HomeMy WebLinkAbout03-110 - Resolutions RESOLUTION NO. 03-110 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING DEVELOPMENT REVIEW DRC2003-00241,A DESIGN REVIEW OF BUILDING ELEVATIONS AND DETAILED SITE PLAN FOR 42 SINGLE-FAMILY LOTS ON 6.59 ACRES OF LAND OF TRACT 16314 IN THE AMENDED TENTATIVE TRACT MAP 15974 WITHIN THE VICTORIA ARBORS MASTER PLAN IN THE VICTORIA COMMUNITY PLAN, EAST OF DAY CREEK BOULEVARD, GENERALLY NORTH OF CHURCH STREET, AND MAKING FINDINGS IN SUPPORT THEREOF- APN: 0227-161-41 thru 47. A. Recitals. 1. Standard Pacific filed an application for the approval of Development Review DRC2003-00241, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application." 2. On the 27th day of August 2003, the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Commission during the above- referenced meeting on August 27, 2003, including written and oral staff reports, this Commission hereby specifically finds as follows: a. The property to the north and east of the project site are vacant and Joseph Filippi Winery adjoins the project to the north. Church Street is generally to the south of the site, and across Day Creek Boulevard to the west is vacant land and land under construction for a single- family residential project; and b. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity; and C. The project design is consistent with the Victoria Arbors Master Plan and the following goals and policies: i) The proposed residential uses are compatible to adjacent single-family uses as opposed to more intense multi-family uses. ii) The proposed infill project would create opportunities of a population that reflect income, age, occupation, race, ethnic background lifestyle, values, interest, religion, and may interact, exchange ideas, and realize common goals that are similar to the existing neighborhood to the west. PLANNING COMMISSION RESOLUTION NO. 03-110 DRC2003-00241 — STANDARD PACIFIC August 27, 2003 Page 2 iii) The proposed use is in close proximity of a transportation network that is consistent with community goals. The project would eventually be a part of infill single-family residences within proximity to the 1-15 Freeway to the east via Base Line Road and Foothill Boulevard, and the 210 Freeway to the north via Day Creek Boulevard. 3. Based upon the substantial evidence presented to this Commission during the above- referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above,this Commission hereby finds and concludes as follows: a. That the Development Review is consistent with the General Plan and the Victoria Arbors Master Plan; and b. The design or improvements of the tentative tract is consistent with the General Plan and the Victoria Arbors Master Plan; and C. The site is physically suitable for the type of development proposed; and d. The design of the project is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and e. The project is not likely to cause serious public health problems; and f. The design of the project will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. An Environmental Impact Report (EIR)(State Clearinghouse No.8808291)was prepared and certified by the City Council as a Master Environmental Impact Report for the Victoria Arbors Master Plan. The California Environmental Quality Act (CEQA) provides that once a Master Environmental Impact Report has been certified, no further Environmental Impact Report or Negative Declaration is required for subsequent projects within the scope of the Master Environmental Impact Report. On July 7, 1999,the City Council certified a supplement to the Environmental Impact Report (State Clearinghouse No. 98041137). Based upon the facts and information contained in the certified Environmental Impact Report, together with all written and oral reports, the Planning Commission finds that there is no substantial evidence that the project will have a significant effect upon the environment. a. There have not been substantial changes in the project that require major revisions to the previous Environmental Impact Report because of new significant environmental effects or substantial increase in the severity of the previously identified significant effects. b. There have not been substantial changes with respect to the circumstances under which the project is undertaken, which will require major revisions to the previous Environmental Impact Report because of the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. C. There is no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the Environmental Impact Report was certified as complete, that shows any of the following: 1) the project will have one or more significant effects not discussed in the previous Environmental Impact Report; 2) significant effects previously examined will be substantially more severe than shown in the previous Environmental Impact Report; 3) mitigation measures or alternatives previously found not to PLANNING COMMISSION RESOLUTION NO. 03-110 DRC2003-00241 — STANDARD PACIFIC August 27, 2003 Page 3 be feasible would in fact be feasible, and would substantially reduce one or more significant effects of the project but the project proponents decline to adopt the mitigation measure or alternative; or4) mitigation measures or alternatives,which are considerably different from those analyzed in the Final Environmental Impact Report, would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division: 1) Construct blockwalls with caps between homes(i.e., along interiorside and rear property lines) for permanence, durability, and design consistency rather than wood fencing. Decorative block walls shall be provided on all perimeter tract, street side yard, and front return walls. 2) Access gates to the rear yards shall be constructed from a material more durable than wood gates. Acceptable materials include, but are not limited to, wrought iron and plastic. 3) All pertinent Conditions of Approval contained in Development Agreement 00-04 shall apply. 4) All Conditions of Approval per Planning Commission Resolution No. 01- 25 for Tentative Tract 15974 shall apply. 5) All, Conditions of Approval per Planning Commission Resolution Nos. 01-23 and 03-54 for Development Review 01-04 shall apply. 6) The developer shall provide each prospective buyer written notice of the winery. The written notice must disclose the uses and operation within the winery and in a format as approved by the City Planner, prior to issuance of building permits. 7) The developer shall provide each prospective buyer written notice of the Victoria Gardens Regional Center, the neighborhood shopping center located at the southeast comer of Base Line Road and Day Creek Boulevard, and the Cultural Arts Center. The standard format for the written notice shall be submitted for City Planner review and approval prior to issuance of building permits. 8) Submit standard design of future trellis, patios, or covered patios that may be added within the rear yard by the homeowners for City Planner review. The standard design shall include notes stating that rolled roof, metal, shingles, and asphalt shingles are not allowed. The standard design shall be added to the Victoria Arbors Master Plan. 9) Landscape all front and side yards that are visible from the public right-of-ways. PLANNING COMMISSION RESOLUTION NO. 03-110 DRC2003-00241 — STANDARD PACIFIC August 27, 2003 Page 4 10) Where rock cobble is used, it shall be real, native fieldstone. Other forms of stone, such as stacked stone or ledgestone, may be manufactured products. 11) Comer lots shall have parkway adjacent to the curb. 12) All walls visible from or facing a street shall be decorative masonry on both sides. 13) Avoid identical or similar elevation schemes plotted on adjacent lots or across the street from one another. 14) Provide conduit to connect to the street, pre-wire houses/buildings for fiber-optic use (minimum Category 5 and RG-6), prior to release of occupancy. Plans shall be submitted for City Planner review and approval prior to issuance of building permits. Engineering Division: 1) Provide a minimum of 3-inch conduit for future fiber-optic use on all streets with connection through the parkway to each lot or parcel. Submit the size, placement, location, and the provider of the conduit for City Engineer review and approval, prior to issuance of grading permits or final map approval, whichever occurs first. 2) The Traffic Impact Analysis fair share traffic mitigation for improvements within the City shall be accomplished through the City's established Transportation Fee Program. The Traffic Impact Analysis fair share traffic mitigation for improvements outside the City limits shall be proportionally paid prior to each final map recordation. Fair share amount for DRC2003-00241 is $18,932.03, and DRC2003-00242 is $14,471.29. 3) School bus route study, including loading and unloading areas, shall be determined and coordinated with the school district, and any improvements recommended by the study shall be required and completed to the satisfaction of the City Engineer. 4) All internal residential streets shall be developed in accordance with the City's"Local Street"standard with typical mid-block section curb-to-curb distance of 36 feet, (lane widths of 18 feet — 18 feet, except at intersections). 5) Entry statements identified by the Victoria Community Plan and Day Creek Boulevard Master Plan shall be accepted into the City's Landscape Maintenance District. All others shall be maintained through a Home Owners Association (HOA). 6) Street trees per City Standards shall be provided for all interior streets. Each unit shall drain to the street or a public approved facility. 8) Landscape Maintenance District(LMD)areas shall have a maximum of 3:1 slopes with a maximum retaining wall of 30 feet, except the east side of Day Creek Boulevard shall have a maximum slop of 4:1. Top of slope and toe of slope shall have a minimum one-foot flat area to pedestrian walkways(two-foot flat area at top of slope for larger slopes) per City Standard. 9) Parkways shall be two percent from top of curb to back of walk. Environmental Mitigation: 1) The applicant shall implement all pertinent mitigation measures adopted in the Master Environmental Impact Report Victoria Arbors Master Plan as covered by the Environmental Impact Report as certified by the City Council of the City of Rancho Cucamonga. The project shall comply with the Mitigation Monitoring Program contained in the Final EIR entitled "Final Environmental Impact Report Victoria Arbors Village SCH No. 98041137," except for Mitigation Measures 4.7.3A, 4.7.38, and 4.7.3D. 6. APPLICANT SHALL CONTACT THE PLANNING DIVISION,(909)477-2750,FOR COMPLIANCE WITH THE FOLLOWING CONDITIONS: A. General Requirements Completion Date 1. The applicant shall agree to defend at his sole expense any action brought against the City, its _J—j— agents,officers,or employees,because of the issuance of such approval,or in the alternative,to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any Court costs and attorneys fees which the City, its agents, officers, or employees may be required by a court to pay as a result of such action. The City may,at its sole discretion,participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his obligations under this condition. 2. Copies of the signed Planning Commission Resolution of Approval No. 03-110, Standard —j--j— Conditions, and all environmental mitigations shall be included on the plans (full size). The sheet(s) are for information only to all parties involved in the construction/grading activities and are not required to be wet sealed/stamped by a licensed Engineer/Architect. B. Time Limits 1. This tentative tract map or tentative parcel map shall expire, unless extended by the Planning Commission, unless a complete final map is filed with the City Engineer within 3 years from the date of the approval. 2. Conditional Use Permit, Variance, or Development/Design Review approval shall expire if building permits are not issued or approved use has not commenced within 5 years from the date of approval. No extensions are allowed. C. Site Development 1. The site shall be developed and maintained in accordance with the approved plans which include site plans,architectural elevations,exterior materials and colors,landscaping,sign program,and grading on file in the Planning Division, the conditions contained herein, Development Code regulations, and the Victoria Arbors Master Plan. SC-07-03 1 Project No. DRC2003-00241 Completion Date 2. Prior to any use of the project site or business activity being commenced thereon,all Conditions of Approval shall be completed to the satisfaction of the City Planner. 3. Occupancy of the facilities shall not commence until such time as all Uniform Building Code and State Fire Marshal regulations have been complied with. Prior to occupancy, plans shall be submitted to the Rancho Cucamonga Fire Protection District and the Building and Safety Division to show compliance. The buildings shall be inspected for compliance prior to occupancy. 4. Revised site plans and building elevations incorporating all Conditions of Approval shall be submitted for City Planner review and approval prior to the issuance of building permits. 5. All site, grading, landscape, irrigation, and street improvement plans shall be coordinated for consistency prior to issuance of any permits (such as grading, tree removal, encroachment, building,etc.) or prior to final map approval in the case of a custom lot subdivision, or approved use has commenced, whichever comes first. 6. Approval of this request shall not waive compliance with all sections of the Development Code,all other applicable City Ordinances, and applicable Community or Specific Plans in effect at the time of building permit issuance. 7. A detailed on-site lighting plan, including a photometric diagram,shall be reviewed and approved by the City Planner and Police Department(477-2800) prior to the issuance of building permits. Such plan shall indicate style, illumination, location,height,and method of shielding so as not to adversely affect adjacent properties. 8. If no centralized trash receptacles are provided,all trash pick-up shall be for individual units with all receptacles shielded from public view. 9. All ground-mounted utility appurtenances such as transformers, AC condensers, etc., shall be located out of public view and adequately screened through the use of a combination of concrete or masonry walls,berm ing,and/or landscaping to the satisfaction of the City Planner. For single- family residential developments,transformers shall be placed in underground vaults. 10. Street names shall be submitted for City Planner review and approval in accordance with the adopted Street Naming Policy prior to approval of the final map. 11. All building numbers and individual units shall be identified in a clear and concise manner, including proper illumination. 12. The Covenants, Conditions, and Restrictions (CC&Rs) and Articles of Incorporation of the Homeowners'Association are subject to the approval of the Planning and Engineering Divisions and the City Attorney. They shall be recorded concurrently with the Final Map or prior to the issuance of building permits, whichever occurs first. A recorded copy shall be provided to the City Engineer. The Homeowners' Association shall submit to the Planning Division a list of the name and address of their officers on or before January 1 of each and every year and whenever said information changes. 13. All parkways, open areas, and landscaping shall be permanently maintained by the property owner,homeowners'association,or other means acceptable to the City. Proof of this landscape maintenance shall be submitted for City Planner and City Engineer review and approved prior to the issuance of building permits. 14. The developer shall submit a construction access plan and schedule for the development of all lots for City Planner and City Engineer approval; including, but not limited to, public notice requirements,special street posting,phone listing for community concerns,hours of construction activity, dust control measures, and security fencing. 15. Six-foot decorative block walls shall be constructed along the project perimeter. If a double wall condition would result, the developer shall make a good faith effort to work with the adjoining property owners to provide a single wall. Developer shall notify, by mail,all contiguous property owner at least 30 days prior to the removal of any existing walls/ fences along the project's perimeter. SC-07-03 2 Project No. DRC2003-00241 Completion Date 16. Construct block walls between homes(i.e.,along interior side and rear property lines),rather than wood fencing for permanence, durability, and design consistency. 17. Access gates to the rear yards shall be constructed from a material more durable than wood gates. Acceptable materials include, but are not limited to, wrought iron and PVC. 18. For residential development, return walls and corner side walls shall be decorative masonry. 19. On corner side yards, provide minimum 5-foot setback between walls/fences and sidewalk. 20. Where rock cobble is used,it shall be real river rock. Other stone veneers may be manufactured products. D. Building Design 1. All dwellings shall have the front,side and rear elevations upgraded with architectural treatment, detailing and increased delineation of surface treatment subject to City Planner review and approval prior to issuance of building permits. 2. Standard patio cover plans for use by the Homeowner's Association shall be submitted for City __J-__J_ Planner and Building Official review and approval prior to issuance of building permits. 3. All roof appurtenances, including air conditioners and other roof mounted equipment and/or projections, shall be shielded from view and the sound buffered from adjacent properties and streets as required by the Planning Division. Such screening shall be architecturally integrated with the building design and constructed to the satisfaction of the City Planner. Details shall be included in building plans. E. Parking and Vehicular Access (indicate details on building plans) 1. Multiple car garage driveways shall be tapered down to a standard two-car width at street. 2. On flag lots, use a 12-foot driveway within flag to maximize landscape area. F. Trip Reduction 1. Category 5 telephone cable or fiber optic cable shall be provided for office buildings and single- family developments of 500 or more units. G. Landscaping 1. A detailed landscape and irrigation plan, including slope planting and model home landscaping in the case of residential development, shall be prepared by a licensed landscape architect and submitted for City Planner review and approval prior to the issuance of building permits or prior final map approval in the case of a custom lot subdivision. 2. All private slopes of 5 feet or more in vertical height and of 5:1 or greater slope,but less than 2:1 slope, shall be,at minimum, irrigated and landscaped with appropriate ground cover for erosion control. Slope planting required by this section shall include a permanent irrigation system to be installed by the developer prior to occupancy. 3. All private slopes in excess of 5 feet, but less than 8 feet in vertical height and of 2:1 or greater. slope shall be landscaped and irrigated for erosion control and to soften their appearance as follows: one 15-gallon or larger size tree per each 150 sq.ft.of slope area, 1-gallon or larger size shrub per each 100 sq.ft.of slope area, and appropriate ground cover. In addition,slope banks in excess of 8 feet in vertical height and 2:1 or greater slope shall also include one 5-gallon or larger size tree per each 250 sq. ft. of slope area. Trees and shrubs shall be planted in staggered clusters to soften and vary slope plane. Slope planting required by this section shall include a permanent irrigation system to be installed by the developer prior to occupancy. SC-07-03 3 Project No. DRC2003-00241 Completion Date 4. For single-family residential development, all slope planting and irrigation shall be continuously maintained in a healthy and thriving condition by the developer until each individual unit is sold and occupied by the buyer. Prior to releasing occupancy for those units, an inspection shall be conducted by the Planning Division to determine that they are in satisfactory condition. 5. Front yard and corner side yard landscaping and irrigation shall be required per the Development Code and the Victoria Arbors Master Plan. This requirement shall be in addition to the required street trees and slope planting. 6. The final design of the perimeter parkways,walls,landscaping,and sidewalks shall be included in the required landscape plans and shall be subject to City Planner review and approval and coordinated for consistency with any parkway landscaping plan which may be required by the Engineering Division. 7. Special landscape features such as mounding, alluvial rock, specimen size trees, meandering sidewalks (with horizontal change),and intensified landscaping, is required along Church Street and Day Creek Boulevard. 8. Landscaping and irrigation systems required to be installed within the public right-of-way on the perimeter of this project area shall be continuously maintained by the developer. 9. All walls shall be provided with decorative treatment. If located in public maintenance areas,the design shall be coordinated with the Engineering Division. H. Signs 1. The signs indicated on the submitted plans are conceptual only and not a part of this approval. Any signs proposed for this development shall comply with the Sign Ordinance and shall require separate application and approval by the Planning Division prior to installation of any signs. I. Environmental 1. The developer shall provide each prospective buyer written notice of the 210 and 1-15 Freeways in a standard format as determined by the City Planner,prior to accepting a cash deposit on any property. 2. A final acoustical report shall be submitted for City Planner review and approval prior to the issuance of building permits. The final report shall discuss the level of interior noise attenuation to below 45 CNEL, the building materials and construction techniques provided, and if appropriate,verify the adequacy of the mitigation measures. The building plans will be checked for conformance with the mitigation measures contained in the final report. 3. The applicant shall submit certification from an acoustical engineer that all recommendations of the acoustical report were implemented in construction, including measurements of interior and exterior noise levels to document compliance with City standards. Certification shall be submitted to the Building&Safety Division prior to final occupancy release of the affected homes. 4. Mitigation measures are required for the project. The applicant is responsible for the cost of implementing said measures, including monitoring and reporting. Applicant shall be required to post cash, letter of credit, or other forms of guarantee acceptable to the City Planner in the amount of $719.00 prior to the issuance of building permits, guaranteeing satisfactory performance and completion of all mitigation measures. These funds may be used by the City to retain consultants and/or pay for City staff time to monitor and report on the mitigation measures. Failure to complete all actions required by the approved environmental documents shall be considered grounds for forfeit. SC-07-03 4 Project No. DRC2003-00241 Completion Date I Other Agencies 1. The applicant shall contact the U.S. Postal Service to determine the appropriate type and location of mailboxes. Multi-family residential developments shall provide a solid overhead structure for mailboxes with adequate lighting. The final location of the mailboxes and the design of the overhead structure shall be subject to City Planner review and approval prior to the issuance of building permits. APPLICANT SHALL CONTACT THE BUILDING AND SAFETY DIVISION,(909)477-2710, FOR COMPLIANCE WITH THE FOLLOWING CONDITIONS: NOTE: ANY REVISIONS MAY VOID THESE REQUIREMENTS AND NECESSITATE ADDITIONAL REVIEW(S) K. General Requirements 1. Submit five complete sets of plans including the following: a. Site/Plot Plan; b. Foundation Plan; C. Floor Plan; d. Ceiling and Roof Framing Plan; e. Electrical Plans(2 sets,detached) including the size of the main switch, number and size of service entrance conductors, panel schedules, and single line diagrams; f. Plumbing and Sewer Plans, including isometrics, underground diagrams,water and waste diagram, sewer or septic system location, fixture units, gas piping, and heating and air conditioning; and g. Planning Division Project Number(i.e., DRC2003-00241)clearly identified on the outside of all plans. 2. Submit two sets of structural calculations, energy conservation calculations, and a soils report. Architect's/Engineer's stamp and "wet" signature are required prior to plan check submittal. 3. Contractors must show proof of State and City licenses and Workers'Compensation coverage to the City prior to permit issuance. 4. Separate permits are required for fencing and/or walls. 5. Business shall not open for operation prior to posting the Certificate of Occupancy issued by the Building and Safety Division. L. Site Development 1. Plans shall be submitted for plan check and approved prior to construction. All plans shall be marked with the project file number(i.e., DRC2003-00241). The applicant shall comply with the latest adopted California Codes, and all other applicable codes, ordinances, and regulations in effect at the time of permit application. Contact the Building and Safety Division for availability of the Code Adoption Ordinance and applicable handouts. 2. Prior to issuance of building permits for a new residential project or major addition,the applicant _/_J_ shall pay development fees at the established rate. Such fees may include,but are not limited to: City Beautification Fee, Park Fee, Drainage Fee,Transportation Development Fee, Permit and Plan Check Fees,and School Fees. Applicant shall provide a copy of the school fees receipt to the Building and Safety Division prior to permit issuance. SC-07-03 5 Project No. DRC2003-00241 Completion Date 3. Street addresses shall be provided by the Building and Safety Official after tract/parcel map recordation and prior to issuance of building permits. 4. Construction activity shall not occur between the hours of 8:00 p.m. and 6:30 a.m. Monday through Saturday, with no construction on Sunday or holidays. M. New Structures 1. Provide compliance with the California Building Code (CBC) for property line clearances considering use, area, and fire-resistiveness. 2. Provide compliance with the California Building Code for required occupancy separations. 3. Roofing material shall be installed per the manufacturer's "high wind" instructions. N. Grading 1. Grading of the subject property shall be in accordance with California Building Code,City Grading Standards, and accepted grading practices. The final grading plan shall be in substantial conformance with the approved grading plan. 2. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. 3. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. 4. The final grading, appropriate certifications and compaction reports shall be completed, submitted, and approved by the Building and Safety Official prior to the issuance of building permits. 5. A separate grading plan check submittal is required for all new construction projects and for existing buildings where improvements being proposed will generate 50 cubic yards or more of combined cut and fill. Existing City roads requiring construction shall remain open to traffic at all times with adequate detours during construction. Street or lane closure permits are required. A cash deposit shall be provided to cover the cost of grading and paving,which shall be refunded upon completion of the construction to the satisfaction of the City Engineer. g. Concentrated drainage flows shall not cross sidewalks. Under sidewalk drains shall be installed to City Standards, except for single family residential lots. h.
