A RESOLUTION OF THE PLANNING, COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING CONDITIONAL USE PERMIT NO. 88- 43 FOR A MOVING AND STORAGE USE iN LEASED SPACE OF 10,000 SQUARE FEET WITHIN AN EXISTING MULTI TENANT INDUSTRIAL PARK ON 3.8 ACRES LOCATED AT 9734 AND 9740 SIXTH STREET IN THE GENERAL INDUSTRIAL DISTRICT (SUBAREA 4), AND MAKING FINDINGS IN SUPPORT THEREOF. - APN: 209 - 211 -32 AND 33. A. Recitals. M Art Olmstead has filed an application for the issuance of the Conditional Use Permit No. 88 -43 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permii; request is referred 0 as "the application ". (ii) On the 9th of November, 1988, the Planning "ommission of the City of Rancho Cucamonga conducted a duly noticed public hearing un the application and continued said hearing to November 17, 1988. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that ail of the facts set forth in the Recitals, dart A, of this Resolution are true and correct. 2. Based upe substantial evidonce presented to this Commission during the above -refer ,.ced public hearing on November 9, 1988, including written and oral staff reports, together with public .testimony, this Commission herQby specifically finds as follows: (a) The application applies to property located at 9734 and 9740 Sixth Street with a street frontage of 614 feet dnd lot depth of 276 feet and is presently improved with a multi - tenant industrial center and 62 parking spaces; and (b) The property to the north of the subject Site is multi - tenant industrial, the property to the south of that site consists of muiti- tenant industrial, the property to the east is rmult _tenant industrial, and the property to the west is single family residential. 3. Based upon the substantial evidence presented to this Commission during the above - referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above,.this Commission hereby finds and concludes as follows: PLANNING COMISS?,QN RESOLUTION NO. CUP 88 -43 November 17, 1988 Page 2 (a) That the proposed use .s in accord with the General Plan, the objectives of the Development Code, and the purposes of the Industrial Specific Plan subarea in 0,ich the site is located. (b) That the proposed use, together with the conditions applicable thereto, dill not be detrimental to tht public healti4, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Industrial Specific Plan. 4. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, tht Commission hereby approves the application subject to each and every condM on set forth below: PLANNING DIVISION: 1) Approval of this request shall not naive compliance toth all sect ±ons of the Industrial Area Specific Plan, aid all other City Ordinances. 2) If the operation of the facility causes adverse effects upon adjacent businesses or operations, including, but not limited to noise, the Conditional Use Permit shall be brought before the Planning Comission for the consideration and possible termination of the use. 3) Any signs proposed for the facility shall be designed in conformance with the Comprehensive Sian Ordina"e, any Uniform Sign Program for the complt -x, and shall require review and approval by the Planning Division prior to installation. 4) Occupancy of the facility shall not commence until such time as all uniform. Building Code and State Fire Marshall's regulations have been complied Frith. prior to occupancy, plans shall be submitted to the foothill fire Protection District and the Building and 'Safety Division to show compliance. The building shall be inspev.,ted for compliance prior to occupancy. 5) The two -Tway drive aisle shall be kept clear at all Limns, including during loading, and unloading of the bobtail trucks. 4 PLANNING COMMISSION RESOLUTION NO. CUP 88 -43 November 17, 1988 Page 3 6) A striping plan to accomodate five 26 -fool. bobtail trucks, using angled or parallel parking such that the trucks do not encroach into the circulation aisle,, shall be submitted for review and approval by the City Planner prior to occupancy. 7) The number of trucks associated with this business shall not exceed the number of parking spaces assigned to this lease space. ENGINEERING DIVISION: 1) Street right -of -way shall be x'edicated along the entire center (APN 209- 211 -32 6 33). Sixth Street frontage to provide a total 44 foot width from centerline including a property line radius at Archibald Avenue, prior to occupancy or building permits. S.
