As the City Council is avarep during the pact year, the City contracted with the
County of San Bernardino to pro,ide approxi"taly 925,000.00 for additional
Library service@ at the Rambo Cutuswags Breneh Library. While all cervices
have been perforaad as spread to by the County and the City, the Ccuaty had not
taken for t action, an the contract docuaent itself. The attached contract has
bear reviewed by the City Attorney and retyped in the County format. We
tecoanand its approval. This will formalise the relationship which has been
working for approxiaarely one year,.
It is significant to note that a separate contract will be provtd�d for fiscal
year 1908$9. This will ensure eantinietion of extended hours at the library as
wall as inerepaing the circuintian to the highest degree possible.

Contract between the City of Rancho Cucamonga and the County enables the City to reimburse
the Library for maintenance and utility costs not to exceed $25,OOC.00 during 1488. in
Exchange, the Branch Library will be open each Sunday for four hours, and the book
collection increased by $15,000.00 and additional grants sought to tuild the collection
• The City of Rancho Cucamonga has grown dramatically in the ten years since it was
incorporated The book collection which seemed adequate then has bean increased, but
not at the rate of the population growth. The natirnal average is twi books per capita.
In Rancho Cucamonga that average is .5 boots per capita. This contract was developed
with the City of Rancho Cucamonga and the Library staff to enhance the book collection
and to extend the operating hours of the branch to make that collection more available
to the public. The contract is for the current year only. The books are to be retained
in the collection.

This Agreement is made and entered into by and between the COUNTY OF 0
SAY BERNARDINO (`County' hereinafter) and the CITY OF RANCHO CUCAMDNGA ("City"

A. Recitals.
(f) County now owns and operates a branch library on a site adjacent
to Lions Park Caamunity Center, 9191 Base Line Road, within the City of Rancho
Cucamongd (hereinafter referred to as the 'Rancho Cucamonga Brancn.')
01) It is the mutual desire of the parties hereto to enhance the
resources and services available to the public at the Rancho Cucamonga Branch on
the terms specified herein.

which County agrees to deliver at the Rancho Cucamonga Branch specified in `

. paragraph 2 hereof, City agrees to reimburse County for County's costs of
`- electrical, gas, water and telephone ('utility costs' hereinafter) incurred at
the Rancho Cucamonga Branch during fiscal year 1987 -88 (July 1, 1997 through
and including June 30, 1988) to a maximum of $25,000.00. In that regard,
County shall suPPIY to City an accounting of all such utility costs incurred by
County at the Rancho Cucamonga Branch as soon as is practicable following
June 30, 1986. City shall provide the above - referenced reimbursement thereof,
up to a maximum of 525,000.00, within thirty (30) days of City's receipt of
said ac.ounting.
2. In consideration of City's reimbursement obligations set forth
In aaragraph 1 hereinabove, County shalt:
A. Maintain the Rancho Cucamonga Branch open through June 30, 1988
during all hours it now is normally open and add four hours on each Sunday
during which the Rancho Cucamonga Branch will be open to the public commencing
immediately and continuing on each Sunday thereafter through and including
Sunday. June 26, 1988;
b. Augment the Rancho Cucamrnga Branch's permanent reference
section in an amount of $15,000.00 prior to June 30, 1988 and maintain said
augmentation permanently at the Rancho Cucamonga Branch.

Brsnch s new books and materials by an amount of $20,000.00 immediately and y
seek an additfonal grant from an outside agency in an amount of $5,000.00 for

a The materials referred to in subparagraph 2.b above shall be
chosen and determined .hrough a cooperative effort of County through its

5. County shall and hereby does agree to indemnify City and City's
elected officials, officers, employees and agents and agrees to save And hold each
of them harmless from any and all claims, actions. causes of action and damages.
including court costs and attorneys' fees related thereto, in any way arising out
o" or connected with the operation and maintenance of the Rancho Cucamonga Branch
to the maximum extent pemi:ted by law.
WHEREFORE, the parties hereto have entered into this Agreement as of the
dates set forth below opposite the name of each such party.

BACKGROUND: When the Project Area was established in fiscal year 19e2/83 the

debt as wall as provide monies to operxte. For debt purposes, tlt Agency has
continued to maiitain a tun from the City so that tax Increment can be
received by the County. Each fiscal year the Redevelopment Agency pays the
loan back to the City, including interest, with tax increment revenues which
are received after paying all debt on bands and agreemeito. Authorization for
this repayment took plate at the Redevelopment Agency moating of June 15,
1988.
EVALUATION: During fiscal year !987/08 the Agency paid to the city a total of
33 .-78 toward. the rrincipal and interest on the loan. At the present
time it .s nec3ssart for ,he Agency to Continue the loan witn the City in
order to show debt for receipt of tax increcent revenue. Therefore, it is
necessary for ;he City Council to authorize reloaning t _ money to the
Redevelopment Agenry.

BACKGROUND: .n fiscal year 1986/87 a neighborhood contervation
program was established by the Agency. This program targets
revenues received by the Agency in its Affordable Housing Fund 21
for use in Improving the supply of affordable housing within the
community.
A housing study was prepared and specific capital improvement
projects were Identified which would benefit affordable housing
neighborhoods. These capital improvements consist of Irnstdlling
storm and flood control improvements, street improvements and
other publi,, improvements that are either missing or In need of
upgrading. In doing so, the Agen:y is able to maintain the
community's 'existing supply of affordable housing as well as cur±
some of the health and safety problems which these neighborhoods
are experiencing.
Two projects have been initiated by the City, the Baker /Arrow
storm drain and the Area VII (NOrthtown) storm drain. These
projects are nearing completion and should significantly improve
the flooding conditions that have existed in the neighborhoods In
the past
EVALUATION. Due to the filing of a lawsuit from the Western
ente��r Law and Poverty callenging the use of the funds for
these types of Improvements the Agency and the city established a
reimbursement progrem In order to proceed with the much needed
pr•ijects. Should the lawsuit be resolved in this flseal year the
Age,,/ should be in a position to continue funding the qualified
projects identified by the housing study. In order for this to be
accomplished it is necessary to amend the Reimbursement Agreement
pertaining to the neighborhood conservation program for fiscal
year 1988/89

In the upcoming, fiscal year the Agency anticipates revenues
available for the Qualified neighborhood conservation, project to
be $5,351,000. In order to be able to identify this amount of
revenue as a debt of the Agency, the Reimbursement Agreement must
be amended to show this amount as being available and rrimbursable
to the City. It -must be emphasized that no neighborhood
conservation projects rill be.inttiated by the City which are
dependent upon the Agency's reimbursement until after the lawsuit
is resolved.

WHEREAS, the City of Rancho Cucamonga, California (the 'City ") is a
party to the Joia Powers Agreement Creating the California Municipal
Insurance Authority, dated May 21, 1986, (the "Joint Powers Agreement') and as
such is a Member Entity of the California Iunicipal Insurance Authority
?, ( "CHIA "), as that term is def'ned in the Joint Powers Agreement; and
WHCREAS, pursuant to the Joint Powers Agreement, the City - ?,as
+ appointed Jim Hart to serve as its representative on the Board of Directors of
t CHIA, but the City has not appointed a person to serve as its delegate to
meetings of the Member Entitles of CHIA; and

g WHEREAS, the Executive Committee of the Board of Oireeters of CHIA
v has determined that it is in the best interests of CHIA to convene a fpetial
meating of the Member Entities, as provided by the Joint Powers Agreement Lnd
the Bylaws of CHIA, and has requested that the City appoint a person to serve

1. Council adopt attached Resolutions adopting the fiscal year 1988/89 Budget
and setting the Article X118 Apprspriations limit.
2. Council adopt the Resolution relating to Salary Rang,is and Benefits for
all full and part -time employees for fiscal year 1988/89.
84CKGROUND:
On June 15, 1988, in advertised public hearing was held to receive input from
the general public with respect to the 1988/84 Preliminary Budget. At the
conclusion 1)f the public hearing, there were no issues presented which
required further Counctl direction to staff. All concerns expressed by
Council to staff have been addressed and amendments to the preliminary budget
have been made based on Council direction.
The State of California Constitution, Article XIIB, requires that an
appropriations limit be established annually by the City Council. The factor
used to develop the appropriations limit is the C.P.I. change, and change in
City population.
The index we are required to use for Gann Limit calculation changes from March
198/, to March 1988, by 3.93, and the population change was 17.97. This gave
the City a total factor of 1.2229 to apply to the 14,058,803 limit set for FY
87 -88 The City's FY 88 -89 limit is $17.192.5I0. -
Approval it also regiested for the 1988/89 salary ranges and benefits package
submitted pursuant to Council direction.

(GAS TAX, AND OTHER SPECIAL PURPOSE FUNDS, AND
ADDITIONAL APPRGPRIATIONS3 FOR FISCAL YEAR
1988 -89.
WHEREAS, the Rancho Cucamonga City Council held workshops to review
the appropriation requests for the FY 1988 -85, and
WHEREAS, the Rancho Cucamonga City Council held a public hearing on
the General City Budget; and
WHEREAS, this public hearing was published in a newspaper of general
circulsticn and held on June 15, 1988.
NOW, THEREFORE, HE IT RESOLVED by the City Council of the City of
Rancho Cucamonga, California, in special sessiun assembled this 28th day of
June 1988, as •ollows:
SECTION I: ADOPTION OF 19A8 -89 BUDGET. The City of Rancho
Cucamonga Budget for the fiscal year 988/89, on file 1n the office of 'the
Assistant Finance Director, is hereby adoptrd in the +mount of SSS,988,697.
This budget total includes appropriations for other special purpose funds.
The City Council of the City of Ranchr 'ucasonga may transfer funds between
funds or activities set forth in tnz in.. ;at. The City Mcnagtr may transfer
funds between appropriations within an appropriation as set forth In the
budget and may transfer appropriations between activities within any fund.
SECTION 3: TRANSFERS OF F�IIDS __8EVEEN FUNDS. Transfers of funds
between funds as shown on the Fund psis shall ue made as expenditures
warrant such transfers.
SECTION 4: DISBURSEMENTS, The City Manager and the Administrative
Services Director, or his duly designated representative, are hereby empowered
and authorized to disburse funds pursuant to appropriations irov'dpd for in
the 1988 -89 budget, and have the responsibility to establish procedures and to
administratively implement and control budget on all matters, except direct
expenditures by Council members which require Council approval.
SECTION 5: ADDITIONAL APPROPRIATIONS. The City Council may amend
this budget to add or delete appropriations.

WHEREAS, pursuant to said Article mrs of the Cons.it•_tlon of the
State of Cdlifornia, the City Council of the City of Rancho Cucamonga deems it
to be in the best interests cf the City of Rancho Cucamonga to establish an
appropriations limit for the Fiscal Year 1931 -89; and
WHEREAS, the Assistant Finance Director of the City of Rancho
Cucamonga has wetermined that said appropriations limit for the Fiscal Year

SUBJECT: Consid•.ratfon of Ilse of ^ -dnent Domain for Fire Station
Sites at the following locatt.,.,
" Vicinity of Baseline and Roctsster
• Vicinity of Milliken and Arrow highway
• Vicinity of Banyan and Milliken
We have been attempting for approximately 18 months to obtain
properties foi the Foothill Fire District. Contacts and negotiations
with nearly 40 property owners have been attempted on a "willing
seller" basis. Further, the three sites must correlate with each other,
to provide comprehe:,sive response without overlapping service
areas. In coope - lon with the Fire District, we have worked
through several "founds" of complementary sites, due to the
impracticality of obtaining various sites owned by large corporations
such as General Dynamics. Unfortunately, the great majority of the
property owners were 1141 interested in selling their land. The one
escrow we were able, to open was cancelled n: the last minute by the
sellers.
The FFD has determined a critical need for the new stations due to
our rapid population growth, and they have done extensive time -
response studies to ensure adequate fire protection city -wide. The
three sites listed above do complement each other, without
overlapping boundaries, and their need is obvious. A map of these
Fire Station areas is attached. c1
Summaries on the current status' of these sites are also attar
for your review. Similar updates were reviewed by the Fire
District Board oa June 91h, furtL -- acquaint them with the efforts
of the Redevelopment Agency in thl, acquisition process.
Due to the lengthy legal process involved in eminent domain
proceedings, Agency Counsel feels we would be wise to initiate lite
schedule of required actions now, This process would begin with an
official appraisal, by a qualified appraiser. Frequently, just staving
the appraisal done assures the owner of the Agency's serious
interest, thereby furthering negotiations. Once the appraisal is
complete, a formal Offer to Acquire is made to the property owners,
who would then have 30 days '. accept or reject the offer.
Hopefully, purchase escrows could be opened at that point.
Meanwhile, though, we would be proceeding with rite remaining
legal steps in the procedure, should the property owners choose not
to sell. Agency Counsel eras prepared an overview of the eminent
domain process apd schedule as an additional reference.
Since the Agency and Foothill Fire District have now exhausted the
options for 'willing seller' acquisition, it becomes necessary to
consider utilizing eminent domain proceedings to either prod the
negotiation process or to conclude legally, die sites in question. Just
as school districts utilize eminent domain to acquire needed school
sites, the Agency must consider this option if it is to provide
expanded fire pectection services.
Recommendation: That we formalize our acquisition process by
chtainmg MAI appraisals on the chosen properties in the vicinities
of
• Baseline and Rochester
• Milliken and Arrow highway
• Banyan and Milliken
Secondly, that Staff be authorized to take the necessary steps to
adopt a Resolution of Necessity, should our attempts to acquire the
properties under usual California Redevelopment Law procedures,

Vicinity of Baseline and Rochester
Current Situation: Property owned by the Ou's was to have closed
escrow on May 31, 1988. On that day, the sellers cancelled the sale,
citing an 'emotional attachment" to the property. it apparently was
not a ploy for more money
As a result, we re- contacted another property owner in the area,
increasing the urgency of our tone regarding their land. They have
been exceptionally unresponsive, even after our Acquisition Agent
spoke with them.
Time Frame: Our preferred course of action would be to begin the
appraisal process and mov., to mom formally acquire the Ou
property. This property was chosen becaeso we.. have a relationship
established with them, and they had been Interested in selling
previously Further, a friendly condemnation had been arranged
with them.

Station 4 - Phase One•
Milliken and Arrow Highway
Golleano Property
Current Situation: The entire parcel is 52 acres, of which we need
8 -10, with 250 feet of frontage on Arrow. This would accommodate
Station 4• and also the Training and Maintenance Facilities to be
built as part of Phase Two. It has been re -zoned from Heavy
Industrial to General Industrial, having the effect of enhancing their
property value.
The problem now needing resolution revolves around the railroad
easement for their Santa Fe spur line, which belongs to another
party The Galleanos mus! develop the property as rail - served, so
they must acquire the easement, and have requested the
City /Agency's assistance. Because of a past private dispute, these
private parties may have difficulty in determining a mutually
acceptable value. We have been working on a plan to have the
easement donated to the Community Foundation, and thereafter be
purchased by the Galleanos. The owners have agreed to the logic
and costs of extending Vincent Ave. to Arrow Highway, but again we
encounter the ptoblem of the railroad easement as it would extend
into the new right -of -way
To develop the site for use as a Fire Station, required public
improvements and utilities would have to be brought to the site.
This, of course, would save the property owners the significant
expense of doing it themselves. They am aware of this advantage,
and we will use it as a bargaining point when negotiating the
purchase price of our parcel.
Time Frame: Overall, though, we are causing them to
consider the development of their land sooner -ban they prefer
However, they recently agreed to purchase the easement and come
to -is with an offer by mid -July They have even hired a new
engineer to re- design their circulation plan and parcel sizes.

AlternWlve Station 4 Site: Santa Fe (Land Improvement Co.)

been unwilling to discuss a sale because their company was
undergointl :i reorganization. We now have a new contact person, so
will renew our efforts with theta. This provides s good alternative

Station 5 - Phase One
Milliken and Ba-ayan (proposed)
Flood Control Property
Current Situation: FFD has requested development cost estimates
for this site and comparison costs to other sites, to determine
suitability In a recent meeting with architect Lary Wolfe, Shinto,
Bill Silva, Cindy Hackett, Bob Corcoran, FFD, and two representatives
from Ahmanson Development, we decided on this course of action
the architect wants the berm graded a, d the debris basin moved
northeasterly to allow for better fire truck access. This is also
deemed necessary to produce the largest percent of useable plot.
Ahmanson has agreed to redesign and construct this temporary
structure as requested, in return for the City or Flood Control
District's maintenance thereof.
In speaking with the Flood Control rep, they are willing to provide
maintenance in exchange for a deposit, sufficient to cover demolition
of the basin when needed. Their logic was to use the interest
generated from th., deposit to reimburse them their maintenance
costs. Ahmanson is obviously hopeful of deleting this cost to their
project. It would become an item of negotiation when we move to
acquire the parcel. In fact, we may be able to trade off respons;bilfty
for maintenance of the channel access flange we had planned to do.
Besides the cysts of site development, FFD Is also concerned with
access to Nett cn via Banyan. For this direct access, Banyan would
ha-.,e to '.n: paved to support the weight of the fire trucks in wet
weather Planning and Shinto are quite sure that proposed
dcv_topment west of the site would solve this problem within 18 -24

A detailed cost report should be ready for the Fire District this week.
Preliminarily, the Engineer states that the 4 Smanson group's
development will solve major problems of developing the site.,
causing only minor inconveniences and cost consequences.

RE: Procedures for acquis.tlor of property -
eminent domain
Pursuant to your request, the following memorandum
outlines the bau)c procedures and approximate timelineo for the
City to acquire the use of property in a condemnation action.
The following summary is based on the assumption that the city
needs to acquire pousesaion of the property as soon as
possible. such Trocedures are as follawat
1. Obtain an appraisal of the real property in
question. (Approximately 2 - < months.)
2. .'Based upon the apprais,' valuation data, the
City must Nil to the property owner :ormal offer to
purchase.
3. Concurrently with the mailing of the offer -
letter, Bet a public hearing for the City Council to determine
the necessity for eminent domain and mail the property owners a
notice of public hearing. Beo..uoo such notice must inform the
property owner of their right to supply writtor, comments to the
city Council prior to the public hearing, this notice and th,3
letter of offer should be mailed twn or throe weeks prior to
the into of the public hearing.

use of the property prior to final judgment if the condemnor
deposits full probable Compensation (as shown by the appraiiial
valuation) into court. In the case of nonresidential property,
the date of pro- judgsont possession may bt no sooner than
thirty days following the execution of the pre- judgment order
by the court and,'in the oase of residential property, no
sooner Shan ninety days after the order. It should be noted
that it these pre - judgment possession procedures are vigorously
contested to the full.oxtent as allowed by the Eminent Dosain
Law, the above - referenced time periods will be extended.
7. If pie- judgment possession is not sought, or for
any reason not granted by the court, processing of the full
case to a final judgment would tie cpproximately one year after

The City shall provide a health insurance plan for all full time
rontlnuou3 salaried employees and elected officials. The City t roes to pay

It is recommended that the City contract with the firm of Joe A. Gonsalves 6 Son
of Sacramento to provide professional legislative representation on behrl£ of
the City. Cost for this legislative advocac7 is $2,000.00 per month. Funding
e is recommended from proposed salary savings resulting from the reorganization
within the City Manager's office beginning with the nest fiscal year. If City
Council does not concur with the recommendation of the City Manager, the funds
will be retained as originally budgeted in the preliminary budget. Specific
authorization from City Council will be requirad in order to spend those funds.
The primary reason for this recommendation is that it is our experience, hate in
the City, that the League of California Cities does an adairnble job
reprecenticg the interest of the cities{ however, there are many uses,
particularly with newly incorporated communities, whore special legislation has
been proposed which impacts our community. while the League makes every effort
to respond to our needs, the workload is such that, at times, the City rat fend
for itself The stakes are high enough that the expenditure of funds is, in our
view, warranted in order to make certain that our voice is heard in Sacramento.
As , part of the legislative representation$ Joe A. Gonsalves L Son will •zvsce,
all bids introduced into the California Legislature, and will inform no City
of any legislation which may impact the City. Ihis will include not caq
typical City issues, such as tax natters and other financial issues, but also
items misted to aoud Waste and racyciing, which have become a high priority in
our community. Staff Will continue to work with Gonsalves, a. veil as the
League of California Cities, to make certain that the City's official positron
has been noted with the Legislature.
The terms of the agreement shall begin an July 1, 1988, and shall continue
until terminated by a 70 day written notice by either party to the other.

This professional legislative representative has had considerable experience
representing cities in California. it in significant to note that Mr.
Gonsalves, and his son Anthony, also work very closely with the League of
California Cities' representatives an: the California Redevelopment Association
legislative advocates on isruas effecting our community.
tt should also be noted that during the past year, Hr. Anthony Gonsalves has
worked with the City of Rancho Cucamonga on the "go and Low Property Tax" bills
which impact Rancho Cucamonga. Mr. Gonsalves represented a cumber of other
cities, which were also impacted by the bill.

AND THE CITY OF RANCHO CUCAMONGA
The City of Rancho Cucamonga wishes to engage the services
Of JOE A. GONSALVES i SON, 925 L. Street, Suite 205, Sacramento,
California, to provide services in legislative advocacy and
governmental affairs in matters affecting cities in California.
The purpose of this agreement is to state the terms and
y conditions under which JOE A. GONSALVES L SO4 will provide
services to the client, the City of Rancho Cucamongi.

The terms and conditions of this Agreement are as followse
1. JOE A. GONSALVFS G SON shall review all bills
introduced in the California Legislature and
inform the City of all such legislation
affecting the City's interest and forward
weekly a cony of all such bills to the City.
2. The City shall review and analyze all such bills
and inform JOE A. GONSALVES i SON, in writing, of
the City's position.

3. JOE A. GONSALVES & SON shall be designated and
authorized by the City tc act as an official .
representative with the California State
Legislature and various governmental agencies,
comaissionE, and persons involved in
governmental affairs affecting the city.
4. JOE A. GONSALVES & SON shall at all times perform
duties customarily performed by legislative
advocates and governmental affairs representative.

5. The term of this Agreement shall comaenco on the
first day of July, 1498, and shall
continue in full force and effect until

A. If any action at law or in equity is necessary to
enforce or interpret the terms of this Agreement,
the prevailing party shall be entitled to
reasonable attorney's fees, costa, and necessary
disbursements in addition to any other relief to
which such party may be entltlud.
4. Th_s Agreement shall be governed by the laws of
the State of California. It constitutes th^ entire
Agreement Lvtween parties regarding its subject
matter. If any provision in this Agreement is
held by any court to be invalid, void, or
unenforceable, the remaining provisions shall

SB 522 (Dills)
This bill was enacted in 1979 and allowed the City of Paramount
to reorganize their Public Employee Retirement Benefits for their
employees.
AB 66 (Lockyar)
This bill removed the business inventory tax. In this bill there
was special language on page 13 that reimbursed the City of
Paramount and the City of Rosemead for projects that were on the
drawing board for business inventory that they would lose. The
City of Rosemead was reimbursed $100,000 (two equal payments of
$50,000). The City of Paramount wag reimbursed $300,000 (two
equal payments of $150,000).
SB 134 (Dills)
This bill allows the Paramount Redevelopment Agency to use tax
increment money outside its agency for public imp.ovements. we
have passed the legislation three timer on behalf of the City of
Paremount, with the lat at being SB 134 in 1985.
AB 1037 (Hannigan)
This bill grandfathared the City of Palm Springs transient
occupancy tax on time shares into law.
SB 198 (Montoya)
The City of Palm Springs hired us to defeat this measure at the
recommendation of Houston Carlyle of the Governor's office. This
same bill the year before was passed by the legislature but was
vetoed by the Governor. SB 198 was killed in the Senate Revenue
and Taxation Committee (the first committee) without receiving a
motion for passage
AB 2153 (Hughes)
This bill saved the City of Commerce an extra million dollars en
the price of property they purchased from the State of California
at the Great Western Exposition Center.
AB 1209 (Viccncia)
This bill was sponsored by the City of Bellflower mandating the
courts to collect an additional $10 fee for cities from persons
