Chairman Stout indicated that these items would be heard by the Commission collectively and at the previous meeti:g of January 25, 1984 there was a decision that they be continued to this meeting in order to determine if the individual projects would join together to _fund a Citywide marketing study for Office Professional uses. Rick Gomez, City Planner, advised see if they wished to participate share basis. Mr. Gomez responded that none is required. Chairman Stout asked if the study to be done on General Plan Amendments 84 -01A and 84 -OIC would be on their individual merits. Mr. Gomez replied that is correct. Mr. Edward Eopson, Assistant City Attorney, recommended that the public hearing be opened tonight on the two remaining items to avoid readvertising. Chairman Stout asked if there was any reason that these items should not be readvertised. Mr. Hopson replied none, other than that of expense. Chairman Stout asked the representatives of Olympus Pacific if they have an understanding of what the action of the Commission is with re,-ard to the continuance. They replied affirmatively. There was no representative present for GPA 811 -01C - Acacia. Chairman Stout asked Mr. Gomez to explain to the audience what will happen with respect to the four week continuance on these items. Mr. Gomez explained that all the alternatives will be considered along with individual requests and the receipt of public testimony. Further, that each of t:�e general plan amendments would be examined to see if they are justified. Chairman Stout opened the public hearing cn Items E and G of the agenda, explained what will occur, and that these items are continued to the March 14 meeting. He advised that if there are individuals who will be unable to attend the March 14 meeting, they can address their comments to the Commission avid send them to the City offices for inclusion in the staff report and record. There being no ±further comments, the public hearing was closed. Motion: Moved by Mc Niel to continue items E and G to the March 14, 1984 Planning Commission meeting. Commissioner Hempel stated that before he seconds the motion, he Wisned to make some comments. He indicated that there is a possibility that the amendment on 19th and Hermosa has some merit and that if it is considered for the General Plan Amendment, the applicant and audience should be aware of the concern for the area which will cause it to be evaluated on that basis. Planning Commission Minutes -3- February 8, 1984 D Further, he felt that the area on Archibald above the Alpha Beta shopping center did not lend itself to change and one of the purposes of the study should be to look at office space in the future. He indicated that this area !ends itself to office space in the future. Additionally, that there is I ousing in between two commercial developments at that location and he felt the applicant would have to have some very good excuses in order for him to change his mind. Commissioner Rempel seconded the motion and it was carried unanimously to continue items E and C to the March 14, 1984 Planning Commission meeting. i 3 3 * S H. ENVIRONkENTAL ASSESSMENT AND TENTATIVE TRACT 12601 - MORRIS & SEARLES - T.he development of 26 single family detached homes on 4.5 acres of land in the Tow Medium (LM) District generally located on the west side of Turner Avenue at Palo Alto Street - AN 1077- C31 -4. 1. ENVIRONMENTAL ASSESSMENT AND PARCEL MAP 8298 - MORRIS & SEARLES - The division of 9.22 acres of land into two parcels within the Low Medium ELM) District generally located on the west side of Turner Avenue at Palo Alto Street - APN 1077- 031 -4. Senior Planner, Michael Vairin, reviewed the staff report. Chairman Stout opened the public hearing. The applicant was not present. There being no comments, the public hearing was closed. Chairman Stout stated the sample board of roofing material was unacceptable to him and requested the roofing material be varied in texture. Mr. Vairin replied there is a condition that the roofing material be examined and approved by staff prior to issuance of building permits. Chairman Stout stated the roof line is something that is shared by everyone and should be varied for shadow lines and pattern. Mr. Vairin stated staff has been finding much more success in taking away the tract look through use of color and pattern change in the roof material and this area has been the focus of Design Review. Commissioner Rempel. stated there is a 120 pound roofing material that can be used rather than the 90 pound shake. He felt the condition should be modified to state that heavy duty shake will be used. Mr. Vairin read the condition and stated staff is in the process of revising the standard conditions so they can be more specific. Planning Commission Minutes -4- February 8, 1984 t Motion: Moved by McNiel, seconded by Rempel, carried unanimously, to adept Resolution No. 84 -14 and issue a Negative Declaration with a modification of the condition to require heavy shingle roofing material subject to the Planning Division's approval. TENTATIVE TRACT 11951 -1, -2, -3. - CROWELL - A revision to the Tentative Tract Map to a 3 lot subdivision for condominium purposes for i5u dwellings on 10.09 acres of land located at the southeast corner of Arrow Route and Turner Avenue - APN 209- 091 -11. Senior Planner, Michael Vairin, reviewed the staff report. Chairman Stout asked for a definition of condominiums and tounihouses. Assistant City Attorney Hopson explained that in a condominium, the resident owns the air space and all the owners in common own the land and bearing walls of the structures, whereas in a townhome, the resident owns the land upon which the townhome s'ts, and instead of all the owners owning the streets and outside bearing walls, the Homeowners Association would own the common areas such as recreation buildings. From the outside, they would look alike, the d2.ffcrence is in how the ownerstip interest is described. Chairman Stout opened the public hearing. Mr. Gary Hines, representing C/L Builders, explained why they wish to change this subdivision from townhouses to condominiums, indicating that Southern California Edison had changed their rulings on how utilities for new construction of this type would be hooked up, which now requires individual. meters on each townhome. Further, this would add more to the cost of construction and put them outside of the pri--e range for the product. Chairman Stout closed the public hearing. Motion: Moved by Rempel, seconded by McNiel, carried unanimously, to adopt Resolution No. 83 -132A, revising Tentative Tract 11915 -1. r a ■ e r R. ENVIRONMENTAL ASSESSMENT AND PARCEL MAP 8345 - SERO AMUSEMENT COMPANY - A divisian of 40.35 acres into 2 parcels in the Medium High Residential and Office /Professional districts located on the northwest corner of Haven Avenue and Arrow Highway - APN 208 - 341- 01 -04. Paul Rougeau, Senior Civil Engineer, reviewed the staff report. Planning Commission Minutes -5- February 8, 1984 Commissioner -,.cmpel asked if there is any proposal to have Civic Center Drive ccntinue cer Creek. Mr. Rougeau replied there is none at this time and it is ro- -•.m on the master plan. Further they did not know whether Center or Ci-.:_ >r Drive should be continued or whether they are necessary. Commissioner Juarez asked if the City has a master plan on th:„ particular parcel so the Commission can see where it will go. Mr. Rougeau replied the master plan of streets is as contained in the General Plan and there is nothing smaller than that. Further. they looked at the streets at Arrow Route and Turner and found they contained multiple family dwelling uni�s at the corner. He indicated the nature of the subdivision is such that it would not be desirable to have a street run into the the property becay,se it would be of quite higher density. Chairman Stout opened the public hearing. Mr. Rick Avant, representing Arnold Anderson and himself, stated he was open for any questions and has tried to work in developing the 'mprovements as required in the City's criteria. Chairman Stout asked whe'. Mr. Avant anticipates wculd develop first. Mr. Avant replied is world be the project on the left. Further, apartments might lend themselves •very well to the further development of commercial along Haven. Chairman Stout asked if there was any possible discussion on the odd piece between this development and Deer Creek. Mr. Avant replied there is none as they are not interested in that property nor do they have any control over it. Further, it seems to be well maintained. Chairman Stout stated his concern that once Parcel Map 8345 is developed, there will be a barrier between this and the odd parcel which will make it difficult to develop. Mr. Avant replied they must speculate that there are ways to develop the property and enough property there to give proper access. Mr. Avant asked 'if 45 feet is required as setback off of Arrow because 50 feet is checked off on his conditions of approval. Mr. Rougeau replied the condition of approval is for 50 feet of right -of -way on Arrow and the 45 feet is for setback from the face of the curb. Planning Commission Minutes -6- February 8, 1984 •I Mr. Avant asked about the surety agreement that must be executed prior to recording the map and whether the property could be split between two parcels. He indicated the tentative map will require different zoning which could prove to be a technical problem for them later on in trying to develop one parcel rather than going ahead with both parcels. Further, if the apartments go in first, they may want to develop Haven Avenue, and without set criteria for the approaches on Haven for parcel 1, which is Haven, and parcel 2, which is Arro�: and Civic Center Drive, and asked if this would be a problem for the Cj ty Attorney. Mr. Rougeau replied there would be no problem in splitting the lien P.greerent between the parcels but there might be a slight misunderstanding on what it would cover. Mr. Hopson stated a condition of approval is iAeprrvcm8ni3 must be built prior to building permits being pulled on each of t`,e pieces. If building permits were pulled on parcel 2, the offsite improvements on parcel 1 would not be required. Mr. Rougeau explained the lien agreement and the °arety are really two different things and cover different items so he di i not see any problems. Commissioner Rempel stated that on the piece along Arrow Highway, if they develop parcel 2 there will be an offset chunk or. parcel 1 which would not be advantageous to the City. Mr. Avant replied that it could be encompassed and his concern is the two par ^els not be tied up. Further, that piece could be included in parcel 1, and he agreed with Commissioner Rempel. Chairmar Stout asked if clarificat'.on. is needed in the Resolution. Mr. Avant stated he was talking about the legal burden of separating them at a later time and the median or. Haven and not tieing the two together. Mr. HcDsor stated as long as the City Engineer is satisfied with the improvements he and t:-e applicant can work tnem out. There being no further comments, the pubile hearing was closed. Commissioner McNie.1 asked if the median is being extracted and being attached to parcel 7 or vas the discussion on the frontage along Haven Avenue. Mr. RougE__ stated that the discussion was on the lien .agreement in that he did not want the two parcels wedded together. Further, that the timing on the median island will be determined by other factors and was close to being put in sinr.•e they are looking at the entire east side of Haven Avenue. Mr. Rougeau explained that lien agreements say that each piece of property has to put up its share of the money so regardless of the stage of development, the money would have to be put up when the: City declares it must be put up. Planning Commission Minutes -7- February 8, 1984 Mr. Hopson stated that the City always works with the applicant if it is necessary to subordinate the lien agreements so that the applicant can obtain financing without a cloud on the development, they want to finance and allows them to use their property in the meantime. Commissioner Hempel stated that the City must make sure that the areas he is concerned with are tied in when the two properties are split and tha'_ good access is maintaine-i to parcel 2. Motion: Moved by ,!mpel, seconded by McNiel, carried unanimously, to adopt Resolution No. 84-1b approving Parcel Map B345. f i f t f L. ENVIRONMENT_AL ASSESSMENT AND DEVELOPMENT REVIEW 83 -42 - GALVIS - Tte conversion o: an Existing gas service station into a self- service station and mini - market in the Gencral Commercial District located at 8166 Foothill Boulevard - APN 207 - 112 -17. Sx-'iior Planner, Mi-,hael Vairin, reviewed the staff report. Chairman Stout asked what she proposed circulation plan is once you bet to the parcel from the driveway to Foothill. He asked -f you would have to exit off of Red Hill Country Club Drive. Mr. Vairin explained what driveway would be closed and pointed out the other, which would be open. Further, that it would be difficult to exit onto Foothill. Chairman Stout stated that the only thing ttat bothers him about that is the people who want to go left onto Foothill. Mme. Vairin replied that they would have the physical barrier of a median island or the driveway closed entirely. Chairman Stout indicated that he wants 'co e:_sinate some conflicts that may Occur. Mr. RougPau stated that the best thing to do :.s concentrate tae turns at as few places as possible and in the present conai: ion a left -turn is possible at both the driveways on Foothill as well a� hied nill Country Club Drive. He indicated that the Foothill driveway should be closed and people encouraged to use Red Hill Cour.try Club Drive, which in itself is not grest, but would reduce the movements from three to two. Commissioner Stout stated he wanted to make the intersection as safe as possible. Planning Commission Minute:+ -8- February 8, 1984 s Mr. Rougeau stzted that if a proposal comes in from the o-aner of the property at Grove and Foothill they could eliminate that intersection completely. Chairman Stout opened the public hearing. The applicant, Mrs. Elizabeth Galvis, stated that she was in agreement with the conditions of approval. Chairman Sto_ct asked if Mrs. Galvis understood the conditions. Mrs. Galvis replied that she did. There being no further comments, the public hearing was closed. Commissioner McNiel asked what the appropriate sign is for the station. M--. Vairin replied that as there are two street frontages there could be a monument sign facing each street frontage which must include pricing as well as identification of the station. Further, there can be an ancillary sign on the canopy, as well as on the structure itself. Chairman Stout asked if a median island is required in front of this property in conformance with the General Plan and whether the City is doing anything to be sure they conform. Mr. Rougeau replied that the City is working with CalTrans on an acceptable design and such a median would have to be installed one mile at a time which would begin at Vineyard to Archibald. Mr. Rougeau stated that a lien agreement for the median island will 'e required. Chairman Stout asked if this is being dons. Mr. Rougeau replied it would be an appropriate condition on a project like this. Commissioner Rempel stated that he would have the same discussion that he had with the Arco center at Malachite and Foothill because this is an even worse situation. He further stated that with the possible increase of traffic there is no way to stack traffic if the need arises. Commissioner Rempel stated another problem in converting gas stations to food sto: as bocauz- ;sere would be nothing to prevent a food store from wanting to also pump gas and no way for the Commission to say no if this is approved. 7:73 p.m. - Commissioner Harker arrived. Commissioner McNiel stated he sees nothing wrong with this and minks it will be an improvement. Further, that a condition exists at Red Hill that aside from a change altogether, would do little. Commissioner Juarez felt the project is a good one. Planning Commission Minutes —9— February 8, 1984 8 Commissioner BarIker stated he would not comment because he was not present during the public hearing. Chairman Stout stated that there should be a lien agreement for the median island at Foothill. Commissioner Rempel stated traffic will come out and make a left turn and there are enough problems now. Further, another signal is needed at this area which would have to be coordinated with the one at Grove. Commissioner Rempel stated the only reason the applicant is changing this is for additional income which will mean additional traffic. He indicated that they will provide more land to the Cucamcrga County Water District but not so mucl, that it would be a park. Site Characteristics: The site consists of a 12 acre parcel which slopes from north to south at approximately a 6 percent grade. In addition, the site contains various indigenous plant materials, grape vineyards, and Eucalyptus windrows which are located contiguous to the north, south, east, and west property lines. Surrounding land uses consist primarily of agricultural or residential uses which include proposed Tentative Tract 10047 to the west. An existing :tone cottage is located on the northwest corner of the parcel and is slated for removal. As illustrated on Exhibit "B ", two existing store dwellings are located either within or adjacent to the proposed development, along Hillside Avenue. These s °:ructures have been designated by the City's General Plan as landmarks and co=unity focal points. This point will be further explored in the the latter part of this report. II. ANALYSIS: A. General: The applicant is proposing a development of 22 single famiTy—dwellings on 22 parcels generally located on the southwest corner of Hermosa Avenue and Hillside Road. The project has been designed with a variety of setbacks and lot widths which provide vaeie:y and visual interest. Lot sizes within. the development are comprised of parcels between 20,000 and 27,000 square feet, which is consistent with City regulations. As illustrated (Exhibit "C "), the development consists of an inward - oriented tract with private streets. Four of the 22 proposed parcels front on Wilson Avenue and will be oriented away from the majority of the parcels within the development. Surrounding and existing land uses consisting primarily of large vacant parcels currently being used for agricultural purposes. Large single family homes are adjacent to the proposed Omni development. As illustrated in Exhibi-: "K ", Tentative Tract 10047 consists of 43 parcels located wes.: of the proposed Omni project between Hillside and Wilson Avenues and provides various street connections to Hermosa Avenue. As illustrated, the applicant of the Omni project has chosen to orient the proposed development away from these circulation features. B. Design Review Committee: Initially, the Design Review Committee was primarily concerned with the present Omnit tract configuration and its predominant orientation away from Tentative Tract 10047 (Exhibit "B "). In an effort to analyze this issue for the Commission, the Committee directed staff to prepare an analysis designed to examine the assets and liabilities involved in establishing an inward - oriented development at this particular location. In addition, the Design Review Committee also recommended that the proposed architecture reflect and be compatible with the existing stone dwellings adjacent to Hillside Avenue. C. Staff Anal sy is: The following is a discussion as to the assets an abilities involved with the development of the Omni project as it relates to its inward oriented configuration. It ® is recommended that the Commission review and consider each discussion item in an attempt to determine an appropriate poli,,y and action related to this land use situation. Upon, determination, the Commission may wish to approve or deny the applicant's project or continue the project by directing the applicar'. to provide staff with an appropriate alternative (i.e., a direct interface with the adjacent subdivision) to the present project configuration. E 1. General: The proposed Omni development consists of an inward- or9er.ted subdivision which orients most of its dwelling units contiguous to a private loop street which provides access to the developmert. •:ia Hermosa Avenue. Tentative Tract 10047, west of the Omni roject, has proposed an adjoining cul -de -sac and street system which would encourage through vehicular and pedestrian access to Hermosa Avenue. City Policy dictates that any proposed project Should be compatible with and sensitive to the immediate environment of the site and neighborhood in relation to identity, neighborhood character, building orientation, setbacks, and visual interest. Past Planning Commission policy has been to discourage an inward- oriented development due to the predominance of bock walls which are viewed by the public along major streets, and because of lack of continuity between adjacent existing or proposed developments. The only form- giving elements (i.e., existing or proposed development or dwellings which may influence the design of the Omni project) appear to be: (a) the existing stone structures located along Hillside; (b) Tentative Tract 10047 to the west; and, (c) an existing tract of homes located between Banyan and Wilson, south of the proposed Omni project. The following is a list of assets and liabilities related to the viability of developing an inward - oriended development: Assets: o The project provides a sense of self - containment, enclosure, and unity for itself. o The project creates its own neighborhood through the use of consistent dwelling designs, building materials, landscaping, and parcel configurations. o A sense of security is provided for the majority of homes through the use of private card - activated security gates. iabilities: The proposed development disregards proposed Tentative Tract 10047 by: a. Not allowing through auto and pedestrian traffic on Street "A" to Hermosa Avenue resulting in a loss of �_cntinuity between future neighborhood units. b. Orienting 18 of the 22 parcels away from Tentative Tract 10047 and not completing or orienting dwellings around the westerly (TT 10047) cul -de -sac. o The development 'will set a precedent by providing an inward - oriented neighborhood and block wall contiguous to Hermosa Avenue. The applicant has attempted to mitigate any problems associated with an inward oriented development by providing landscaping and decorative block walls contiguous to Hermosa Avenue and the westerly cul -de -sac. Vehicular barriers shall be required on all trail openings to the westerly cul -de -sac and to the community trail located contiguous to Hermosa Avenue. 2. A 20-foot dedication shall be required contiguous to Hermosa Avenue for equestrian purposes which meets all adopted Equestrian Guideline standards for construction. The block walls adjacent to the westerly cul -de -sac and Hermosa Avenue shall be designed in such a fashion as to provide architectual variety and visual interest to the streetscape. The wall shall be designed to include indentations, reveals, and extensive use of washed river rock. 4. Extensive landscaping features including raised planters, berming, street trees, ground cover, vines, etc., shall be provided adjacent to the block wall located contiguous to Hermosa Avenue and the westerly cul -de -sac. 5. A variation of roof materials, textures, and colors shall be required. Roof material samples shall be submitted to the Planning Department for final approval by the City Planner prior to issuance of building permits. 6. A variation of exterior colors shall be required. A color palette shall be submitted to the Planning Department for final approval by the City Planner prior to issuance of building permits. 7. Texturized entrance features such as stampe,. concrete shall be provided. In addition, a noo -slip paving surface shall be provided where equestrian trails cross paved streets. 9. No building permits sha'11 be issued for parcel number one (1) until the Planning Commission has determined the merits of preserving Late stone cottage or authorizing its removal. ENGINEERING DIVISION 1. A 10 -foot wide easement for utility and sidewalk purposes shall be reserved on each side of the interior private street. 2. A 60 -foot wide irrevocable offer of dedication for roadway and related purposes shall be required on all interior streets. 3. Prior to or noncurrent with the recordation of the tract, the developer shall be required to join an assessment district or any other facility district that the City deems necessary to complete construction of the Alta Loma C;iannel. 4. The drainage outlet structures from the tract to Wilson Avenue shall be designed and constructed to eliminate adverse impacts on downstream properties and public streets.
