Site and architectural design is not considered unless it is related to environmental concerns. To determine significant adverse impacts, an Initial Study of xnvironmental concerns in prepated. Upon completion of that study, evidence would indicate either no significant irpacto or tl:e potential for significant adverse impacts. If a determination of no signi- ficant impact is made, based upon the Initial Study, then a Negative Declara- tion may be Issued for tl:e project. If significant impacts are found, then an environmental impact report should be required to fully analyze the poten- tial impacts of the project. ENVIRONMENTAL SETTING: The applicant in proposing to construct a 44,625 sq. ft. industrial building on 2.8 acres of land in the M -2 zone on the west aide of 11yasop, south of 7th Street. Following is the adjacent land use and zoning of the site. Land Use Zoning North Vacant M-2 South Vacant M -2 East Vacant M -2 West Devore Freeway M -2 The subject property is presently vacant and contains no significant vegetation. The applicant will be required to install full street improvements for that half portion of Ilyssop abutting the site. ENVIRONMENTAL ANALYSIS: Part I of ti:e Initial Study has been completed by the applicant and is attached for your review. The subject property is presently zoned R -3 (multiple family residential) and has requested a change of zone to M -1 (limited industrial). The appll'.cont has requented the change of zone to allow for future development of industrial, uses on the property. ANALYSIS: ExhLbits "B" and "C" indicate the adjacent land uao and zoning which is described an follows: LAND USE ZONING North Vacant A-1 South Radio Station, vacant land M -R East Light Industrial M -R West Single Family Residence, and vacant land 11-1 Exhibit "D" displays the Interim Land Ue9 Element of the General Plan which designates the subject property as Minimum Impact Industrial. The General Plan Land Use Element contains only two industrial land use classifications; minimum impact and major. The Minimum Impact designation of the General Plan can be implemented through zoning the land either M -R or M -1 to bring the land in conformance with the General Plan. SECTION 2: DErINITIONS The words and terms used in tills Chapter shall have the following meaning unless the context clearly indicates otherwlso: A. Apartment: (Community) Apartment as defined in Section 11004 of the Business and Professions Code, containing two or more rights of exclusive occupancy. D. Condominiums: Condominiums as defined in Section 1350 of the Civil Code: "An estate of real property consisting of an undivided interest in common areas, together with a separate right of ownership In space.” C. Conversion: The process or act of subdivision, In accordance with the Subdivision Map Act, of existing rental dwelling units. D. Pest Report: An inspection and written report conforming to the requirements of Section 8516 of the Business and Profns',lons Code of the State of California including documentation of conditions ordinarily subject to attach by wood destroying pests and organisms. 11 E. Proj acts Project means a condominium, community apart- ment, and stock cooperative. F. Stock Cooperntiva: Stock cooperative as dorincd In Section 11003.2 of the Business and Professions Code: property consisting of dwelling units owned by a corporation wharaby shareholders resolve a right of exclusive occupancy In a portion of the real property uwned by the corporation. SECTION 3: PROPERTY DEVELOPMENT STANDARDS In order for an application for the conversion of apartment units to community apartments, condominiums and stock cooperatives to be considered, the applicant must submit an appiieat'on for Conditional Use Permit and Tentative Tract Map. The following special and general requirements must be met or accompany the Conditional Use Parm1t and Tentative Tract Map r.I.,plication in addition to those requirements of a Conditional Use Permit and Tentative Tract Map. A. Special_ Requirements: The applicant shell provide specific Information concerning economic and demographic characteristics of the project, including, but not limited to the following: 1. The applicant's projected percentage of the existing number of tenants desires of buying this unit necessary Jn order, to sake the conversion project economically feasible. 2. Estimated market value of each unit; ® 0 3. Terms of proposed assistance, discount, or other financing program to be orrered,,ir any, to present residents for the purpose or subsequent unit purchnsot 4. Proposed prcgrotn of relocation assistance to be offered by the applicant, if any; 5. Makeup of existing tenant households, Including family siza, length of residence, age of tenants, and whether recoiving federal or state rent subsidies; G. Proposed Homeowner's Association fee; ® 7. Names and addresses of all tenants. When the subdivider can demonstrate that such Information is not available, this requirement may be modified by the Community Development Department. 8. The subdivider shall submit evidence that a certified letter of notification of Intent to convert was sent to each tenant for whom a signed copy of sold notice Is not submitted. 9. A report of field test by a qualified Independent testing agency as specified in the Uniform Building `Code showing that the wall separation and the floor ® and ceiling separation between units shall provide the some airborne sound insulation as required by 0 the mo►,t current Uniform gullding Coda requirements adupted by the City ,If the report shows that 010903 standards are not met then the applicant shall Indicate that ha will complato improvements necessary to meet these requirements prior to any solo of said converted apartments. A copy of the proposed declaration of covenants, conditions and rdstrictions which will apply and which shall include an agreement for common area maintenance, Including facilities and landscaping, together with an estimate of the initial assessment fees anticipated for such maintenance; a description of a provision for maintenance of vehicular access areas within the project; and an indication of appropriate responsibilities for maintenance of all utility lines and services for each unit. 11. A physical elements reports which shall include but ---not be limited to: (a) A report detailing the condition and estimating the remaining useful life of each element of 0 0 ® the project proposed for conversions Iloofs, foundations, exterior point, paved surfaces, mechanical systems, electrical systems, plunb- Ing systoms, including sowago systems, swlmning pools, sprinklor systems for landscaping, utility dniivary systems, control or community heating and air- conditioning systems, fire pro- tection systems Including nutomotie sprinllor systems, alor:n systems, or standpipo systems, and structural elements. Such report shall be prepared by an appropriately licensed contractor or architect or by a registered civil or structural engineer other than the owner. For any element whose useful life Is less than five (5) years, a replacement cost astimate shall be provided. (b) A structural pest control report. Such report shall be prepared by a licensed structural past control operator pursuant to Section 8516 of the Business and Professions Code. (c) A building history report including the following: (1) The date of construction of all elements of the project; (2) A statement of the major uses of said pro- ject since construction; r 0 (3) The date and description of each major repair or renovation of any structure or structural clamant since the date of con- struction. For thn purposes of this sub- section n "major repair" shalt moan any repair for which an ixpunditure of more than $1,000 was mode; (4) statement regarding curt•ont ownership of all Improvements and underlying land; (5) Falluro to provide information required by subsections (1) through (4). Inclusive, shall be accompanied by an affidavit, given under penalty of perjury, setting forth reasonable efforts undertaken to discnver such information and reasons why said information cannot be obtained. 12. A notice of Intent to convert shall be delivered to each tenant's dwelling unit. Evidence of delivery shall be submitted with the application for conver- sion. The form of the notice shall be as approved by the Community Development Department and shall contain not less than the following: (a) Name and address of current owner; (b) Name and address of the proposed subdivider; 1 ® 0 (c) Approximate data on which the tontativo map is proposed to be rl!ed; (d) Approximato date on which the final map or parcel map Is to be filed; (a) Approximate date on which thr, unit Is to be vacated by nonpurchasing tenants; (f) Tenant's right to purchase; (g) Tenant's right of notification to vacate; (h) Tenant's right of termination of lease; (i) Pr�-vislon for special cases; and (J) Provision of moving expenses. (k) Other Information as may be deemed necessary by the Community Development Department. Tenant's Right to Purchase. As provided In Government Coda Section 66427.1(b) any present tentant or tenants of any unit shall be given a nontransferable right of first refusal to purch%so the unit occupied at a price no greater than the price offered to the general public. BACKGROUND: Mr. Anderson in raquenting approval for the devolopment of 4 light industrial buildings totaling 800000 square feat e:: 4.5 acres of land located on 0 north side of 6th Street, approximately 300' want of Turno� Avenue (Exhibit "A ") . The site in presently zoned M -2 (gonoral manufacturing) and general planned for minimum impact industrial. Tile situ is presently vacnnt, in addition to ti:e property located to the north, cast and south. The property to ti:e went in presently developed with industrial development similar to that proposed by Mr. Anderson. ANALYSIS: The project site is adequate in size and shape to nccomodato the proposed improvements an shown on tl:e development plan (Exhibit "B "). Street improvements and dedications will be done in accordance with the master plan of streets and highways. The project is providing th,a required amount of landscaping for 6th Street and meoto parking standards of the zining ordinance. As the Commission will recall, 6th Street was upgraded from a collector street, to a secondary thoroughfare and Special Boulovatd on the General Plan. This means that the right -of -way required for the development of 6th Street increased from 66' to 88'. This change also increased the street from the centerline to curb face from 22' to 321. There - fore, the new street improvements required to be installed with this project will create a 10' off -net from the existing street improvements on the went side of the subject property. In addition, the change now subjects the street, to the "Limited Access Policy" as adopted by the Planning Commission. As can be seen from the site development plan, access in proposed by means of two driveways; one on each side of the property. This proposal is not cunsistent with ti:e "Access Policy" as the weetorly driveway is within approximately 30' of an existing driveway to the west and the east driveway it less than 300' from the planned west driveway. In ord:•r to design access for this project consis- tent to the policy, the applicant would be rajuired to provide shared arenas on the west and oust property lines or one .driveway in t center of tl:e property. This has been conveyed to the applicant and ha'has not bee.. able to gain permission from the west property owner to allow the combination of the existing driveway with the proFooed driveway for shared access. Therefore. the only other alternative to meet the "Access Policy" would be tl:e centrally located driveway.
