineer- ing Jivision will post this notice at intervals of not more than 300 feet along all streets within the proposed district. (At least three notices oust be posted ; The posting oust occur at least ten days prior to the time of the hearing of protests. 7 Publication of Notice of Improvement The City Clerk will publish the Notice of Improvement in the Ontario Daily Report and will obtain proof of publication. The notice must be published once, at least ten days prior to the time and date for hearing protest D. Nailing Notice of Improvement ® The City Clerk will mail notices to all property owners within the District ten days prior to the date of hearing. These tracts previously agreed to the establishment and maintenance of park- ways as a condition of approval. _ At this meeting, the Commissioners indicated that they would like further Information on the following issues: 1 Cost of maintenance of all parkways Citywide on a per lot basis. • 2 Uses for beautification funds versus maintenance district funds. 3 Methods available for annexation to the District CITYWIDE MAINTENANCE The staff is not able at this time to Precisely define •he ove all raintenace cost for a Citywide program because of the uncertai:cy • oarkway development, parkway development standards and the lack of a complete inventory of the parkways to be maintained. The staff is currently working on standards for parkway development making use of more exten.ive handscape elements to reduce planting and maintenance costs. It is expected that maintenance costs under the revised standards will be much lower than tl.e historical costs developed to date. Utilizing the current information and Ith a brief inventory of remaining parkways, it is estimated that per lot .urges Citywide would range from $50 to $60 per lot per year This is a sl' it reduction over the limited program proposed under Landscape District No 1 BEAUTIFICATION FUNDS Parkways within the City fall into three categories: 1 Improved parkways adjacent to existing tracts - not maintained 2. Parkes,,; abutting undeveloped land - to be developed 3 Undeveloped parkways adjacent to existing tracts. .0 �� ITEM "J" Y LANDSCAPE MAINTENANCE DISTRICTS June 27, 1979 Page 2 Beautification fees were developed to provide a funding source for the development of category 3, undeveloped parkways adjacent to existing tracts, and for development of special boulevards. These funds were not intended to cover maintenance cost The Beautification fees are not a predictable source of revenue and depend on the level of resi- dential developent within the City, tecause they will vary from year to year they will be used exclusively for construction. MAINTENANCE FUNDING No funds currently exist for the maintenance of parkway improvements and many improved parkways are currently being lost because of lack of care. Without development of future sources of revenue for maintenance, future tract improvements will also be lost. ANNEXATION TO DISTRICT 0 Included within the June 13, 1979 Council packet, was a detailed procedure for the establishment of Landscape and Lighting Districts This is the same procedure to be used in annexation to the Maintenann. District It is the intention of the staff to aggressively pursue District Annexations . when Landscape District No 1 has been completed Approval of these an- nexations will be difficult to obtain where the majority of the residents object to the District formation. ALTERNATIVES The City has four alternatives for funding of parkway oaintenance: 1 Maintained from general funds. 2 Establishment of Maintenance Districts through phased development and annexation 3 Development of Citywide tax for maintenance of parkways - requires election 4. Do not maintain landscaped parkways. Parkway maintenance cost will expand as development continues making funding with general funds impossible without sacrifice of other City services. Establishment of a Citywide tax should be pursued through election as soon as the parkway beautification program has been established. As a incremental step at implementing Citywide maintenance district. Alter- native 2 should be implemented to prevent loss of current capital investments. The established district will supply a living model of the Main- tenance District program to encourage other areas of the City to join. 3 The Districts will allow experimentation to establish precise maintenance cost and to develop cust effective maintenance programs REMIENDATION That the Planning Commission recommend the establishment of Landscape and Lighting District No. 1 as one encompassing district with costs distributed on a per lot basis. City Attorney indicated each year the City Council holds a public hearing to set the fees and anyone objecting to the fees has the right to protest. What he would like to see is the development of a plan that would ultimately include the entire city within a landscape mialn- cenance district. Chairman Hempel stated that it should be made clear which streets will be main- tained under the district to avoid confusion. He would also like to know the parameters and boundaries of the plan and whether or not the entire City will eventually be included. Because of the size ur the County and the resultant conflicts in priorities, response to requests for striping have not been satisfactory. The Engineering Division has obtained proposals from three contractors for the performance of striping services These contractors now do similar work for cities in San Bernardino, Los Angeles and Orange Counties. Analysis of the bids indicated that the firm of Safety Striping in Anaheim •` is la: bidder. This firm offers particularly good prices on certain strip- ing items comprising the bulk of our City's needs. Safety Striping contracts with the cities of Chino and Fontana as well as many Orange County cities Chino has used the firm's services since 1963 and reports very good perform- ance and response time. It is estimated that our City's striping maintenance cost will amount to $28,000 per year, allowing for same heavy wear areas to be restriped more than once a year. All costs of a striping contract would be costs which vould not be incurred under the annual maintenance contract with San Bern- ardino County and thus are not new costs. Information to Referral is provided both at our office. located in Ontario and at various Senior Nutrition sites, including the site located in Rancho Cucamonga. Additionally, the role of advocacy for the interests of area senior citiz ., is provided by this office. In raspons, to the request of agencies representing the needs of seniors of Rancho Cucamonga to appear at this evenings public hearing, I am going to present some obsarvations and suggestions for the allocation of Revenue Sharing Funds. These will be geared in the interest of the over 5,000 senior citizens of this city. 1 o .. • - . ) Transoortation was recently improved in the city with the operation of dial -a -ride which is greatly utilized by senior citizens. A note should be rade regarding bus transportation. Routs 14, which is the county -aide bas route, passes through the limits of Rancho Cucamonga. .his route providea nccess to the many facilities required of the elderly, dioibled and sicY. For this reason, *he route will soon offer lift- equippad buses to meet the needs of this special population. The contract between the City and Omnitrans is without mention of responsibility for the upkeep and improvements of bus stops. These are qtr.. 4 *TPPta and medians or parkways. A suggestion 2 i at this point would be the improvement of stops so that they would provide access to the specially equipped buses. A second suggestion for your consideration would be to implea@ita a senior discount on water bills collected within the city. General Revenue Sharing Funds could be used to augment this sort of program therefore aiding seniors on fixed incomes while not losing the income to the agency. The amount of the discount could be discussed by the council, a suggested amount is 100'. The idea of water bill discounts to not new in the West End and should be considered by the City Council of Rancho Cucamonga. The preceding suggestions received the approval of the nest Valley Regional Council on Aging. Representatives of Senior Citizens clubs in Rancho Cucamon3a sit or, this board. Cecilia b:artinez and Kathi Guayante are those representattres. Additional membership includes boar"_ members of the American Association of Retired Persons' local chapter. It is hoped that those suggestions will be given serious consideration. Too often, the City of Rancho Cucamonga is claimed to be a "young city" because of its recent incorporation and popula- tion exoloaion. Take this opportunity to rocognize the needn of the older .citizens of thin area and to show appreciation for their early accomplishments which benefittod this area. Wasserman City Manager SUBJECT: Citizen Petition for Paramedics The city has received a petition with 59 names requesting the city council to provide revenue sharing funds to assist the Foothill Fire District in esta- blishing a free paramedic service similar to that provided by Los Angeles County We have a nieber of proJlems with the request First of a't, it is questionable whether the city should be involved in the affairs which are appropriately handled by the Foothill Fire District Secondly, there are some serious problems with paramedic services They are expensive snd they also generate substantial labor relations problems for fire departments which are involved to the prograe.
