HomeMy WebLinkAbout03-36 - Resolutions RESOLUTION NO. 03-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING VARIANCE DRC2002-00950, A REQUEST TO REDUCE THE REQUIRED LOT AVERAGE FROM 8,000 SQUARE FEET TO 7,200 SQUARE FEET FOR ASSESSOR PARCEL NUMBER 0209-263-04, AND THE MINIMUM LOT SIZE FROM 7,200 SQUARE FEET TO 5,625 SQUARE FEET FOR ASSESSOR PARCEL NUMBER 0209-061-15; ALSO TO REDUCE THE MINIMUM LOT WIDTH FROM 65 FEET TO 45 FEET, AND TO REDUCE THE REQUIRED SIDE YARD SETBACK FROM 10 FEET TO 7 FEET, FOR BOTH PREVIOUSLY IDENTIFIED PARCELS, IN THE LOW RESIDENTIAL DISTRICT (2 TO 4 DWELLING UNITS PER ACRE) WITHIN THE NORTHTOWN AREA ALONG FERON BOULEVARD AND REID AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF-APN: 0209-063-04AND 0209-061-15. A. Recitals. 1. Northtown Development Corporation filed an application for the approval of Variance DRC2002-00950 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as 'the application." 2. On the 12th day of March 2003, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Commission during the above- referenced hearing on March 12, 2003, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a. The application applies to two parcels: APN: 0209-063-04,with a street frontage of 90 feet on Feron Boulevard and a lot depth of 160 feet, and APN: 0209-061-15, with a street frontage of 90 feet on Reid Avenue and a lot depth of 125 feet. Both parcels are presently vacant and front-on improved public streets; and b. Properties to the north, south, east, and west are vacant or developed with single- family residences; and C. The application was filed in conjunction with a request for Tentative Parcel Maps SUBTPM16057 and SUBTPM16058, and Development Review DRC2002-00951 to construct single- family residences on nine in-fill lots; and PLANNING COMMISSION RESOLUTION NO. 03-36 DRC2002-00950— NORTHTOWN HOUSING DEVELOPMENT CORPORATION March 12, 2003 Page 2 d. The application proposes reduction in lot area, lot width, and side yard setback consistent with established development in the neighborhood; and e. Allowing a variance from the required lot size, lot average, lot width, and side yard setbacks would not grant special privilege to the subject properties and would allow for affordable single-family homes as part of an affordable housing in-fill program within the community consistent with the surrounding development pattern. 3. Based upon the substantial evidence presented to this Commission during the above- referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above,this Commission hereby finds and concludes as follows: a. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship for the applicant, thereby denying him the ability to develop affordable housing for the community. b. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of this property that do not apply generally to other properties in the same district. C. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district, and would not enable development consistent with the objective of the project, which is to construct affordable single-family homes to provide needed housing in the community. d. That the granting of the variance would not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. e. That the granting of the variance will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Commission hereby approves the application. 5. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 12TH DAY OF MARCH 2003.
