HomeMy WebLinkAbout03-08 - Resolutions RESOLUTION NO. 03-08 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA,APPROVING TENTATIVE PARCEL MAP SUBTPM16037,A PROPOSAL TO SUBDIVIDE A PARCEL OF 19,710 SQUARE FEET THAT IS COMPRISED OF TWO, SINGLE-FAMILY HOMES INTO TWO PARCELS OF 9,525 AND 10,185 SQUARE FEET WITH ONE HOME ON EACH IN THE LOW RESIDENTIAL DISTRICT (2-4 DWELLING UNITS PER ACRE), LOCATED AT 8585 COMET STREET, AND MAKING FINDING IN SUPPORT THEREOF -APN: 207-451-23. A. Recitals. 1. CTK Inc. filed an application for the approval of Tentative Parcel Map SUBTPM16037,as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Parcel Map request is referred to as "the application." 2. On the 8th day of January 2003, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. The Planning Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the Planning Commission during the above-referenced public hearing on January 8, 2003, including written and oral staff reports,together with public testimony, the Planning Commission hereby specifically finds as follows: a. The application applies to a parcel of 19,710 square feet within the Low (L) Residential District, located at 8585 Comet Street; and b. The subject parcel is comprised of two, separate single-family residences and attached garages with a combined area of 2,800 square feet(1,400 square feet each house/garage), and associated improvements; and C. The application contemplates the subdivision of the subject parcel into two separate parcels of 9,525 square feet (Parcel 1) and 10,185 square feet (Parcel 2), with dimensions for each parcel of about 75 feet wide by 130 feet deep and a street frontage along Comet Street of about 75 feet each; and d. Following this subdivision, each parcel will be comprised of one, single-family residence and attached garage, and associated improvements; and e. The applicant is not proposing to alter the existing structures or add new structures; and PLANNING COMMISSION RESOLUTION NO. 03-08 SUBTPM16037—CTK, INC. January 8, 2003 Page 2 f. The properties surrounding the subject site are zoned Low(L) Residential District, with similar dimensions and lot sizes, and are improved with comparable residential structures. 3. Based upon the substantial evidence presented to the Planning Commission during the above-referenced public hearing, and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. The Tentative Parcel Map is consistent with the General Plan and Development Code; and b. The proposed subdivision, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 4. This Commission hereby finds and determines that the project identified in this Resolution is categorically exempt from the requirements of the California Environmental Quality Act of 1970,as amended, and the Guidelines promulgated thereunder, pursuant to Section 15315, Class 15, of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application, subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division: 1) Approval is for the subdivision of a single parcel located at 8585 Comet Street into two separate parcels of 9,525 square feet (Parcel 1) and 10,185 square feet (Parcel 2). 2) The individual parcels shall be maintained and developed in accordance with the City's Development Code including, but not limited to, site development standards. 3) Approval of this request shall not waive compliance with any sections of the State Fire Marshal's regulations, Uniform Building Code, or any other City Ordinances. Engineering Division: 1) Install the following missing improvements on Comet Street: a) Streetlight per City Standard. 2) Have a Registered Civil Engineer revise City Drawing No. 129 for the improvements listed above. Appropriate plan check fees will apply. The improvements are installed under an Engineering Construction Permit. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. LOCATION: 8585 COMET AVENUE ALL OF THE FOLLOWING CONDITIONS APPLY TO YOUR PROJECT. APPLICANT SHALL CONTACT THE PLANNING DIVISION, (909) 477-2750, FOR COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. General Requirements Completion Date 1. The applicant shall agree to defend at his sole expense any action brought against the City, its agents, officers, or employees, because of the issuance of such approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any Court costs and attorney's fees which the City, its agents, officers, or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his obligations under this condition. 2. Copies of the signed Planning Commission Resolution of Approval No. 03-08, Standard Conditions, and all environmental mitigations shall be included on the plans (full size). The sheet(s) are for information only to all parties involved in the construction/grading activities and are not required to be wet sealed/stamped by a licensed Engineer/Architect. B. Time Limits 1. This tentative parcel map shall expire, unless extended by the Planning Commission, unless a complete final map is fled with the City Engineer within 3 years from the date of the approval. C. Site Development 1. The site shall be developed and maintained in accordance with the approved plans which include site plans, architectural elevations, exterior materials and colors, landscaping, sign program, and grading on file in the Planning Division, the conditions contained herein, and Development Code regulations. Revised site plans and building elevations incorporating all Conditions of Approval shall be submitted for City Planner review and approval prior to the issuance of building permits. 3. All site, grading, landscape, irrigation, and street improvement plans shall be coordinated for consistency prior to issuance of any permits (such as grading, tree removal, encroachment, building, etc.) or prior to final map approval in the case of a custom lot subdivision, or approved use has commenced,whichever comes first. 4. Approval of this request shall not waive compliance with all sections of the Development Code, all other applicable City Ordinances, and applicable Community or Specific Plans in effect at the time of building permit issuance. APPLICANT SHALL CONTACT THE ENGINEERING DIVISION, (909) 477-2740, FOR COMPLIANCE WITH THE FOLLOWING CONDITIONS: D. Street Improvements 1. Lights Trees Trail Island Trail Comet Street X 2. Improvement Plans and Construction: a. Street improvement plans, including street trees, street lights, and intersection safety lights on future signal poles, and traffic signal plans shall be prepared by a registered Civil Engineer and shall be submitted to and approved by the City Engineer. Security shall be posted and an agreement executed to the satisfaction of the City Engineer and the City Attorney guaranteeing completion of the public and/or private street improvements, prior to final map approval or the issuance of building permits, whichever occurs first. b. Prior to any work being performed in public right-of-way, fees shall be paid and a construction permit shall be obtained from the City Engineer's Office in addition to any other permits required. E. Improvement Completion 1. If the required public improvements are not completed prior to approval of the final parcel map, an improvement security accompanied by an agreement executed by the Developer and the City will be required for: Tentative Parcel Map 16037. F. General Requirements and Approvals 1. A non-refundable deposit shall be paid to the City, covering the estimated operating costs for all new streetlights for the first six months of operation, prior to final map approval or prior to building permit issuance if no map is involved.
