DESCRIPTION OF IMPROVEMENTS SECTION 2. (a) The Improvements are generally described as followss The construction and acquisition of drain- age improvements together with appurten- ances and appurtenant work, acquisition of interests in real property, if necessary, and incidental expanses in connection therewith The Improvements shall be located in certain public struts and rights -of -way in the Assessment District. For further particulars, reference is hereby made to a Map of the Assessment District previcasly adopted. (b) The struts, rights -of -way and easements shall 1w shorn upon the plans hereln'referred to and.to be filed with these procudings. (d) The description of the Improvements and the termini •• thereof eontainod in this Resolution are general in ' - nature. The Improvements do not necessarily extend ^ for the full length of the description thereof. The plans and profiles of the Improvements contained in the Engineers Report shall be controlling as to the correct and detailed description thereof. (a) - Whenever any public way,is herein referred to as - - running between two public ways, or from or to any - public way, the intersections of the public ways are included to the extent that Improvements to be done k 41 therein are shown on the plans. > (f) Notice is hereby given of the,fact that in many cases ' the improvements will bring the finished grade to a - - ^ grade different from that formerly existing and, to that extent, the grades are hereby changed and the ^ - Improvements will be done to the changed grades. The Improvements are of� direct benefit to the properties and land within the Assessment District and the city hereby makes the costs and expenses, of the Improvements y {{yy r �4 f;a' chargeable upon the Assessment District which is hereby declared to be the assessment District benefited by the a` Improvements and to be assessed to pay the costs and expenses of the Improvements. The Assessment District is described as ` follows; All that territory in the Assessment District ••• included within the exterior boundary lines shown on the Nap exhibiting the property benefited by and to be assessed to pay the costs and expenses of the Improvements in the Assessment District, which Nap is titled and identified as "PROPOSED BOONDMES OF ASSESSNEWT DISTRICT NO. 86 -2" and which map was heretofore approved and is on file with the transcript of these proceedings, EXCEPTING from the axes shown within and delineated upon the Nap, the area of all public struts, public avenues, public lanes, public roads, public drives, public courts, public allays, and all easements and rights -of -way therein contained - belonging to the public. For all particulars as to the boundaries of the Assessment District, rsfer- once is hereby made to the Nap and for a complete description of the assessment Diatrict, the Nap on file shall govern. REPORT OF ENGINEER ` SECTION 4. The proposed Improvements are hereby referred to the Engineer of Work who is directed to prepare and file a written report (the "Report ") which shall contains (a) Plans and specifications of the Improvements; 'tV (b) An estimate of the cost of the Improvements, including the incidental expenses in connection therewith; (o) A diagram showing the assessment District and the boundaries and dimensions of the respective ;n 4 n E 0 subdivisions of land within the Assessment District, as the same existed at the time of the passage of the Resolution of Intention (the "Diagram "). Each sub- division shall be given a separate number upon the DiagramA (d) An assessment of the total amount of the &***usable costs and expe.ses of the Improvements upon the several subdivisions of land in proportion to the estimated benefits to be received by such subdivisions, respectively, from the Improvements (the "ASeessment "). The Asse2esent shall refer to the subdivisions upon the Diagram by the respective numbers thereof! and (a) A description of the Improvements and acquisition of interests in real property, where necessary. When any portion or percentage of the cost and expenses of the Improvements is to be paid from sources other than assessments, the amount of such portion or percentage shall first be deducted from the total estimated costa and expenses of the Improvements and the Assessment shall include only the remainder of the eatiaatsd costs and expenses. BONDS SECTION 5. Notice is hereby given that serial bonds (the "Bonds ") to represent unpaid assessments, and bearing interest at the rata of not to exceed the currant legal maximum rate cf 12% par annum, will be issued pursuant to the "Improvesent,Dond Act of 1415 ", being Division 10 (commencing with Section $500)' -- a ,'';A_ of the Streets and Highways Code of the State of California. ji 5 -rRt. i The last installment of the Bonds shall mature a maximum of and not to excoed nineteen (19) years from the second day of Ssptember next succeeding twelve (12) months from their date. The provisions of Part 11.1 of the Streets and Highways Code, which provides an alternative procedure for the advance payment of assessments and the calling the Bonds, shall apply. The principal amount of the Bonds maturing each year shall be other then an amount equal to an even annual proportion of the aggregate principal of the Bonds, and the amount of principal maturing in each year, plus the amount of interest Payable in that year, will be an amount that is approximately equal each year, except for an adjustment in the first years ir a. assessment. c w �4 4 SECTION 7. Tltl• of Sonde. The determination not to advance lawfully available funds to cure deficiencies in the Redemption Fund shall be clearly stated in the title of any ^� Bonds issued ropresanting unpaid assessments, pursuant to section 8769 of the Streets and Highways coda. i BOND RLDENPTION SSCTION e. The city council elects that the Bonds, upon redemption prior to maturity, shall provide a premium of five 6 �r • pereant (5Z) on the uematured principal and that language shall be added to the redemption clause in the bond fora to require (. the property owner to pay the premium in order to discharge the obligation of the lien prior to maturity. SFSCIAL MD SECTION 9. The City Council establishes a special fund x Yt designated ' IMPROVEMENT FOND 7OR ASSESSMENT DISTRICT NO. 06 -2 into which moneys may be transferred at any time to expedite the construction or acquisition of the Improvements. He has been providing services to the - community since 1977, and during that time has made an effort to respond to the needs of the City of Rancho Cucamonga and its citizens. Admittedly, his business is not as large an operation as some of the �• large refuge companies that are now finding an interest in the Rancho Cucamonga area, but he has been interested in the community and has been t ready and willing to serve its members and wet their needs for some time now. In the later part of August, 1986, Mr. Rosta was notified by the City Attorney that the City had awarded ccumercial refuge collection franchises pursuant to Municipal ordinance No. 291, and the notice mandated that he cease his operations as of Cctober 1, 1986 and discontinue services that he had been providing to this community on a consistent basis for many years. He had not been aware, previous to that date, concerning public notices or hearings regarding the awarding, of commercial refuge collection franchises or he would have -donu. whatever would have been necessary on his part to do in order to be included among those businesses that were to be considered for ,this purpose. As you may be aware, if Mr. Rost& is required to termigat* hie% services to the community it will effectively put him out of business. It is a ah tme that a community that he has worked w hard to &sew for so many year& finds it necessary now to turn on him and demand that he get out nf the area so it,can now to award contracts to large ccnglomerate enterprises whose only interest is to overshadow the small busineua'an and pursue the profit dollar. In light of the fact that Mr. Rosta has been &erving the community for so many years Cow, we believe that Health andi Safety Code Section 4272 protects his interests in serving the community for a minimum of five {5) p additional years. However, we find }t quite unbelieveable that the �- City will now turn a deaf ear to a small businessman who has tried to provide quality service to its community members for so long in the past without allowing him a small amount of additional time to submit the necessary paper work to attempt to qualify ti■ business as a franchise operation. �s ; With that in mime, we are at this time requesting that your office permit our client additional time in which to,process the necessary paperwork �i forapplication.ss a commercial refuge collection franchise. Hr. Rosta recognises that he will have to comply with the provisions of the appropriate Municipal ordinance and other contract requirements in ? order to qualify me a franchise operator, and it is his desire at this . Ordinance No. 307 Dear Mayor Stout and Councilmemberss As I understand it, Ordinance No. 307 is scheduled for a second reading at your meeting of 4 February 1987. There are a number of questions which I pose in this letter and ask that you answer for yourselves if not for others. I do not expect a personal reply. Ordinance No. 294 was more thrr two years in the making. It was debated by the fifteen members of the Citizens' Advisory Commission (CAC) at least fifteen different times in varying degrees. It was discussed more than once by a joint committee of the CAC and the City Council. It was further discussed at a meeting of the full CAC and City Council. All together it would be conservative to may that more than four - hundred hours of individual time was contributed to this effort by CAC members, staff and City Council members. Ordinance No. 294 was enacted by a unanimous vote of the City Council. This means that Councilmembers Buquet, King and Wright voted in favor of it. It bocame effective 17 October 1986. The ink had scarcely dried on the Ordinance when the City Council appointed a sub - committee to consider revisions to the Ordinance I am informed that this sub - committee consisted of Councilmembers Buquet and Brown. Why was an Ordinance which was so pai- vtakingly drafted with such widespread contribution never given an opportunity to work? Why were the two chosen sub - committee members the combination most likely to produce a change recommendation to the carefully drafted but untested ordinance? When Ordinance No. 294 was recommended to the City Council by the CAC, it was accompanied by a CAC resolution which explained in great detail the history and philosophy behind the CAC. It described the "two-tier" government promised at the time of incorporation. It further reviewed the promises of maintaining the identity of the three communities. It explained the factors which led to the formation of the CAC and the historical basis of its role in city government. Was this background considered? Was councilmember Brown provided with a copy of this resolution? Are you rejecting the two -tier concept entirely? Are you discarding the individual identity commitment or beginning to do so? Section 3 of the proposed Ordinance No. 307 makes slight alterations to the first and third pa *agraphe but essentially deletes the entire second paragraph. The second paragraph provides most of the basis for the CAC creating its own agenda. Of course, this practice developed by default when prior City Councils refrained from asking the CAC to perform any services of any consequence. However, the practice was very healthy for the City and encouraged the entertaining of new and different ideas. The elimination of this paragraph has a strong appearance of discouraging the CAC from seeking out such ideas and from entertaining new and different ideas unless they come from the City Council or the Planning Commission. Before the CAC developed its own agenda (which it does with a logical, fair and sensible procedure), it could have bean considered an issue- receiving institution and never an issue - generating institution. As such, it was a receptacle on which hot issues could be dumped (fireworks, trash) but it was not perceived as a political problem of any kind by City Council members. Are you deleting the middle purposes paragraph to discourage the CAC from pursuing ideas that do not come from the Council or the Planning Commission,. If not, what is the purpose of deleting this paragraph? The CAC has not failed to achieve a quorum more than once in three years. Attendance probably averages in excess of two - thirds and perhaps close to three- fourtbs. I, for one, do not recall missing a session while I was a member of the CAC. The number fifteen did not make the meetings unwieldy. Tnere is no member of the CAC who would say that they were restricted from presenting their views by the size of the body The size of the body was considered important to its abilit% to be n grave routs organization and to reach into the ,immunity in as many places as possible. Other than a miniscule savings in postage what is the reason for reducing the size of the G1C? A reduction in size is certain to result in a reduction In !cs grass roots function and will probably result in a reduction of its overall impact. Is this what is intended? The CAC wag appointed entirely by district. The now ordinance almost completely eliminate$ that practice. The incorporators of Rancho Cucamonga promised us that our three communities would nave; lose their identities. The elimination of the district base of the CAC will certainly constitute a very big atop in that direction. The CAC never made a decision which was based on any kind of community riva ry or division. All fifteen members worked together° for _he benefit of all three historic communities. Of all the policy makers and advisors in Rancho Cucamonga city �•, government, very few are from old Etiwanda. Your new proposal will reduce old Etiwanda's participation in city government to practically nothing. You may recall that Etiwanda voted in favor of incorporation. Is the now ordinance a first big step toward elimination of the separate identity concept? If so, isn't the now ordinanco a breach or partial breach of these promises? If you are concerned about the residents of Victoria and Terra Vista, wouldn't it be simpler to say that one Cucamonga CAC member must be from Terra Vista and one Etiwanda CAC member must be from Victoria? These numbers could be shifted as the population shifts. Your nomination subcommittee in Section 4 is rather valuely worded. What is the purpose of this nomination subcommittee? What is thu nature of the recommendatiot it presumably makes on ever%, person 'proposed for appointment.` Who proposes for appointment? Will it no longer be permitted to apply? You have shortened tho terms of the CAC members from three years to two years. One obvious result of this reduction will be to make the terms end with Council terms. one obvious result of that will be to make the CAC more politically sensitive, less independent and less likely to raise volatile issues. This interpro_ation is consistent with the elimination of the second paragraph of the purposes clause and the following two paragraphs. ordinance No. 294 provided that terms expire on December 31, 5 but that nemi`ers serve until their eucceasors are appointed. The proposed ordinance deletes the latter portion. If the CAC is doing something which the City Council finds lens - than desirable, an effective tool which can be implemented by omission rather than act is to simply refrain fron appointing successors.
