HomeMy WebLinkAbout14-015 - Resolutions RESOLUTION NO. 14-015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, FINDING THAT CERTAIN REAL PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, TO BE SURPLUS AND A BURDEN ON THE CITY OF RANCHO CUCAMONGA AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THAT CERTAIN DEED, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT "A" AND TO CAUSE THE SAME TO BE DELIVERED TO THE PERSONS NAMED THEREIN A. RECITALS (i) The City of Rancho Cucamonga has a fee interest in Lot "C" of Tract 16128 generally located on the east side of San Carmela Court, north of Base Line Road, in the City of Rancho Cucamonga, County of San Bernardino, California, and hereinafter referred to in this Resolution as "said property". A full, true and complete description of said property is set forth in that copy of deed attached hereto as Exhibit "A" and by this reference set forth herein. (ii) California Government Code Section.37350 provides as follows: "A City may purchase, lease, receive, hold, and enjoy real and personal Property, and control and dispose of it for the common benefit." (iii) California Government Code Section 37351 provides in pertinent part, as follows: "The legislative body (City Council may...dispose of, and Convey such property for the benefit of the City..." (iv) The Planning Commission of the City of Rancho Cucamonga heretofore made the findings on August 27, 2008, that disposing of said portion of City owned property, as herein contemplated, would be in conformity with the General Plan of the City of Rancho Cucamonga. (v) Said portion of City owned property was acquired by the City of Rancho Cucamonga through a Corporation Grant Deed, for Streets, highways and related purposes. (vi) Said property constitutes a burden on the City of Rancho Cucamonga and is no longer necessary or convenient for the purposes for which is was acquired. (vii) Conveyance of said property will further the use of said property and benefit the City of Rancho Cucamonga by deletion of a necessity to maintain said property. Resolution No. 14-015— Page 1 of 3 (viii) All legal prerequisites to the adoption of this Resolution has occurred. B. RESOLUTION NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. All facts stated in the Recitals, Part A, of this Resolution hereby are found to be true and correct. 2. This Council hereby finds that the quit claiming of said property to the persons described in said deed will benefit the City of Rancho Cucamonga. 3. The Mayor and City Clerk hereby are authorized and directed to execute the deed, a full, true and correct copy of which is attached hereto as Exhibit"A", and cause the same to be recorded forthwith upon adoption of this Resolution. 4. The City Clerk shall certify to the adoption of this Resolution. Resolution No. 14-015— Page 2 of 3 PASSED, APPROVED, AND ADOPTED this 51h day of February 2014.
